    • Today , after a lotof years i recieved a letter from this lot. Very friendly, "Were writing to remind you that we havent had any contact from you in a while".  The velvet fist, followed by  a veiled threat to get their preferred debt collectors involved. Yep dead right. In 1992/3 I took out a Student load under duress from DHSS. uP TO 2000 I hadsucessfully gotten deferment on low income. But rarther thansign on as unemployed,I decided to be self employed. I applied and they asked for all sorts of documents. I obliged and then correspondance ceased from them, circa 2001. To date  I have had no correspondance from Student Loans. I was made  redundant in 2009 and  reached 65 in 2012 , at which age the loan should have been cancelled. Now ,today, 12 years on retirement and 11 ( at least years after last contact) I get a letter with veiled threats. Do I , as I smell a scam a) ignore it and hope that Erudio will think that this phishing attempt has failed or b) respond with a statute barred letter or c) remind them of legal terms that loan should be cancelled 12 years ago or d) combination of b) +c)      
    • But I'm not mixing and matching. Sure, when researching I do check multiple avenues, but when speaking, I will open a single post. The Fb post was made in March, it is now June, time has passed, and when the suggestion was made, no further information was given on how I should progress beyond "send a letter", which has meant that I've needed to start another stream - this one, but only after taking the time to research first.
    • hes not turning you away he is simply saying that you should stick to one channel of advice. he is perfectly happy with that channel being this forum, and he will help you   all he is saying, and I agree, is that you should stick to one help channel, not mix and match 3/4
    • As long as we are clear . Do the reading and post your letter of claim in draft form as requested and we can go from there.    
    • Hold on @BankFodder, that was a bit harsh. I spoke with the EVRi complaints Facebook group to begin with, a user on that group told me to send a letter but didn't give any specifics. Here at CAG, I was looking more for specific help as I've never raised such a claim before, and wanted to be sure that my claim was correct, which is why I've researched information with the other groups too, to be sure; but you seem to have assumed that I've made some form of contact with the other groups, such that I find your comments and tone to be very unfair. And I do know a thing or two about forums, that forum users are unpaid volunteers, I happen to be a Tableau Ambassador, and so perform a very similar role helping others in an unpaid capacity

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I CCAd the Bank of Scotland on 14th January 2008, I have the signed POD from the Royal Mail website to say that the letter was signed for on the 18th.

 

Today, I have received a Default letter dated 17th January 2008. Because they use the prepaid system of postage there isnt a posting date on the envelope !!

 

Is it likely that they would have backdated any correspondence so they can say they sent the default before they received my CCA request?

 

The 17th was a Thursday, and I am finding it hard to believe that this IMPORTANT/URGENT letter has taken 6 delivery days to reach me when their previous bog standard threatograms are usually delivered 2 days from date of letter.

 

What should I be doing now please? I am supposed to respond to this default notice before the 31st January.

They have 12+2 WORKING days to provide this if they dont then they are in default of your request if after a further 30 CALENDAR days, they have committed an offence under the Consumer Credit Act. It is at that stage you should complain to the FOS, their local trading standards and the OFT....

It may be worth you scanning and posting the default notice here (obscure your personal details) so that 'those in the know' can take a look and advise you if it is valid or not.

 

That is precisely what I was recently advised about a default notice I had received, and lo and behold it was deemed to be invalid by pt2537 :), and has therefore hopefully become a lethal weapon to use against the claimant (HFC) in their ongoing case against me.

Here is the letter from BOS, on the 2nd page next post down, I dont understand the bit where it says DH can 'apply to the court which may make an order allowing you or any surety more time. ' What court?, they say they will be passing the debt to a DCA, nothing about a court appearance !

I'm certainly no expert on this, but the actual format and dates of the default look OK, although I'm not sure of the requirements of a default notice for an overdraft. Is this a loan or an overdraft?

 

However there is mention of the arrears containing 'charges', so maybe someone more knowledgeable will have some good news for you if they happen to look in on your thread.

I have sent both CCA and SAR letters to Bank of Scotland. They still have a week or so before they breach the SAR. However in the post today I received a letter dated 4th February. It terminates the account and states that within the next 48 hours the account will be referred to a Debt Recovery Agent.

 

It is becoming very frustrating that letters are taking so long to be delivered. Especially as I am paying out £4.30 a letter to ensure swift delivery and signature. I notice that this was a 2nd class mailing as well.

 

Should I write again enclosing copies of the letters already sent.. pointing out that they are in breach by referring to a DCA or just wait for the DCA to write and send them a letter telling them they are aiding and abbetting a crime.

Hi CB,

 

This may have been better posted on your Bank of Scotland thread so your case stays in one place - easier for all to follow.

 

Their action could be construed as retaliatory which can be challenged. See here - http://www.consumeractiongroup.co.uk/forum/bank-templates-library/106950-what-do-if-your.html

 

However the most important thing is that you have a parachute a/c set up and ready to use if you need it.

 

I doubt you'd do much good sending copy letters off again. Just deal with any new contact from a DCA as nec'y - ie confirm that the debt is the subject of SAR and CCA requests which remain unanswered.

 

BTW, £4.30 is a lot to pay per letter. You can send plain Rec'd Del'y for just £1.04 (?) or send normal post but ask PO counter for Certificate of Posting (free).

The reason I am sending by Special delivery is that so many of the Recorded Delivery letters dont seem to be signed for. I hve been checking the RM website for one particular letter sent 2 weeks ago and it doesnt even appear to have been delivered. Many thanks for the link .

I CCA'd Bank of Scotland on 12th January, followed that up on the 26th January. To date they have not responded with an agreement.

 

Early June, I received a Notice of Intended Court Action letter from Blair, Oliver and Scott. I sent them a request under the Pre-Action Practice Directions - Civil Procedure Rules asking for the information. They sudeenly went quiet.

 

I then received "We are keen to deal with your concern" letters from Bank of Scotland and then letters from APEX Credit Management Ltd advising that the account had been passed on to them.

 

I advised APEX the account was in dispute and SAR'd Bank of Scotland on 30th June, they signed for this on 2nd July.

 

On 16th July I received another letter from Bank of Scotland in response to "my latest letter dated early June" ? The information I requested I am advised falls under the SAR, although the author was prepared to waive the £10.00 fee.

 

I wrote back advising the clown above, that having requested the credt agreement on no less than 8 occasions I was rather astonished at his cheek. I pointed out that meanwhile I had already sent £10.00 and expected to receive the documents that I had now paid for a 2nd time.

 

On the same day I received a 2nd letter from a different department. Enclosing details of how they work out Credit Scoring and advising that documetns I am entitled to receive will be supplied as soon as possible.

 

On 18th July, I received a set of statements from APEX, I wrote back advising theirs and Bank of Scotland's obligation had not been fulfilled and detailed AGAIN what I required.

 

Today a letter received from APEX.

 

It is marked "Without Prejudice" .... WHY ??

 

Although the letter is addressed to OH, the Dear Mr XXX is not OH's name but someone else??.

 

It then goes on to say, I refer to your complaint dated XX July requesting details of the date we hold relating to your account. They have supplied all they hold and to get in contact with Bank of Scotland for any thing else.

 

Do you get the feeling I am being given the run around ?

So does the data they sent relate to OH or someone else.

 

If the latter, a complaint to Info Commissioners Office would be in order !

 

The run around - certainly. But until they produce an agreement, there's little they can do now.
