  2. Awww shucks, thanks Mark..it really is just a case of holding your nerve and sticking to your guns. Don't let them talk you into folding...just keep saying you'll see them in court unless they pay in full. They do not want to go to court, so they WILL pay you your money..it's just a matter of time

  5. Lap, first of all, I seriously suggest you edit the link and remove all your personal information from the pdf document...the whole world can see your details and in the interests of security that is not good! Once you have edited it, post a message again and I'll take a look at it
  6. Hi reddragon, and welcome. It's not unusual to feel a bit overwhelmed by all the information. I'm presuming you've already read the faqs, but this is a good link in it: http://www.consumeractiongroup.co.uk/forum/faqs-please-read-these/23848-introduction-bank-charges.html You need to consider the possibility of opening a 'parachute account' - a back up account just in case the bank threatens or does close your account. They shouldn't do this, as it is retaliatory action, but they have been known to on some occasions. I have personally successfully claimed against Barclays, Barclaycard and Halifax, and none of them has closed my accounts. It is a risk you have to take, which is why opening a back up account is recommended if you're concerned. As for your Woolwich account, I really can't see why they would close that in relation to your Barclays claim, as technically they are separate entities so to speak. Don't let the fear of account closure prevent you from reclaiming what's rightfully yours. Don't get mad, get even as I say! If you need anymore help, just post on this thread as you go along....

Right, I rung the court today to ask them if they'd received my 'application for costs' and have been advised that my claim hearing has been adjourned to March 27th at 2pm, and that an order for further instructions will be going out to Barclays and myself It ain't over until the fat lady sings....

  11. Hi Paul, As a joint account owner, I presume they have equal full authority over the account. In which case, at court stage you can file the claim just in one name - whoever wants to 'man' the case, out of the two, so to speak
  12. Hi Anna, If I'm understanding correctly BOS have agreed to pay on your Bank account? If so there is no reason why they would refuse to pay because of a debt with your credit card, which is, in effect, a separate entity. If they've agreed to pay you, it is highly unlikely that they will withdraw their offer. However, even if they do for whatever reason, you can just continue with your claim and pursue it through the courts. Either way, you'll get your money

  14. Hi citybloke, I successfully claimed contractual interest @ 26.4% which was the unauthorised rate pre-6yrs ago (I had charged beyond 6 yrs which I also successfully claimed). However, please read up on the latest issues surrounding claiming contractual interest before you make your decision. If you use the search facilty, plenty of threads on the topic will come up
  15. I'm hearing this more and more idle. Some banks are now returning your fee and providing statements 'free of charge'...Barclays have been doing this for a while now. Whilst POs are 'legal tender' so to speak, I think for the sake of avoiding delays in the process it's best to stick to cheque, authorisation to take the fee from the account, or cash (at the branch).

  17. No need to re-start, add them to your next letter with the line 'I enclosed an up-to-date Schedule of Charges'. You can add any charges right up until you submit the claim in court. Any new charges after the court claim is filed can be added for a non-refundable amendment fee of £35, but normally it's better to save those for a new claim at a later stage

Any steps in the interim are just part of the process to your win
  19. Davyboy I claimed both my accounts (with Halifax) in one claim to avoid paying two lots of court fees and got settlement in full for them. As long as you have account details for both accounts I don't see why you can't. I would, however, suggest you use the paper N1 form and submit it in by hand or post to your local court. It gives you more room to write your particulars of claim....link for pdf file is available in the library of templates
  20. Kev, I have successfully claimed back more than 6 yrs but it is down to personal choice.   22. Meshi, I've had this with my brother's account. Unfortunately the accounts were in a mess, so I couldn't find any statements. I called the Business Banking number: 0845-605-2345 and asked them if they could send me all the copies again, as I needed to reconcile our accounts, and they did for free within a week. You have to be a bit sneaky and give them any excuse other than the fact that you want to reclaim your charges! It doesn't work each time and obviously depends on the number of statements you need.
  23. hezl, you can also go into the branch your were with, with some ID. They are normally quite good at fishing out info on the spot, or can at least find out and let you know. As the others have said, take as much info as poss.
