  1. Hi folks, I thought this was dead, done & dusted but BG find new and ingenious ways of cocking up. I finally accepted their offer to clear the balance to sort my billing issue and for the stress and inconvenience..I asked for my costs...long argument, life to busy gave up was happy to let it die. UNTIL... I start receiving numerous phone calls from a dca called Buchanan Clark a& Wells (pondscum) chasing the very original completely wrong high amount and threatening al sorts. I e-mailed them proof, 3 times now, posted this and eventually warned them I would claim for harrassment if they didn;t stop - that worked! Turns out BG did NOT clear the balalnce on their records...the muppet dealing with it just left it hanging for 7 months then SOLD it to a debt collector......AAAAAAAARRRRRRRGGGGHHHHH! Went bananas and a manager called me back today, grovelling. It took her hours to read all the notes on my account and agreed it should never have been handled like that, the offer was worded all wrong and it should no =t have even been on the system never mind sold. So, thats it. I let it go but this is unnacceptable, on the warpath now. I now want my costs and something for this latest fiasco:mad:
  2. Hi ataxidriver, was really chuffed for you reading your thread but am now getting concerned. WHen you paid them, was anythign confirmed in writing that your payement was in acceptance of that offer and your credit file would be amended to show this? I just do not trust them an inch
  3. Hi weejock, welcome to CAG! There is flexibility for things like this. Can I ask what your monthly contributions/payments to the TD are and when you signed? Thing is, when your trustee first wrote to all your creditors with you financial situation, that was then...life changes. Your TD will run until the minimum amount of 36 of those monthly contributions is paid. Should you lose your job and pay less or nothing for a while, your TD will be extended until you have caught up with that shortfall....however, if you get a payrise your TD won't end early lol, you just pay more towards the TD! Speak to your Trustee (I advise backing the phone call up in writing), explain and ask what can be done. It is a household essential - heat/hot water. Let us know how you get on and if you need any help

Well its obvious cash collection is a main focus and (a already seen) they will put considerable effort and pressure to rewrite as many possibly unenforceable agreements as possible and secure debt. Many many folk will be pushed into signing these agreements and it drives me nuts ....what can we do about it?

  6. Hmmm, this loan was set up as part of my complaint about them mis selling me a loan full of charges way back in 2005. The deal was interest free and I remember having to send in 2 agreements as they lost the first, then had to call me and ask what my payments and start date was after I send the 2nd. I wonder if they put that T&C in and if they actually have my agreement......CCA being send today, lets see if I get anything through. I will wait the 12+2 days then canx that S/O. Thank you guys, I think a parachute account is a wise move now as well as I smell another fight with them
  7. Thanks for the quick response yourbank. It just drives me nuts that they make all these decisions about my money, and leave you penniless without warning. Apart from twice forgetting to make a payment (which I then caught up with) the loan has run fine...not bad for 3 years for me!
  8. Hi all Looking for a quick bit of advice please. I am in the last stretch of a loan with RBS and cancelled the DD a few months ago and was just transferring the payments in every month online. I completely forgot March's payment, haven't heard anything until this morning....a standing order appears on the small key account I use for odds nn sodds. They are obviously unhappy at not having the control of a DD and set this up as not as easy to canx.....but I did not ask, know about or give permission for this to be set up. Can they do this without my permission or a signature or sorts? Grateful for any advice as I do not give this shower an inch and will be getting into this with them today (they do hate me ) Thanks
  9. To keep yourself right you really need a solid reason to put the account into dispute first. If court action was ever started by any side they would throw non payment without good reason at you. This is entirely up to you. it all depends on how much is outstanding against how much you want to claim/put in dispute. In my case with RBS (missold loan just like yours) I paid for so long and when they didn't take my complaint seriously I then stopped all payments, putting the entire account in dispute until they did - i claimed I was forced into that action as I was otherwise ignored....worked! You will also find them very agressive right now trying to get hard cash in...the company is in trouble big time and they are trying to scrape in every penny. You did great though when they called! How did it feel to stop him dead in his tracks like that pmsl!

