    On the same timescale as me - but at least you've had two acknowledgements - I have had nothing not even an emessage and I do a lot of my banking on line! Just out of curiosity is it a large amount, don't want details etc...
  2. Nothing really to tell you. 14 days have now lapsed since I sent DPA letter for two accounts - 26 days to go.... Nothing received to date. No letters, statements or acknowledgements - I can wait!!!

    Not a word from the HSBC - just prepared the next round of paperwork, so if nothing received Monday morning this will be in the post Monday afternoon recorded delivery. Quick that 14 days went!!!:o Just want to check two points - 1. prelim letter sent 7th August when stating 14 days should it be 14 days from the date you sent it or the date they supposedly received it which should have been the 8th? 2. Just confirming that it is consecutive 14 days and not 14 working days? Having said that if they want something from me they say 10 days or whatever and don't take out the weekend of bank holidays!! Boo

Thanks for that, I know I haven't been registered long but done so much reading of this site - the postings and the FAQ's and I have become very suspicious of someone who want's to deal with things via PM's. I aint got nothing to hide and as stated you get so much more information, advice and assistance from other people why not tap into that?? PS I'm addicted. I love it all and thanks to everyone who helps I will be donating when my - lots of lovely lolly comes through:D
  5. Have you had any contact with them since? I actually phoned and said I hadn't had an agreement stating the loan had been paid in full and if it wasn't too much trouble, just for my records, would it please be possible to send me a statement of all payments made and charges incurred for the period of the loan (as I'd never had a statement only letters regarding charges etc). Isabelle - was very nice and promised to send it as soon as possible. TBH I didn't hold out much hope but true to her word information received within the week. I then got cracking, had a look at the Statement and listed all the charges incurred - see thread of the 16th August - 18.49. I then completed a charges schedule (spreadsheet) and amended the prelim letter to suit this particular situation see 16th August 22.17, which has now been sent along with the charges schedule. I thankfully had help from other people on this site that's why it's always better to list a thread in the relevent site as opposed to using PM's as someone will always help - been there bought the T shirt so to speak!!
  6. As no doubt everyone else will tell you accept this as part payment and chase the rest including the £100 plus charges & interest that will no doubt now be debited to your account.

The money is only meagre in comparison to a lot of other claims - including my own but I haven't yet seen any other threads regarding this company and a claim etc...here's hoping Letter already to go + schedule of charges - posted recorded delivery tomorrow.   10. I have amended the initial letter to read as follows, Can I send this??? LOAN AGREEMENT NUMBER: xxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxx My request I am writing to ask you to refund to me the charges which you levied from my account. I now understand that the regime of fees which you had been applying to my account are unlawful at Common Law, Statute and recent consumer regulations. If you say that they are not, then will you please demonstrate this by letting me have a full breakdown of the costs to which you have been put by as a result of my breaches, in order to reassure me that your penalties really do reflect your costs. Additionally, it has now been confirmed that your particularly high level of penalties are considered to be unfair per se by the OFT who reported on the 5th April 2006 and are therefore presumed to be unlawful in the absence of specific proof to the contrary. Your responsibilities I would draw your attention to the terms of the contract which you agreed to at the time that I opened my account. It is an implied term of that contract that you would conduct yourselves lawfully and in a manner which complies with UK law. I am frankly shocked that you have operated my account in this way as I had always reposed confidence in your integrity and expertise. I consider that your repeated representations that your charges are fair and reasonable are deceptive and that they have deceived me into agreeing to pay them. Your concealment of the true nature of your charges has prevented me from asserting my right until now. What I require I calculate that you have taken £xxxxxplus £xxxxxx which you have charged me in interest. Total £xxxxxx. I enclose a schedule of the charges which I am claiming with this letter. My targets to resolve this matter I hope that you will enter into a sincere dialogue with me about this matter and I am writing this letter to you on the assumption that you will prefer to do this than merely respond with standard letters. I will give you 14 days to reply to me accepting, unconditionally, my request in principle and letting me know a date by which I will receive payment. If you do not respond, or you do not respond positively, within this time period, I shall send you a letter before action giving you a further 14 days in which to reflect. I believe that these targets are more than sufficient. After that, there will be no further communication from me and I shall issue a claim at the expiry of the second deadline. I have also attached a schedule of charges including interest repayments (No not the 8%!)
  11. I have looked at the SAR which is asking for a list of charges etc. I have the Statement from LBL which I received this morning after a phone call/quick confirmation letter last week. It lists everything - all payments, charges etc... Is there really any need to do an SAR or should I go straight to an amended Preliminary Approach for repayment letter?
  12. Hi Martin 3030 - thanks for that advice and yes it is clear. No need to suspend any action as the account is paid and all clear - thankfully!! I will do the S.A.R - (Subject Access Request) now.
  13. Excellent - received a response including statement from Log Book Loans today, how quick were they - letter sent 11.08.06? What I just wanted to check was what exactly in this instance I can put a claim in for, statement is saying: 7 day letter £20 14 day letter £20 21 day letter £20 28 day letter £20 Notice of default letter report printed £20 Debt recovery instruction sent £20 Telephone call £10 Vehicle recovery instruction sent £20 Vehicle recovery charge £300 Post repossession letter 7 days £20 Post repossession letter 14 days £20 Post repossession letter 21 days £20 Post repossession letter 28 days £20 Interest Lots etc..... I must add that whilst all of this was happening I was still paying. These were arrears incurred whilst I was in hospital. These people would not accept DD’s/SO’s or cheques it had to be cash through the bank. I have to be honest I didn’t want to let anyone know I’d taken out this loan so couldn’t ask anyone to pay it. I did speak to LBL who were less than helpful, but not passing the buck – my fault. What I now need to know is exactly what I can claim - thanks:?:

You seem to know what you are talking about with regard to these people - I am guessing that you have either worked for them or you have had extensive dealings with them, how can I help?

There are a lot of people on this site who have had major banking problems over the years including myself and I think some of the banks are recognising this/some not, but anyway there are a number of banks that will provide cash card accounts. They are current accounts but do not provide you with cheque guarantee cards, some will issue cheque books others don't and the cash card they issue is generally Solo. You can set up DD's through them and SO's - worth a try. Try - Co-op (pretty good but I'm sure someone somewhere will disagree!); Barclays; HSBC (I'm sure they provide a cheque book but no cheque guarantee card) Nothing to lose!! Good luck

    What lovely people you all are on this site... You must spend hours trawling the site giving advice and support to all that need it. I know this is going to sound dramatic but this site has turned my life around. I am sure I'm not alone when I say - it's been the kick up the **** that I needed for me to be able to see the light at the end of that what has been very distant tunnel!! I am still in the initial claiming stages so as yet have received nothing. I do feel however that it is very important to log on to the site regularly not only to get support but to give it. You don't have to be a legal eagle to support with common sense and the occasional hug!! Sev - don't let them grind you down - Don't get mad, get even (or better)!!

  21. Thank goodness for that I was beginning to feel like the only muppet to take up a loan with these sharks!! I know I acted foolishly but I was in hospital for almost three weeks and then off work for four months seriously ill. They couldn't have cared less they lent the money they wanted it back immediately. Not the best crew deal with and certainly not the most sympathetic!! When you check on the finance also make sure you've had your log book back I had to request mine three times! Just in the process of typing up DPA....
  22. Well done you!! I hope you get exactly what you want and more if possible. I am close on your heels, I have sent DPA letter today so let's hope the statements come back soon and then I can put my case forward also. Shame we can't claim for harrassment, stress and bullying isn't it? How long do you have to wait now and do you think it will actually get to court or do you think they'll settle before?
