However, at the time of the complaint, I beleive we'd advise the complainant to ask for some compensation and take it from there. @FTMDave??   4. May be too late with this suggestion but, just spotted something in BPA's COP SECTION 4. CONDITIONS 4.3 Under the Code you must keep to all the requirements laid down by law. The Code reflects our understanding of the law at the date of publication. However, you are responsible for familiarising yourself with the law on any activities covered by the Code. I was thinking this may be useful in OP's WS section 5 Illegal signage?

  6. From the wording on their letter, it looks like the other victim is a bit of a fighter. Just a possible suggestion to try and stir things up for GS... Why not send the victim the paperwork you've received with a covering note explaining what's happened and refer them here to CAG for advice on making a GDPR claim?
  7. Hi rita, your name is on the correspondence because you are the registered keeper, NOT because you are the driver. (Anyone could have been the driver at the time and they have NO IDEA who that was.) Also, just to reiterate. As well as updating your logbook with the DVLA, you must also write to Parking Eye informing them of your correct address... nothing more! Get and keep a free proof of posting at the post office and keep it safe!

  10. First bit of advice is DO NOT APPEAL! (You could lose useful legal protection.) Next is contact the gym, explain the situation and ask them to get the PCN cancelled. (DON'T tell them who was driving.) And finally, read a load more threads around the forum to educate yourself on who you are really dealing with.

Extract from IPC Code of Practice 29 Byelaws 29.1 Operators should establish whether any land upon which they operate is subject to any relevant Byelaws. 29.2 Where land is subject to Byelaws Operators must ensure that their practices are in accordance with them or, alternatively, that they operate a scheme that is not prohibited by them. Extract from SHOREHAM PORT AUTHORITY BYELAWS 18. Vehicles, directions of Harbour Master A person having charge of a vehicle within harbour limits shall at all times comply with any directions of the Harbour Master with respect to moving, loading, discharging, manoeuvering, waiting and parking and shall not, without the written permission of the Harbour Master, leave the vehicle unattended anywhere within the harbour premises for a period exceeding 24 hours. So, without directions (signage) from the Harbour Master, there are no restrictions on parking... Other than 16. Operation of vehicles No person shall drive or operate a vehicle on the harbour premises without complying with all the statutory requirements that are applicable on public roads. And, as parking on public roads is allowed...
  13. This is questionable LFI. Although they've used some of the wording, they haven't specifically stated they're using POFA... Just a misleading statement that they have the right to pursue the keeper. Which, of course they haven't!
  14. kjaska, You certainly missed a trick here! Section15.1 of their T's &C's allow you to end your membership early due to "loss of employment". (PDF attached) A question for the team...   16. They are still saying right at the end of the letter that "you can view CCTV evidence of your case online"...????? Crazy! The letter (1st page) also says that the email they sent on 15 Jan gave you an email to contact for the CCTV footage. I've looked at your post on the 15th Jan quoting from that email, and you don't mention the email contact details. Maybe check what the original email says again?