Just seen this post apparently about an e-mail sent to employees in welcome: An e-mail was sent around the company about further cost cutting ie stop using the 118 numbers and the company will save a small fortune. This was sent by Gary Edwards who has just been brought in by David Postings to help save the company. The interesting thing though is certain other information was included in the previous e-mails he'd sent which for some reason were included in this e-mail. Such as the company has been riding a shock wave over recent weeks and that what is to come is another shock wave. He then goes on about a communication he is working on and the areas to be covered are.... Madrid (could some cattles employees confirm what this is) cash collections cost management bonus deferment Next few months - mobilise the project re TOM (again could an employee confirm what this is), continue discussions with banks, future focus dealing with local issues. Something big is brewing but I cannot see any further news being released until the results come out. Spot the words "Bonus deferment"?

Did a bit of diggin on that. seems there are numerous depts that deal with NU's various underwriting of policies etc for various companies. See this link for a Lloyds TSB insurance job that NU does, they are Dept 29 apparently? Layout 1 The thing you will notice is the amount of information supplied in this policy leaflet....compared to a Welcome one . 2 questions I don't think Mr Penfold will want to answer straight away, apart from the obvious!: IS Welcome an agent or authorised agent for NU? IS NU aware of the lack of info supplied in Welcomes Policy leaflets (if you get one)...do they not check the quality of the info being supplied on their behalf? If DG print and send these out and they work for NU, same applies - do they not check if the info supplied on their behalf is compliant? The demands and needs/policy leaflets and even the T&C's supplied by Welcome/DG are ridiculously NON compliant, will NU claim to be unaware of this? (Even though they are responsible for the advice/info supplied by their agents ) And just for kicks: Who underwrited the PPI - Norwich Union Ltd, Norwich Union Life & Pensions, Norwhich Union Healthcare....who? And do they underwrite the Medicare/Healthcare/Homecare crapola (we've not even begun to dig into them yet ) Have a lovely afternoon Mr Penfold

Alternatively a complete set of statements and agreements for the accounts or associated accounts is acceptable. I would be grateful if you would provide the following for ALL accounts or associated accounts I have held with your organization: -Full copies of all contracts which you believe exist or have existed between myself and your organization, including true copies of any documents you hold in support of the same. - A complete list of all transactions or statements relating to ALL of my Loan Accounts and or credit card with your organization. -Copies of all documents which include any of my personal information including copies of any contacts or invoices, emails or computer records containing my personal information, or any records which pertain to this information. -Full copies or transcripts of any correspondence in postal, email or any other format which you have entered into with any individual, organization or third party which contains my personal or financial, or which pertains to me. - Where any previous information or records held have been deleted or disposed of, the methods used to do so, including dates, certificates or references confirming details of destruction.   15. Hi Rikk, sorry for not getting back to you sooner, my whole area of the country had a major powercut, still playing catch up! Defo send the Subject access request, will post a template for you that asks for everything. Can I ask if the agreement you posted up is your original or did you ask them to send a copy? After the others looked at your agreement I still think you have at least a complaint about the layout....they are supposed to be clear and up front and it is only on one small corner that I had to read a few times before finally seeing does it state HP, how could you have been clear what you were signing? The other think is, Postggj is right, you were bullied and frightened into signing this agreement. The complaint you want to make is that they missold you the loan by pressurising you into further long term borrowing when already in financial difficulty. The circumstances of signing alone back that up. Send the SAR, enclosing £10 postal order, print your name, do not sign and send recorded delivery. Also, if that is your original copy of the agreement, send a CCA request and lets see what they have on file for you. Enclose a £1 postal order, and again, print, do not sign and send recorded. They have 12 days + 2 for post to supply you with this or they cannot demand payment. Third, send a letter informing them you are having financial difficulty and you are unable to make a payment this month. You can enclose a token payment £10 even (this keeps you right, shows willing etc) and you will keep them updated. You also want to lodge a complaint regarding the behaviour of the staff, excessive charges applied to the account and being missold the loan. Ask them to supply thier complaints procedure and again, print not sign. Don't go into any more detail in this first letter, you just want to lodge the complaint, your informing them in writing of financial difficulty and asking for their complaints procedure...this keeps you right again and gives you time to get your SAR info through to see what your real position with them is. I guaruntee you are paying for loads of old charges at least. Will help you get the complaint letter etc done and don't worry too much about them pressuring for money, stand firm...they cannot take what you do not have. Another letter I will post up for you is the one that removes permission for them to come to your home or phone you...all to be done in writing. If they breach that start complaining about harrassment. Trust me, they will hound you if they think they can bully money from you. Once they realise you know your rights and are fighting back, you will see a difference! What do yo think?

