  1. this thread is related to unlawful bank charges, being that i was charged so much recently by abbey that my BT bill went unpaid; in fact it was disconnected. i managed to pay the bill, but the next bill had a reconnection charge of £20 and an outgoing call restoration charge of £10 i am not going to ring them, instead i am going to send them the below letter - will keep you posted: Account no : xxxxxxxx Bill no : xxxxxx Dear sir/madam I received my latest bill from yourselves, which included: £20 reconnection fee £10 outgoing call restoration charge Please note that I will not be paying the above charges as I believe they are penalties, and are disproportionate to your actual costs. If you do not cancel the above charges, I will sue British Telecom in court and will be asking for a breakdown of what the actual costs of reconnection and restoration of services are. Please also be aware that profiting from penalties is unlawful in Common Law. I will be happy to pay any proportionate costs that British Telecom has incurred due to the none payment of my bill, and would appreciate an invoice which details the actual realistic costs that I should pay. Please respond in 7 days, or else court proceedings will follow. Regards itsamomentintime
  2. btw, what about the weight of the package? doesnt that prove that there was SOMETHING in the package when it was posted?
  3. my advice would be to sue. in my case, i was being fobbed off by 'customer services' every week, but when they recieved notice of litigation they couldnt contact me quickly enough to settle. its the only language they understand
  4. i sued the Royal Mail as a tester to see how the whole Moneyclaim procedure worked. heres what happened: in May 06 i sold some dvds on ebay for around £150 and was paid via paypal. DVDs were posted with recorded delivery (big mistake) and were promptly 'lost' (stolen) in the post. the buyer claimed their money back via paypal (as they are entitled to), leaving me seriously out of pocket. i contacted Royal Mail who told me to fill in a claim form, which i did. weeks later, nothing. i rang them and they told me to wait another week. after a week, guess what? 'wait another week'. this went on for 2 months. evenually i got sick of them and sued via Moneyclaim. after recieving their defence, i then recieved a phone call from their legal team, apologising and offering me the maximum compensation for recorded delivery items that get lost in the post (£32) plus court costs (£30). i accepted of course. so. i got some experience of the system, plus an apology from their solicitors. last word, if you send anything in the post thats worth more than £32, use special delivery. just in case
  5. this is disgraceful - tell them that you want in writing a reason for the swallowing of the card. then post it here if you can

  10. tell them that you want a cheque, so you can pay it into a parachute account
  11. i asked them to prove that i was parked at the times that they quoted - they couldnt thank you all for the kind messages - i have this massive feeling of satisfaction, like good triumphing over evil
  12. put every charge in the lba - send a schedule of dates and amounts (keep a copy for yourself) and dont forget to add 8% to each and every charge. drinks are on you!!!
  13. here is a copy of the original letter that i sent: Dear sir/madam I am writing to you to express my disgust at the way I have been treated by your company. I recently applied for a vehicle check costing £274. the inspector carried out the test but was unable to complete the road test as he thought he had found a serious water leak when checking the water pressure. He told me to contact the office to arrange a retest, once the water leak had been fixed. I did this, only to be charged a further £137 for a future road test, even though I had already paid for one that had not been done. I contacted the vendor who assured me that the car had no leak, and urged me to get it checked independently. I contacted your offices again to cancel the road test and to get a refund on the £137, which was given to me. However you charged me a cancellation fee of £30, (bear in mind this means I have paid £304 for 2 road tests that have not been carried out). The car was taken to Ryedale BMW in Birmingham and a water pressure test was done at a cost of £50 (copy included). No leak was detected, meaning your engineer had made a mistake, which I wont crucify him for however I take exception to the fact that I have to pay for someone else’s error. Your greedy company provided no help at all, instead you insisted on charging me extra at every turn. Do not seek to blame the engineer, he only made a mistake. The real fault lies with your policy on ripping people off. As a result I want a full refund for: Vehicle test £274 Road test cancellation fee £30 Ryedale water pressure test £50 Travel expenses to Birmingham from and Manchester, and vice versa £30 Total £387 If you don’t refund me I will contact my credit card company for a chargeback, as I have a report from you stating that the full vehicle test can’t be done due to a water leak, and I have a statement from BMW saying there is NO water leak. This means you have not provided the service that I have paid for. Please respond within 7 days. Regards itsamomentintime
