  1. Yes. I have managed to get them to change the default date to my bankruptcy date but because Max recovery are not the OC I thought they couldnt mark my account. Am asking the question because I believe that Erudio who bought student loans can't mark my credit file as they are not the OC (unless I sign their deferment form). So how can Max recovery?
  2. I have checked my credit file and it seems that MBNA sold a few of my credit card debts to MAX recovery who has also made an entry on my credit file. It seems after bacnrupcy the debt was sold to MAX. I thought only the Oringinal Creditor can mark credit files?
  3. Sorry dx. Last information was wrong. Can't find the receipt for the PO but have photo of cheque which has cheque number etc. Also just realised that I have accidently cashed the cheque from the SLC.

  5. Heres an update of what has been happening with Erudio recently. I received my 6 monthly statement and it says I made a £10 payment to one of my loans which is complete nonsense effectively resetting the SB clock. This £10 must have came from the SAR request but how did Erudio get hold of it? I sent the SLC in Glasgow a SAR request few month ago and sent this recorded. The SLC received this the following day according to the track and trace service but there is a letter included in the SAR dated a few weeks from Erudio stating that they received this SAR and no money was enclosed in letter! This letter was addressed to the SLC. The SLC then sent me the SAR along with a £10 refund apoligising for the delay. So how did Erudio receive my SAR if the SLC received it the following day? Very strange. It seems the only possibility was that SLC sent them the SAR once they received it then Erudio sent them it back minus the £10 using this to pay towards one of my loans then the SLC refunding me this. Am still waiting for my CCA how can they get away with this dodgy tactic?
  6. Thanks DX. What makes a CCA enforceable, how do you know if a CCA is enforceable and what exactly does enforceable mean?
  7. Thanks but if only the OC can default me then what difference does it make if Erudio produce the signed CCA documents or not? What more rights does that give them?
  8. Just had my SAR from the SLC and it included all of the signed CCA's for the student loans. I sent a CCA request to Erudio over 6 month ago and received an acknowledgement letter saying they would send the CCA's in due course but I have had nothing from them. It did mention in my SAR that Erudio contacted the SLC for documents. Now that I know the SLC have the signed CCA's it's just a matter of time before Erudio produce them. I keep getting arrears letters from Erudio and now I have received a letter saying I have 14 days to contact them. I have pasted this letter onto thread. I last deferred my loan in 2013 so it wouldn't be statute barred till 2018. What action can Erudio take against me at the moment? What will happen when they do produce the CCA's? Could they potentially CCJ me? I take it the debt would be enforceable? Thanks
  9. What account/reference number is to be used in the CCA request to Eurdio. Is the Eurdio reference sufficient or should it be the original SLC numbers for each loan?
  10. If Erudio do produce a CCA then could they mark my credit file? I will be sending a SAR to SLC to see what paperwork they have.
  11. How long would I have to wait before I can apply for it to be statute barred? Going back to what was written earlier the SLC did not mark my credit file before and a few times I did not defer on time and I got fined but I got the fines refunded and SLC sorted out my accounts. I think this what the compliance refund was all about. If they do send me a copy of signed CCA can I still go down the statute barred route? In the mean time is it advisable to just to do nothing and wait for the CCA to arrive? I have an acknowledgement letter from Erudio for the CCA.
  12. Rosskie, I was reading your thread and you mentioned that you paid off your arrears. Did you send them a cheque to do this?
  13. Thanks for the replies folks. Should I send a CCA reminder to them? Am I correct in saying that my account is currently in dispute due to me requesting this so I don't have to pay the arrears until this is sorted? Worst case if they do produce a CCA and I have to pay as I wont be able to defer is there any way to do this apart from signing their DD form? Would they take a cheque etc?
  14. Hi folks, Looking for some advice on what to do next. I received my deferment form back in April but followed information to not sign or send Eurdio deferment form and so send a CCA request. I received a letter from them saying that they are dealing with my request and will send it in due course but have still not received any CCA's. Instead they send me loads of sheets with relating to different dates. Each of these dates have Notice of arrears sheets. Also included in this pack was Remedy off Account and Annual statements. No sign of CCA I requested! I have now received a letter saying am 2 month in arrears and owe them nearly £500! Where they got this figure from I have no clue. What do I do next? Do I do nothing and wait for the CCA which will probably never show up. I probably won't be able to defer due to my salary just need to know where I stand because I want to fight them. If I started paying it back they will mark the debt on my credit file which is not what I need at moment as am looking to apply for a mortgage. Any advice would be great.
  15. Could Erudio put a default on my credit file while am waiting for response from my CCA request? The company seems to use some underhand tricks.
  16. Excellent advice. As I mentioned earlier my deferment runs out in May. I will be sending the CCA request shortly and will have proof of postage date etc. If I don't receive response before my deferment date runs out what could be the outcome with regards to not applying for deferment or agreeing a payment plan?
  17. Next step for me is to get the CCA request sent and wait for reply!! Whenever that will be!

  19. Got a rough idea what an CCA request is. Do you think sending the request first is a good place to start before I send in anything else? I got a letter mentioning there were giving me a discount to not being compliant. Unsure exactly what this means.
  20. Wont be able to defer any more unfortunately. Does anyone know is it a set amount you pay back or can Erudio make up there own rules and say I have to pay something stupid a month back? I don't want to deal with them through the phone so will be writing to them.
  21. Thank for everyone involved in answer my question. My current deferment runs out in four weeks and have recently got a new job which pays more than threshold. What's my legal stance on this? Am in a different situation from other people on here who don't earn enough to pay back. Does anyone have any advice if I should write them a letter and ask for discount as they did buy the debt for a pittance!
  22. Thanks for the replies. The loans were old style loans. I have been deferring my loans ever since leaving Uni in 2000 then went bankrupt in 2010. I then went back to Uni in 2011 and was told I could not get a student loan due to being bankrupt. So kept deferring my loan repayments as I was under the threshold. Any debts I had which were sold to DCA's were all written off with the bankruptcy. Now my student loans have been sold to a DCA! As 'Ford' mentioned loans up to 2004 could be included in bankruptcy but I was told it couldn't by SLC. Does anyone know what's correct?
  23. I have a few student loans taking back from 1997, 98, 99 and 00. I went Bankrupt in 2010 but was told my student loans would not be included in my Bankrupcy. I spoke to SLC and they backed this up. I was still receiving deferment forms from SLC and I kept deferring the payments but have now received a letter from Erudio who say they have now bought the debt. I have now read that certain student loans could be put under Bankrupcy so could be written off. Would these loans have been written off when I was declared bankrupt? Was I miss-informed? Any information would be great
