  1. Received 36 letters today, my statements, postman thought it was april fools......lol well gone through my statements and i have a few questions. My account with halifax is a student account with an overdraft, so what do i do about the interest they debited? Do i add it all or just the interest i was debited when the charges took me over the overdraft limit? Also i have some charges for £2.50, £10, £12.50, £15, £28, £30 and £35. I don't know what these charges are for as statements just say 'Charges as notified' so when it comes to the schedule of charges, what do i state they are for, as i have no idea! Can anyone advise me?????
  2. Ok, took the N1 form into the court today, god it was scary. A very young man checked over the form for me, he was very helpful. I had missed my title off the form. Well now its a case of fingers crossed and see what happens.....lol
  3. Ok, well received this letter today, any advice as to what i should do next would be appreciated. Section 10 of DPA 1998 does not apply where consent is given to the use of data for the particular purpose concerned, or where it is needed to perform a contract to which the data subject is a party. ( Please see schedule 2 of DPA) When you opened the account you agreed to be bound by our account conditions. These give us the power to impose charges on customers' accounts and for the services and facilities that customers use. Customers are told about these charges in line with both our account conditions and the banking code. I appreciate that you are unhappy with the amount of the individual charges that have been applied to your account. However, there is no dispute over our right to make charges or the circumstances in which we impose them. Consequently section 10 does not apply to the circumstances of your request. Well that is their response to the s.10 letter!!!! Anyone else had a letter like this?
  4. Hi, I need some help and advice concerning a joint bank account that I had with my ex partner. My ex partner will not sign the form to have my name taken off the account. I do not have access to this account as such as I have no debit or cheque book. I keep receiving letters from halifax bank asking me to pay money into the account as it is over the overdraft limit. I have spoken to the bank who insist that I am still liable for this account. Is there anything i can do, I have told them that I will not pay the amount asked for and did tell them that i would be willing to state that in court if they take it that far.
  5. Help need please!!!! in the particulars of claim, what does the ' in respect of £3' mean, that bit confuses me!!!! Which swindon address do i use on the N1 as i have about 3 different ones? Just waiting for help with this and then will be taking in the N1 form, a week late but nevermind.

Letter received today from halifax stating: Statements have been ordered and be sent under seperate cover and that HBOS can't assist me with my request for information relating to manual intervention on my account as they are under no statutory obligation to record this information. Anyway i will just have to wait and see how much they owe me when the statements come and as for manual intervention, well its just what i expected they would say.
  7. Congratulations I have just read your thread from beginning to end and was fascinated. I have just sent for my statements from halifax and i hope that it all goes well for me. Just in the process of filling out the N! form for nationwide too.
  8. I have a natwest and a co-op cashminder accounts, they were really simple to open and didn't require any bank statements, natwest is quicker to open, especially when applying on line.

I am in the process of filling in the N1 form as i cannot do the money claim as i don't have to pay court fees so i have to take mine into the court and prove that i'm exempt, so i'm not sure which is better. I think the N1 form is more professional but the money claim is easier and more convient.

  14. I to have had problems with council tax and baliffs. If they haven't entered the house they cannot take anything and don't ever let them in. What i did was visit the CAB asap and they called the baliffs to come to an arrangement. You can ask for the CAB to do an expenditure form for you which you will need to send off to the baliffs anyway. My arrangement was declined at first and then i told them that i was not willing to pay anymore and they accepted it due to the fact that I had taken advice from the CAB.

  16. Thanks dolly, again another question, the particulars of claim, do i print this on a seperate sheet and attach it to the form? I know i sound really stupid but i'm just nervous about getting it wrong. Also which address do i put for nationwide, the member accounts add or is it another one?

  18. is that using the spread sheet? i have just used the online spread sheet to work mine out.
  19. Just wait till you get to the court claim stage...lol....now that is daunting. Anyway, good luck with your claim, i hope to have mine back soon.
  20. Sorry another question. When i'm filling in the spread sheet to calculate interest, in the list do i add the interest debited also or is it just the dd and overdraft charges?
  21. Hi, HKS, thanks for your help. This might sound silly but on the N1 form at the beginning do you just put your name in the claimant part or your name and address and in the particulars of claim, do i leave the 'court costs' line in or delete it as i don't pay court costs?
  22. I have just read your thread and I am very puzzled as to why you haven't received the amount claimed. Which stage did you get too? If you took them to court then the bank pays your court charges ontop of the amount claimed and the 8% interest added. I don't understand whats happened?

HELP.....Ok, i'm not blonde but i think i should be as i have been staring at the N1 form and freaking out as i need to get this right, so the question i have may sound stupid and the answers are probably simple but i'm freaking out and need help filling in the N1 form. Ok I was wondering if anyone knew what to put in the brief details and value section. I have an idea, just not sure how to word it, any help would be appreciated. Thanks

Ok got another letter today, it seems that they think that i never recieved their first reply to the prelim, so after recieving my lba letter they have resent their original reply with the reply to the lba letter, why i have no idea as both letters are nearly identical. Pillocks!!!! Come next week i will be filing my claim.
