Ive had the same reply. Every letter you send is dealt with as a complaint and takes 8 weeks to get a reply. Once ive deallt with JD williams and there misleading on a biblical scale i will deal these cretins who are still using the same dodgy practices as they did in the 70's.

what gets me with these catalogues is that requesting a catalogue you are 'deemed' to have agreed to the opening of a credit account with high interest and charges regulated under the cca and they think it is binding which is of course nonsense. I don't know how they are still getting away with it. They havent changed their dodgy practices since the 70's. -

Hi hooker, as they have issued a claim you need to acknowledge it. This will give you a further 14 days. When did your wife open the account? Have you asked for a copy of the credit agreement? (catalogues are notorious in not getting signed agreements) edit: Did you ever receive a default notice? -

As far as im aware, the dca was acting on behalf of the OC and that included the settlement they accepted.

Hi joski, though this might intertest you, it related to adverts made in 2002 and 2004. Television Advertising Complaints Reports Television Advertising Complaints Reports on both occasions they found the adverts were found misleading as they didnot contain a credit check was needed. They still do this on their adverts -

hi pinky69, you are right. I shouldnt really and wouldnt advocate anyone else doing it. I was trying to make a point that if they can get away with anything I could get away with being sarcastic. Even if they take and win in court they will still lose as I have 0 assets. My total belongings consist of 1 computer worth 100quid, a phone worth a fiver and my clothes. If you seen the state of them then many would say they are worth nothing . Thats it ! and i can never see it changing. Ive been a carer day and night since as long as I can remember and they wont get me down as i have better things to think about. Sorry for rambling and talking on sunflowers thread my applogies. -

hi i forgot I had a letter adding another £12 charge on sat. I was going to reply with the std "you cant as its in dispute" but thought I would have some fun instead. heres my reply off in post 2moro. Dear Sir/Madam Thank you for your letter dated 3/2/9. (copy enclosed). It is unfortunate for you that this account is in dispute and therefore your letter is irrelevant and against the guidelines of the OFT on debt collection, not that capitalone have ever taken any notice. I am still awaiting a reply to my letter dated 2/2/9. This is my final response on this matter. I am not in a position to enclose my complaints procedure as I do not entertain to complaints, similar to yourselves. Unfortunately you cannot complain to the Financial ombudsman service either as I am not apart of their service. As always I will only communicate in writing, attempting to phone will automatically enter your number into my exclusive "BT choose to refuse" list where a place is always available for such prestigeous creditor. from what I can see your husband didnt agree to any terms and conditions, not in writing anyway. I would send it back including a letter that you don't want it and you owe them nothing as it has already once been returned to them. Include an invoice for the postage costs.

hi housewife, the company you re dealing with is part of jd williams. The majority of their so called agreements dont actually exist. In my case they replied to the cca and said we dont have one and wont pursue but carried on - so i have issued against them under s127 of the cca. Im currently waiting for their defence to be submitted. Dpick has a good thread on jd williams / reliable collections http://www.consumeractiongroup.co.uk/forum/debt-collection-industry/104426-dpick-oh-reliable-collections.html - edit dpick has posted. His thread was an inspiration to me - thanks dpick Most customers pre 2007 ordered products from adverts in magazines or leaflets and sent them through the post or rang. These adverts only stated "subject to status" (their tv adverts still do)and mentioned nothing about credit agreements, apr, charge for credit etc etc. The problem they have is that ordering an item does not mean you are agreeing to a credit agreement (in my case i sent full payment with the order and it was ignored). They are supposed to send an agreement out to you and have signed and returned, but most dont. The ITC have already ruled twice that there TV adverts are misleading over credit checks and they are still using the "subject to status" on adverts. I am as part of my claim gathering evidence against them. I have found out so far (applies to all 30 + trading names): 1) Tv adverts dont display Typical APR. (not required at first glance but as you cant purchase anything without a credit check or credit agreement with credit limit then it is). 2) Their flyers / inserts / mag adverts contain an incentive(10% off first order) so must contain Typical APR. They don't. source : http://www.oft.gov.uk/shared_oft/business_leaflets/consumer_credit/oft016.pdf 3) Their Flyers / inserts / mag ads show cash prices, but you cant buy them with cash without having a credit check or credit agreement. source http://www.oft.gov.uk/shared_oft/business_leaflets/consumer_credit/oft016.pdf . All items sold on credit must be able to be bought by cash. There are 6.5 million flyers / inserts sent every month. source the insert house :: portfolio :: JD Williams 4) All of their 30+ websites do not have the APR in a prominent position and their terms and conditions relating to APR and charge for credit are hidden away, this is not allowed. Additionally, the APR must stand out in the prescibed format, it does not. 5) Their websites also offer discounts as an incentive to apply for credit and the Typical APR should be on the same page, it isnt. 6) Some of their TV adverts include "10% off your first order" and therefore must display the Typical APR, they dont. 7) Their TV adverts include "subject to staus". This has been ruled to be misleading. source Television Advertising Complaints Reports 8 ) You cant register on their websites (any of them) without having a credit check or entering into a credit agreement. Though it says this in around about way in the hidden terms it isnt clear when registering. The consumer does not know the total charge for credit before ordering (and automatically entering into an agreement). 11) As it is nomal for the customers of JD Williams to not receive the so called agreement then they also did not receive any cancellation rights under the agreement. I am currently working on a report to the OFT, the department for enterprise and trading standards as they have the remit for enforcement. I believe this company is misleading thousands if not hundreds of thousands of people. Jd Williams have 2 million accounts in total, I wonder how many are unenforceable, i suspect the majority. -
looking at the dates of the posts made it looks as tho you might have made a mistake in the extension of time allowed after acknowledging. It is a further 14 days after AC and not 28days. I seems as tho you entered no defence within the time limits so they went for default judgement. It looks as tho from post 39 onwards you were out of time

I had a read of some articles on the tessera website and this one Can Charging Orders Bolster Security? / Articles / Tessera seemed to enforce the use of chargeing orders. I wonder if there has been a rise in charging orders over the last few months

lol i know they are just petty. Wait while they get my next letter asking if ellie actually exists ! and if not who has been sending drival to me ? Its not the only supprise I had today, I went into asda to buy a sausage roll, I queued up like anyone else behind some old chap and when it was my turn to be served the cashier said "i think he was just a bit nervous" i thought " " and must have looked at her with a blank expression as I didnt have a clue what she was talking about. She then said "dont worry, for all he knew you could have been a murderer" :eek:infront of everyone I was so gobsmacked I walked away in disbelief. -

I might be missing something here but arnt experian supposed to remove the latest default (as you cant be defaulted twice for same debt). If they remove the older one that means the default is on the cra file much longer than 6 years? Basically they could default you every 3 years and it would never disappear Im pretty sure the capquest default should have been removed in stead of the original. Im tired so i might be wrong ofc -

hi fedup, Im about to cca marlin/pheonix over a hsbc loan for someone. I remember when they got the loan in 2002 and thought at the time (as I was helping them) that they had put the loan in to a new account they opened(without asking). The account number was I think 1 digit different to their normal current account. I wonder if Im gonna have trouble the same as you.
