  1. Stick to your timetable and ignore theres, they tell everyone it will take 4 weeks, but remember you at asking for your money back, so you set the time limits. I wonder what they would say if it was the other way round and we sent them a letter stating it would take 4 weeks for us to look into their request....lol
  2. Hi Frankie, why wouldn't you want to claim back the charges?.....lol...Its add abit extra and you get 8% interest on the interset when you get to court. If your gonna claim for the interest charges later you are better off claiming them at the start. If you have an overdraft them you can only claim certain charges.
  3. It is best to wait the 14 days, that way you are covered if it gets to court and it can't come back on you.

Hi cj, I'm glad to hear that your case is simpler than mine, coz i wouldn't wish my situation on anyone....lol.....i see it like this, i have nothing to lose and will take it all the way if i have to. I expect i will have to take them to court to get the default removed, just waiting to see what happens with jonni2bads case.
  8. when it comes to the court claim, state it on the particulars of claim, that you require the default to be removed. The highlighted red areas on the particluars of claim template in the library concerns defaults.

    Its upto you......I have left mine in arrears and pursuing with halifax bank, who have now defaulted me (taking that to court too), so i guess its upto you. I can't afford to settle mine.
  13. Hi, you are brave, it does take some guts to do this, especially knowing that it could actually go to court. Thats the scary bit. Mines done with Nationwide, they are the easy ones....lol......its halifax i'm dreading, the worst of the bunch.
  14. Hi, Have the bank charged you after receiving the prelim letter or before, as if your account is in dispute they should not charge you. I argued with the bank about this and received no more charges for being overdrawn and they even refunded one. I was suprised.
  15. Charges refunded 21st sept on the same day as they filed to defend court claim.
  16. Hi, I am just wondering if you have gone through the whole process. You say you have just received your statements and now filing a moneyclaim!!! Have you not sent them a prelim letter and then the LBA letter first?
  17. Start with the FAQ's section and read up on everything. Beware that they probably will close your account and ask for you overdraft back, but you will be able to find out more on the royal bank of scotland and how they react under their section.
  18. ok sorry, was just wondering what stage you were at, as you send a spreadsheet with court claim too. If your using the spreadsheet to send with the prelim or LBA letter then make sure you don't add the 8% interest on yet, that is only used at the court stage.
  19. I stuck to the 14 days and then sent the LBA. Thats what I suggest you do, then at least your covered and it can't come back on you if it does go to court.
  20. Hi, sorry hear that your ill, hope you get better soon. As your exempt from the court fees, the form you need to claim on is the N1. A copy of this can be found in the template library. I would start preparing the form now as in 2 weeks obvisously you will need to take the form into your local court then you fill out the exemption forms. make sure that you take proof of your benefits and any evidence that you take must be recent, like not older than 5 weeks. If you need any help with the N1 form, they please ask and i am sure that if i am unable to reply someone else will.

Hi, the 8% interest is only claimed at the court stage, now you can claim back the interest debited from your account by the bank, if you have no overdraft then you can claim all the interest, if you have an overdraft then you can only claim the interest back from when you are overdrawn. I hope this helps
  23. If its the N1 form then the particulars of claim template is in the library. The N1 form allows you to state more as the word limit isn't restricted like the moneyclaim. Brief details of claim I am claiming the return of money taken by the defendant in the way of charges over the last xx years and xx months plus the interest they have levied on those charges. Concerning overdraft charges do you mean unauthorised overdraft charges or just like a service charge?
