  1. Thanks peeps, Nailz, all I had was my bundle and stuff that I remembered. Eventually when I got fed up of his yabbering, I said, look, we can dance and debate all day long, I'd rather not do it over the phone and leave it for the court. Then he folded! Just make sure when the time comes that you have your exact settlement figures in front of you. Tell them that amount, and they'll pay!
  2. Nailz, it's up to you if you want to ring them but they don't usually start negotiating until you've been issued a court date. In the meantime, have a look at my Halifax thread...it's been moved to the 'Successes' bit!!!!

  6. Oops, almost made a boo-boo and realised I hadn't added the full interest. Called him back and at first he thought I was demanding more than the claim, I said no, check it out. Misunderstanding cleared, as I have emailed him my POC, so settlement figure is actually £1543.80 He also mentioned that Customer Services had just emailed him to say the £1380 had been agreed but he also added that for £1-200 he wasn't concerned as he was glad to see the back of my complicated claim!
  7. I don't think so Allan...if you really want to call them go ahead. Just be prepared to listen and say 'fine, we'll proceed as normal' if you don't hear what you want to.
  8. Oh...my....giddy....aunt! Halifax J Magill rung me a few minutes ago. We danced a bit...he threw some law at me, I threw some back...he stated they'd made more than a generous offer to pay me most of my charges....I said I want all of it plus the compounded interest back...he said the limitations act states this...I said it states that...he told me my case would be struck out...I said no point in debating over the phone, I'll see you in court...THEN he said fine, what do you want? What will you settle at? I said: Charges Interest Misc. costs Court Fee Daily Interest....which makes £1380.34. I'm happy to exclude the litigants in persons costs on this occasion. He said fine, it's up to my superiors (yeah right, you've just settled with me mate) and what account can I pay you in? Money should be sorted over the weekend. I will do my somersault when I see the money
  9. Woolie you can send them a Non-Compliance letter when the 40 days are up (template in the library), but if they say they're on their way, it may be that it's just winging its way to you at some point, but just late!
  10. Alien you can try calling the legal team @ Barclays but be warned that they are highly unlikely to do or say anything at this stage. They are most likely to be in a position to discuss settlement a couple of weeks after you have been issued a court date.
  11. Solari, tempting as it may sound, I wouldn't trust the banks with a list of charges from them. They have also been known to start offering GOGW payments to people who have simply sent a SAR so they obviously want to nip things in the bud half the time, before customers even have a clue as to how much money is owed! At least with the statements you can go through them meticulously, to ensure you reclaim the right amount! Good luck!
  12. Breenie, I would proceed to the next stage, and send them the 'partial acceptance, will pursue rest in court' letter. You've not acted unreasonaby because they haven't offered you the full amount you're after. You are within your rights to claim the whole amount. They'll be paying you the lot soon
  13. Hi Shadey, banks and credit card companies have been known to charge upto £5 per copy statement, which is why the DPA is the best way to obtain all information for a statutory £10. Have you made a start as yet?

  15. Sent bundle off via Recorded delivery on Weds 24th, plus an extra sheet of expenses up to date for time, research, paper and postage, as a 'Litigant in Person'. Keep checking the good old online banking but nothing showing as yet. Had a dream last night that they posted me a partial cheque, with a request to send me copies of statements for older charges...to which I call them back and say 'check the court bundle you saps'!! This is obviously not healthy...pmsl!
  16. Halifux: 'We will not, no siree, absolutely not, under no circumstances, categorically state, that we will NOT pay you back any more money, so take this very generous GOGW of £100.......' Followed by an 'upped' offer of £750 the next week.
  17. Fatdan, just to clarify, this is not a money-making or profit-making scheme. This website is to help people reclaim what is rightfully theirs. Irrespective of what type of account you had, if you have been charged penalty fees whilst having that account, you are entitled to reclaim that money. Even if you were charged once, that is your money, and you can start up a claim even for one charge if you wish to. Whether the claim is for £30 or £3000, reclaim it to have it rather in your pocket than in the Banks vaults Good luck!

  21. Nailz, no need to call them to check if they've received the letter, get a proof of posting certificate which will suffice if you ever need to argue about it being sent/received in court. As you say, you may get lucky and get paid before any of that which would be fab. Just send them the next letter about 16 days from the date of the prelim, as this will allow a couple of days postage grace too

I'm presuming you've already checked this: Information Commissioners - Data Protection Public Register but if not, you can type in the company name and it brings up the relevant Head Office details. There's no reason why you can't send your DPA addressed to the Data Controller at the Trinity Road address for a Halifax C/C.
