  1. Mileage is genuine at 82K. Oil additives will thicken-up the oil to reduce oil burning for a short while. I replaced the air filter which didn't help the emissions.
  2. I can't prove that the seller doctored the MOT certificate. The car was advertised as mechanically sound, whatever that means. In my mind "mechanically sound" means there is nothing mechanically wrong with the vehicle.
  3. I spoke to the Police who said that it isn't a Police matter and therefore cannot persue the matter. Thay also said that Trading Standards could only help me if I had bought the vehicle from a car dealer. I have to accept my loss and be more careful in future. So there we have it, if anyone wants to make money selling cars with doctored MOT's, then go ahead. The law will leave you alone and let you get on with it. The "crime doesn't pay" principle doesn't apply because doctoring MOT's obviously isn't a crime. Therefore if you wish to sell a car that has a valid MOT with advisories, photocopy the document and blank out the advisories to get a better price.
  4. For many years I have suspected that the target driven culture is responsible for the mess we are in. This was imported from America along with many other insane management ideas. All crime figures are now fudged to make things look good, we all know that. Sadly the Government thinks we have all been dumbed down and are all thick. They have forgotten that there are many people still around who are well educated who can see right through their lies and deception.
  5. That's very interesting. In our local paper (I live near Bristol), there is a column called "In the courts". The column lists and details recent Magistrates and Crown court cases. The vast majority are motoring offences. I have also seen many motorists driving badly as you describe. However myself and many people I know have been pulled in my the Police for no reason when driving perfectly. This implies that the Police can't tell the difference between a motorist driving badly and a motorist driving perfectly.
  6. The seller owned the car for two months. The car was advertised on a Facebook group. The Police have failed to get back to me so nothing will happen.
  7. Oh you have had it easy compared to me. My house was broken into three years ago, doors smashed and items stolen. I caught the offender red handed and threw him out. Police dropped the case beacuse there were no witnesses and no camera evidence. I later discovered that the offender's wife was friendly with a Police woman on Facebook. A while after this, a gang of thugs broke into my daughters house and attacked her. Case dropped due to lack witnesses even though there was a witness who was willing to testify.
  8. A petrol engined car that's burning oil won't pass an emissions test. I recently had the car MOT tested and it failed the emissions test due to smoking exhaust. The car has done very few miles since it's previous MOT which is why I suspect the previous MOT was bent. The seller erasing the advisories from the MOT certificate is a sure indication that deception has been employed.
  9. I am getting uncomfortably close to 60 and over the years I have come to the following conclusions. 1. The law seems to mainly exist for the sake of itself. 2. The Police seem to just be tax collecting protectors of the state. 3. Motorists are chased by the Police mainly for revenue rather than road safety.
  10. Interesting to note that if you break the Road Traffic Act, the Police have no problem prosecuting you.
  11. I did ring Trading Standards last week concerning this issue. They said they don't deal with this type of problem. They told me to contact the CAB. I also contacted VOSA who told me to contact Trading Standards.
  12. The advisory was smoking exhaust / engine worn so it would have failed the emission test. Anyway, I have just reported all details to the Police. They are going to get Action Fraud to contact me. In the fairly recent past I have contacted Action Fraud on another issue and never heard anything since. I am therefore not holding my breath.
  13. Thanks DragonFly for your good kind advice. I will ring 101 and report this. I will report back any result I obtain. Should the Police decline to help me I will tell them that I intend to sell second hand cars with doctored MOT certificates and not expect any comebacks from the law.
  14. The doctored MOT certificate turned out to be a photocopy with the advisory removed. Strangely the MOT was valid despite the serious advisory being removed. I therefore also suspect that the MOT was a bent MOT. Interesting to note that the suspect MOT was carried out before the seller owned the car. However, the seller gave me a servicing receipt for a service that was carried out when he did own the car. I later discovered that the service was never carried out. I therefore suspect that the seller was using deception.
  15. I recently bought a second hand car from a private seller. I agreed with the seller that I bought the car "sold as seen". I therefore fully accept that any problems with the car are my responsibility. However I later discovered that the MOT certificate had been doctored. Advisories had been erased. The erased advisory stated smoking exhaust/engine worn. The car has just failed it's MOT on exhaust emissions. I contacted VOSA and Trading Standards regarding being given a doctored MOT certificate by the seller. They both said that they cannot help me. Do I have any legal comeback against the seller?

  18. I guess the mess I am in could be my fault. My wife deserted me nearly three years ago and has only recently applied for home rights. I should have sold the house when she deserted me and disappeared abroad with the money. Oh well, I had my chance but now my chance has gone. Maybe I could adopt a child or go back into full time education to ensure the court don't grant an order for sale in the near future.
  19. Thanks for your informative posting. I am currently living alone in the property. I thought that being in actual occupation only protected occupants who were under 18 or in full time education. I am therefore worried that should a divorce come about, the court would force a sale leaving me homeless.
  20. Thank you for that information. Maybe then I could continue to live here for the rest of my life without the worry of a forced sale. I don't mind my wife being granted 50% ownership as long as I can continue to live here. Regarding moving to a smaller house, there are no houses in Bristol that I could afford with 50% of the proceeds from this house and I wouldn't be eligible for a mortgage. Therefore moving to a smaller house is financially out of the question.
  21. Thank you for that link. I have had a good read through the information. Am I correct in thinking that if I could obtain a divorce which resulted in my wife owning 50% she couldn't force me to sell the house without my agreement. Also I assume I couldn't sell the house without her agreement. I wonder if under such circumstances if she could charge me rent on her half of the property. I assume so.
  22. I am unable to afford a divorce due to living on a small private pension and I'm certain that my wife wouldn't be able to afford a divorce either. This situation has been made worse by the withdrawal of legal aid from divorce cases. I therefore seem to be stuck in a situation that has no solution. Being unable to afford a divorce and now being unable to sell the house implies that my house has no value. The value of something is based upon how much someone is willing to pay for it. Therefore if you aren't legally allowed to sell something then it must have a market value of zero.
  23. All I have here is form B94-1 the notice of an application for a home rights notice accompanied by some explanatory notes. The notes explain protecting home rights under the Family Law Act 1996.
  24. The only address on the home rights notice is the address of my property. I suspect that my wife applied for the home rights notice on line and didn't use a solicitor.
  25. I have received a home rights notice from the land registry which was instigated by my absent wife who left me nearly three years ago. I now don't know my wifes whereabouts, she doesn't reply to my emails so I can't discuss this issue with her. She hasn't petitioned for divorce so I don't know where I stand. The home rights notice states that I can't sell the house without my wifes permission. However, as I can't communicate with her I seem to be stuck in a situation that I can't solve. Being legally unable to sell it without permission that I cannot obtain what should I do? The home rights notice doesn't say that I can't demolish the house so I assume that would be legally acceptable. I would be happy to negotiate a sale of the house with my wife if she would only communicate with me. Should I just demolish the house and ignore the home rights notice if my wife continues to ignore my emails? Being notified by the land registry that I can't sell my house without the permission of someone who's location is unknown and I can't borrow any money against the equity implies that the house is worth nothing.
