  1. stick to the 14 days, then send the LBA
  2. Received another letter today from halifax, stating that my account has noow been passed to the debt recovery department due to the default notice. They want me to supply them with an expenditure sheet and confirmation of my income. Do i supply this or just write to them informing that I will be disputing the charges? I have already sent a s.10 letter and a letter to their legal department concerning the default notice.
  3. Well they have done it again, Taken £50 in charges because they say that I was overdrawn and 10p short for a DD so it had to be returned. Well got 2 parachute accounts now and more money will be going into my nationwide account as of next week, so they can whistle for the money now i'm over drawn.
  4. LOL.... I am having the same problem. If you figure it out, please let me know.
  5. Ok now I have sent the LBA letter, I should think about filling in the N1 form ready to go in 14 days. I have had a quick look at it and I am certainly gonna need some help filling it in!!!!
  6. Sent LBA letter today via recorded delivery.

  8. thank you so much for your help. I will be sending the SAr letter tomorrow and then sending the s.10 and legal letter on tuesday once I have written it. any suggestions as to what I should state in the letter to the legal dept?
  9. ok, sorry about this mechs, i did try to explain my situation, but may have got confused myself when typing. Thank you for your help, just one more question, is the s.10 a letter that you send before they default you or after? i have read it, but it seems to be a letter that you send before they default you! Or have I again got confused!
  10. Thanks mech, I have read the s.10 letter but can't remember it saying anything about requesting statements or the £10 fee.
  11. ok, I think I am getting alittle lost with this one, although I have been advised, i'm still confused. I am about to send off my SAR letter and as the bank have defaulted me, I am also sending the s.10 and a letter to their legal dept. Am I right or have i got this all wrong? please help
  12. Thanks jonni2bad, by what you have said it sounds like I should send 3 letters, the DPA, s.10 and then a letter to the legal department. Is that what you are suggesting I do?
  13. thats what you do, add all the charges and interest charges but don't add the 8% interest. Not that I know off. The banks seem to pay up when you file a court claim. Be aware that it may come to a point that your case may be heard in a court!!!!! But as far as I know that hasn't happened yet to anyone on here.

  16. Hi, just printed out the template letter to send to my local mp, who happens to be John Prescott. I have in the past sent him many letters concerrning other problems that I have had and he has replied. I wonder if he has the guts to reply to this one and the specific question asked in the letter!!! We shall see, will let you know if I get a reply.
  17. Hi alex, DPA stands for data protection act letter, this is the first letter that you send to your bank requesting your statements for the past 6 years, make sure you include a cheque or postal order with it for £10. The bank has 40 days after receiving this letter to send all the information required. Hope this helps The letter can be found in the bank templates library, here's the link http://www.consumeractiongroup.co.uk/forum/bank-templates-library/
  18. ok, i guess i am chatting to myself, no-one seems to be answering my question.
  19. Hi alex, just to let you know that you can start you claim before reading the books by sending off your DPA letter with the £10 payment first to get your statements for the past 6 years.