To those of you checking he charges etc recorded at the Land Registry, if you find ANYTHING irregular, whether you are unsure about it or not (ie both signatures required on paperwork for joint), complain bitterly to the registry and get them to respond to every point in writing. When I worked in insolvency, it was the Register of Scotland (ROS) we dealt with to place inhibitions etc and they were notoriously strict...as they are supposed to be, but if you phoned with a question you quite often got some young person and not much by way of a definite answer on things. If there is anything wrong, focus on the registry and hound them with a complaint - they will cover their backside no end and turn the heat on Welcome, as I know in the ROS they were very strict with procedures and staff and didn't tolerate cock ups. At least I hope thats how it still is!
  17. Evening all, just managed to get back on, my whole quarter of the country had a power cut! What a carry on, it is ridiculous how helpless we become without electricity for just half a day!   18. Hi all, hoping for news today! Would like some opinions on what I personally think is very suspect. OH's agreement was supposed to be £4562.86 (total amount of credit) + £75 acceptance fee at £212.43 per month for 36 months. (No total amount payable shown on agreement) Count this up and it comes to paying back £7647.48. OH did ask to pay weekly, advisor told him the agreement will be monthly but they will set up weekly ok. She just divided his monthly payment by 4 for his weekly amount. (odd, as that works out more over a year) The interest rate on the agreement states 42.6%....the statement of price states 36%, so got me thinking. Obvioulsy, paying £53.11 asked for weekly is more over 3 years than paying the monthly amount and I did say I couldn't get the figures to add up: In their system (statement of price): Total credit AND acceptance fee - £4637.86 @ 36% over 36 months = Total amount payable would be £7646.12. £212.43 x 36 (as stated on agreement) = £7647.48 - Ok, close enough. On the agreement: Total credit AND acceptance fee - £4637.86 @ 42.6% over 36 months = Total amount payable would be £8287.88. £212.43 x 36 (as stated on agreement) = £7646.48 - so am confused until...get this.... I double check how much would be paid in total if OH continued to pay the weekly amount of £53.11 asked for 3 years - total amount then payable would be £8285.16. Basically the same as the interest rate on the agreement =- but not in their system! My question is.....did the advisor (who was branch manager btw) put a higher rate on the agreement to cover the extra £600 odds paid if paying weekly, and then be able to pocket that extra as the system was only expecting less? Or is the interest rate on tehe agreement just a typo and that is one amazing coincidence? Have I explained that correctly?!

Hi all, am hoping someone could look over the agreements on this thread: http://www.consumeractiongroup.co.uk/forum/general-consumer-issues/190778-welcome-finance-please-can.html Bit of a strange one...the new agreement is listed as a modified HP agreement (OP was struggling and Welcome Finance talked him into refinancing ) but....the original agreements posted up look like only bog standard unsecured loan agreements? They seemed awfully desperate to get him to sign the new one, could they have cocked up originally and realised it? Thanks loads in advance

  25. I think it is a mixture of unhappy trained monkeys with some really sneaky sods at the top. The branch managers don't survive in that environment for very long without obviously being sneaky manipulative bullies....if I ever get to update my thread I will show you how the BM at mine calculated the agreement SO sneaky its ridiculous....
