The prescribed terms referred to are contained in schedule 6 column 2 of the Consumer Credit (Agreements) Regulations 1983 (SI 1983/1553) and are inter alia: - A term stating the credit limit or the manner in which it will be determined or that there is no credit limit, A term stating the rate of any interest on the credit to be provided under the agreement and A term stating how the debtor is to discharge his obligations under the agreement to make the repayments, which may be expressed by reference to a combination of any of the following-- 1. Number of repayments; 2. Amount of repayments; 3. Frequency and timing of repayments; 4. Dates of repayments; 5. The manner in which any of the above may be determined; or in any other way, and any power of the creditor to vary what is payable
  3. Oh yeah.. anyone know more about these Debt Relief Orders and in particular how invasive that would be on the home front? i.e my old mum being spared any knowledge of it all and having it all done in the background via post and phone maybe? nite all...(2am again!)
  4. Yeah thanks for the descriptive comment BRW. It certainly crossed my mind and i remembered not to give the home phone number! Luckily i really am without means and all the info these places wanted has been the same as what i have told the DCAs/Creditors so they won't learn anything they don't already know: Carer's Allowance + beat-up old car etc It stinks to high heaven how all these companies are tied together and operate behind the scenes.

  6. Annoyed at the moment. Had the car insurance renewal come in.. couple of quid less i think at about £125 fully comp with Swiftcover. Being me, i shopped around as i always do to see if i can get it cheaper and found Swinton doing a quote for £86 (£156 then £70 cash back if you stay with them. You'll get the cash after 90 days.) So i thought hey that's pretty good. £86 for the year. I emailed Swift and said that i need to save money this year and can they match that quote or at least come close to it and they replied: "Thank you for your e-mail. I can confirm that your insurance cover on ****** is due to renew at 00:01 on 14 May 2009. Swiftcover endeavours to offer the best value for money quotes, however for us to compare premiums with our competitors and for us to revisit your renewal please would you provide us with the following details in relation to the quote you have received: •Price quoted •Occupation selected •Annual mileage selected •Level of cover selected •Optional extra’s selected •Policy Excess Once we have this information, we will look into your renewal with a view to offering a more competitive quote. Under the Duty of Disclosure, it is your duty to inform us of any changes that might affect your policy. Failure to do so could invalidate your policy and any future claims. As soon as we get e reply we can proceed with your request. I hope this answers your query. So i gave the info which included a slight change in named occupation. I think last couple of years i have just put 'professional' but the quote from Swinton i used 'carer - professional' which was the closest match. Swift got back to me today with this: "Thank you for your e-mail. After amending your renewal details to match those stated by yourself below, your renewal premium comes to a total of £141.28, including Insurance Premium Tax. I have amended your cover to Comprehensive, (it was already!) selected a voluntary excess of £450, which would be paid in addition to a compulsory excess of £50. I have also changed your occupation to "Doctor, Nurse or Care Worker" which is the closest suit to your occupation. If you'd like to renew at this price, please reply to this e-mail stating your wish to do so." What?! So i have just emailed saying: "So thanks to the amendments my renewal quote has actually increased then.. and the simple answer to my original question is no: Swift can't compete or attempt to come anywhere near the Swinton quote of £86 for the year??" I've just cancelled the renewal and will keep shopping around! grrrrrrrr
  7. Balance still increasing by £10 a month i see. If they think they are going to pass the buck to the OC they have another think coming. No reply for now.. i'll wait and see what they come up with first.

  9. Sounds like Halifax have come unstuck there. Best things to do is start your own thread in this forum: Halifax Bank and Bank of Scotland - The Consumer Forums Top left is the 'new thread' button. An exact start date for the loan would be useful info. If you can't remember then checking your credit files should show that.   11. Knowledge is power. I'd still call for verification and once you have that make the formal written complaint.
  12. Doesn't sound much good to you with out the dates! If it was a basic letter requesting the info and not a SAR then send a Full SAR request. If they don't supply it within 40 days make a complaint to the ICO.

  14. I can't advise specifically in this but... It would have to have a missing debtors signature and be pre April 2007 to be classed as 'irredeemably unenforceable' although Judges can be very lax about even that. Without the lenders signature it would be only be 'improperly executed' and not outright 'unenforceable' so potentially could be enforced by a Court. It sounds like the finance company's solicitors have been adding extra info to try and support their case and that should certainly be pointed out. Hope others will pop along to give you more info though.

  16. They are asking a lot aren't they. 'What the data is for'?! That's nothing to do with them. You want it because you have run out of wallpaper for the bathroom. It's your data! I would call the ICO for information on this as i am sure they would (hopefully) agree that what the company is asking for is way OTT.
