I have an old credit card with Clydesdale which I have more than paid off. The remaining amount is charges of £22.50 x lots plus interest and I have asked them to write off the account!! However in spite of all the information we have about their charging system they are still arguing that their charges are fair.

 

Obviously I have no intention of paying them, although I have to admit that their CCA is about the only one I have received which could be correct:evil:.

 

But how can they continue to bang on about their charges being fair? Do they think I am a mushroom?

Sorry to say but this is par for the course.

I'm having a similar fight with B'card where the outstanding balance is completely charges, yet they refuse to move.

So instead they are passing it around the "great and the good" of the DCA world.

Hey I must admit I don't mind as I get to see how these "people" operate.

I'm just waiting for them to file on me as I've always wanted to couterclaim for a higher amount ;)

No, it's the latest sport! A year ago we had everything to lose - now we are fighting tooth and nail and getting amazing results. The worm turns.

 

Clydesdale haven't managed to do the DCA bit yet - but I have had fun with B'card (cr*p CCA) - have met DLC, Hillesden and had a great time with Ruthbridge - waiting to see who we get next. Was back with DLC a couple of weeks ago and we get automated messages on the answerphone.

Well the OFT wouldn't agree that 22.50 is fair so I suggest you just start claiming back the charges as credit card claims shouldn't be affected by stays.

Or would it make more sense to wait and see if they do issue proceedings and then do a counterclaim? If I went after them they would probably only owe me about £50 so it seems like a lot of hassle. I have told them they aren't getting any more money from me...

Your first post implies it's more than 50.00. Is there some other reason for not paying off the account? IMO you risk a CCJ or default if you wait for them to take action.

Hi Caro, thanks for the reply. I didn't make it clear but the account balance is over £600 and when I calculated the charges over the years plus interest thereon they owe me about £620. I already have a default on it. I have written and explained the 'we are equal' situation to them. Additionally they were the only one of my creditors who refused to freeze interest when I got in difficulties and one of the few (interestingly small ones) who refused to accept my reduced offer via the CAB. I only ever spent about £300 on this card and have paid them back far more than that.

So you are owed more than 50.00 with the interest, assuming that's just interest on the charges. I would have thought it worth considering claiming back the charges and trying to get the default removed, depending on how much the default was for.

You are right Caro, however I am fighting an ongoing battle with several creditors and it is almost a full time job dealing with the correspondence, in addition to my more than full-time self-employment and having four kids. And of course spending endless hours on this site!! I suppose I could send them a LBA to show I am not going to take it lying down. Thanks for your input:)

I take your point Goldlady, but I think you have more chance of succeeding if you take the initiative, rather than wait to respond to Clydesdale when the time suits them.

 

You don't have to take on everyone at once though. I have some issues I need to deal with myself but other things seem to get in the way, so I know where you're coming from.lol

Update - as I have not paid them they have now instructed a specialised Debt Recovery Agency who will be contacting me shortly.... I am quaking in my boots:D. (would have been pre CAG days!). I wonder which of the wonderful agencies I will be hearing from. And guess what, they have charged me another £22.50 for sending me a two paragraph letter - suspect their typists are very well paid or they pay over the odds for their ink cartridges!!

 

Never got round to the LBA Caro, but might get down to it this weekend:p

Oh, and now several months later I have had a letter from Capquest. They are telling me that this debt will not go away. Actually Capquest I think you could be wrong. I haven't had dealings with Capquest as yet but I am sure this will be entertaining. I haven't decided whether to reply to their letter or just ignore them. Seems they have been sold this alleged debt with a boatload of others.
