  1. Hi Poppy Its nice when they get things out on time, but they are so busy (banks & courts) they cant keep up. They will reply, to the court, if you want a copy of their AQ you will probably have to phone the court. Still weathers lovely, dont forget the tanning lotion, and a nice chilled bottle of wine:-D AL:)

  3. Hi Lindy Yes you can estimate, estimate too little, they keep the rest, estimate too much and they will fight tooth and nail. Yes its achievable but remember your up against a bank, they are quite clever with figures:o AL:)

  7. Hi Jster Well in my case they were very slow and thats why it took so long. As it happens they have told me (yesterday)that when my card expires it wont be renewed. I have been trying to get it to a nil balance but they beat me to it. Never mind I'll survive. Bankers!!!!! AL:)

Hi Blue perhaps if you have the name of someone at the DPA dept at B/C you could send them a copy of the letters you are about to send to the court and the Information Comissioners Office and give them another 7 days, it might save going to court which will take time. Not the perfect solution but..... AL;)

  14. Hi V If you have sent your LBA (along with copies of your shedule) you give them 2 days postage time (hope you sent it recorded) then 14 days. Then about 2 o'clock have a beer and sit in the pub with a big smile on your face . I believe the court allow up to 5 days for service ( i dont think the bank holidays make any diffrence) then 14 days (thats 19) then they aknowledge on the last dayish!!! then thats another 14 days to file their defence, and even if they are late (which they may well be) the court will allow them to issue their defence. So have a good read of the longer running threads in this forum and you will see how the Woolwich and the overworked Court systems runs, or in most cases, does not. AL

Use the above and something along these lines When I signed the terms and conditions upon opening my account in XXXX. I was not aware of the unfair terms I had agreed to as defined by the Unfair Terms in Consumer Contract Regulations 1999. It is only in the last few months that I have become increasingly aware that default fees are not fair if they exceed the cost of dealing with the default; if they do then they are considered a penalty. You say that the fees are automatically added, I assume that this is done by the software doing the account administration which suggests that there is no manual intervention; the cost is significantly less than £12. Penalty charges are irrecoverable at common law. The precedent for this was Dunlop Pneumatic Tyre Co Ltd v New Garage and Motor co Ltd [1915] AC 79, along with Murray v Leisure Play [2005] EWCA Civ 963. AL
