regarding moorcroft increasing your payments, they did this to 2 people i know, I wrote to them telling them the increased payments were not agreed to and to place it back to how it was. They did return it to the lower payment as they know they dont have a leg to stand on.

Do you think i can ask this, im pretty sure i can as it is only a question not a statement. but with that pic you posted she might hide . but every time i think of it i start laughing and my ot thinks im mad as i start laughing for no reason -

Hi, would it be right to assume that the only way to actually tell if they are sending genuine or dodgy cca's is by going to their place and seeing the original or by having them ordered to produce it in court under cpr rules? -

Hi sunflower and all ! today I recieved the same as you did, both front and back from good old ellie. (love the pic, it made me chuckle). The thing is I do believe the front is genuine but I dont think the back is. I believe it has been cut and shut. It refers to section 23 etc when it clearly aint there. I dont believe that the terms and conditions that they say were on the back were. I suspect that red boomarang in their logo means they keep coming back lol -

hi mightacorn, 1) No they can't refuse a cca request due to no sig, write to them telling them the clock is still ticking and they previously sent you statements etc to that account so they know exactly who you are. 2) Bit more tricky as they did it before then 12 working days were up. Was the account in arrears or anything similar?. Not sure on that one. 3) if you want info under the CPR then it is Howard Cohen Sols of Cleckheaton as they are dealing with the court claim (their address should be on the form you recieved)

it has been helpful to me as I intend to do the same, have already sent a cca and recieved the usual rubbish. I have just replied requesting the original under CPR as I feel it will end up in litigation. Not heard anything back yet but I have to be patient with the CPR requests. It has also helped with my case against jd williams. Many thanks davey77

It is a possibility that they are pre-empting a claim from you through the court for the return of the charges and interest and so have credited to your account (rather than at some point give you a cheque). It might not be that but it is possible.

hi I have submitted a claim this week and if I win (or get settled) I will donate 10% to this and the same to cag. I dont have anything now,(it has taken me 3 weeks to save up for the court fee) and its a toss up to pay for shopping or gas/elec at the moment(its the elec this week ). I have read this thread from the start a while ago and I give my word I will do my best to help. Good luck and all the best

Can I ask a quick question, What is the point of experian adding all these posts to their bundle. if anything, if the judge actually reads them it will add more weight to uk26's argument not theirs? Uk26 has explained his argument and reasoning very clearly and all the posts show that all his actions have been considered carefully in compliance with the courts/laws. edit: if they have only included "certain"points that benefit them only then I would be inclined to print off every post and use it

I am following it myself currently with jd williams and littlewoods. Its a great post I have filed at court with jd williams and I have just sent off the letter with list of charges to littlewoods. They have 11 days to go and i will file at court against littlewoods too. My poc's are shorter than dpicks as i had to use mcol, but they did consist of the needed parts. My argument is that they have admitted they have no cca so I am asking the judge to declare in unenforceable and as there was no contract they had no right to claim charges and interest so I want it back. my thread http://www.consumeractiongroup.co.uk/forum/legal-issues/170617-version-jd-williams.html#post1840336

Hi, sorry I cant help on the age issue, but just as a thought, they would have done a credit check with the credit reference agencies and be reporting the monthly balance to them. Maybe an idea would be to get a copy from the cras. Im also not sure if they are allowed to hold data of someone who is not 18 yet. I think also the debt might be unenforceable but I think littlewoods could report her for fraud. A more knowledgable person will be along to clarify.
