  3. OFT would have been given legal advice based on UTCCR 1999. I am unsure if they would have asked for advice based on other arguments, re CCA 1974 as amended. To be honest, without seeing the actual reasoning and what they say, it would impossible to comment.   4. Can I ask a slightly difference question about the car in question? Was the type of car ever in your poseession? What was the circumstances of it being in your possession? Was it the case that no changes were made to the policy when the car was no longer in your possession? I am quite confused why you are being hassled if the description of the car, person driving etc,etc, is not you at all. Have you checked the address on the first letter in case it was sent to the registered owner of the vehicle?

  6. Because it was done on your card the Step account does not get a charge for being in excess nor does it get a charge because of using the card which took your account into minus figures. In short, and for a change, they are right in what they said.

  11. What was the normal date of the Standing Order? I have seen occasions when the payment has shown as going out early but was in fact the right date. Furthermore, different banks update their systems at different points over the weekend so that Saturday to Monday payments will show as going out(RBS Group accounts ie natwest/rbs would show on the Saturday, A&L I believe update overnight saturday, LloydsTSB update Sunday night and others may update prior to the mondy).

I would check the OFT website because I am SURE that on their newsroom(for reference: Newsroom - The Office of Fair Trading ) rather than reading the news or listening to it since they are interpreting the news rather than necessarily giving you a full picture of events that are happening. Furthermore, on the sites it will take a little time to digest what the OFT actually say, since the first initial reaction is not always the best one(as most newspapers did show with the SC decision "banks won!"). I don't think anyone will be surprised however the OFT decide to go since all consumer groups have said that they have to carry on so they either will or their hand will be forced yet again with the civil litigation that will go on if they do nothing.
  13. Every single bank has CCJ's against them and if you do searches against all the banks, you'll find very much similar results. Natalie the weekend does have an effect on payments and transferring money into the account over the weekend means you have to get the bank to override any automated decision based on funds from the previous WORKING day ie monday to Friday. I know it SHOULDN'T matter but it DOES unfortunately.

I am sure even you can write a letter explaining how the charges debited immediately from your account without any chance to opt in or out of their overdraft services, severely disrupted your attempt at budgetting and lead to an irreparable imbalance within the contract you had signed with the bank leading to a clear breach of trust between you and the bank I would wait until after Tuesday though

  20. Best thread to ask on When were the CAG POCs changed on the N1 template for bank claims ? I need the version which was up at the beginning of November if anyone has a copy, I havent been able to find one on the forums other than MCOL ones. Someone I'm assisting can't find the version from CAG they used mid november.
  21. I dont think it would be a default judgment. The Judgment was 25th November in any case so 21 days is tomorrow. Have you called the court and asked the current status of your claim, that would seem to be the best move first, then if need be write in and ask to prolong the stay. Theres no unless order attached to the directions order so its exceedingly unlikely the banks defence would just be struck out for not complying in time.

  23. That seems to be left over from the old announcement. Templates will most likely not be available within two weeks (unless the OFT say No and Counsel are confident with the arguments presented) . The OFT do not expect any announcement until near christmas or early January (source LB's meeting with them) and we should support them in that as they have to make the right decision. I know LB are trying to get something from the MOJ on the overall position of the stays - the original information was it was down to each individual claimant, but without the OFTs announcement thats incredibly difficult. If stay ends are coming up I would suggest a brief letter to the courts with claim reference and outline of your last stay order, and, apologies again for quoting LB, something like ''Following the recent judgment by the Supreme Court (25th November 2009) Case [2009] UKSC 6 (On appeal from: [2009] EWCA Civ 116 ) it is extremely likely that further litigation will follow, either between the OFT and the defendant or otherwise to generally decide the issues. I therefore respectfully submit that it would be appropriate for the Court toapply/continue a general stay in this claim pending resolution of the issues raised.'' I do not consider it wise for anyone to be applying to lift any stay whilst decisions have not been made. The Banks, FSA, Government and OFT AND Courts are all in communication about the next steps, but this may not feed down to the individual judges as has been said previously, so it might be an idea to check the situation out at your individual courts, then go from there.
