  1. I found a life insurance policy, so there’s money, I’d rather try and get a settlement figure and pay them out the policy than have them put a charge on the house. I just begrudge using the money to pay that shit instead of the mortgage.
  2. Hey guys, sorry for going silent. I had to take a break from trying to deal with all this. I’m still upset about losing my father. I’m writing to his creditors and arguing with them and requesting settlement figures. My question is, isn’t there supposed to be some legislation where creditors should notice you’re not paying off more than the interest they’re charging and stop the account/stop your credit? I want to argue with them that they shouldn’t have allowed his credit cards to get into that state and propose as the majority of the balance is interest to write a lot off. Thanks
  3. No I’m not on the deeds, I’m just his next of kin, and there’s no will. Can I be forced to use the life insurance to pay them rather than the mortgage? thanks for your help
  4. I found a life insurance policy which covers around 3/4 of the mortgage and my brother and I should be fine to get a mortgage for the remaining balance. I was just worried we’d have to sell the house to pay off the credit cards/store cards. No PPI I know of, he’d recently gone through and put claims in against them all and for refunds.
  5. Hello, I’m wondering if anyone knows the answer... My father passed away this month, we can’t find a will so I’m currently going through the probate process to try and deal with everything. so far it seems the money in his account will pay for approx 2/3 of his funeral. There is a life insurance policy which would cover around 3/4 of the mortgage There is approx 20k of credit card and store card debt. I was thinking of selling his Van and then spreading the funds for that to go against his debts, but I’m wondering if I will be forced to sell the house to pay these credit card debts? (A house i currently live in) thanks
  6. Hello I have a problem with last minute.com and 2 airlines. I booked flights with last minute.com and I didn't realise at the time that they apparently didn't leave enough space between the connecting flights (1 hour). On my journey home, I caught the first flight fine but it was delayed almost 1 hour (flying with LAN). My second flight was supposed to be Iberia operated by LAN or vice versa before I had even got on the flight they were sherking responsibility with my meal (I am vegetarian and lactose intolerant) both airlines told me it was the other ones responsibility to provide my meal! When I reached my second destination, the connecting flight was boarding and I was advised by someone who worked at the airport that I had to buy new flights. I was advised that in South America you should have 3 hours between flights so I wouldn't have been able to board that flight anyway as 1 hour is too small a window. I couldn't get hold of anyone in the UK so I did what I had to do at that time which was purchase new flights home (£2000). I have since looked at my travel insurance and it only covers missed departures up to £500 (and it looks to not cover missed connections). Last Minute.com shirked responsibility straight away and said LAN should have put us on another flight so they should pay out. My friend and I have chased LAN and Iberia and we aren't getting anywhere. so my questions are: 1. Does anyone have any advice on what to do? 2. Would I get anywhere chasing lastminute.com - I have heard that they are notoriously rubbish and won't accept liability for anything. 3. Does anyone know if my friend and I could jointly sue Last Minute, LAN and Iberia as one claim? E.G one claim against 3 companies. I worry if I tried to sue anyone separately they would blame each other and I'd end up out of pocket further. P.S. don't book anything with Last Minute.com, they suck
  7. Excellent, I love using the OFT guidelines, one of my favourite party tricks. That's pretty must the jist of what I was going to say, only far more formal. I need to reply to it due to the house I'm living in not being mine etc etc. Just going to nip it in the bud before I get in trouble from the house owner (my aunty!) Plus I like putting these cretins in their place Can anyone remember if it's actually illegal for them to disguise it as a PCN or if it's allowed? I had stuff saved on my laptop but it died! I'm sure it was something I read about disguising debts to look like they have more authority then they do? I want to wing this at them as my final nail on the coffin
  8. Hey is the deal still the same for Scotland? I'm about to write a letter for a ticket telling them to shove it, but want to make sure i'm not going to shaft myself. I am not the driver, just the registered keeper, I don't even have a driving license. Also the fine is for parking in a disabled bay when that was the only bay available to unload the van for a delivery to the shop. Seems pretty ignorant of the parking attendant to ticket for that. Just want to make sure there is no dodgy Scottish law that says I have to pay it, had a quick scout on the internet but cant find anything. Also this ticket says "PCN" isn't there legislation about making their ticket look like a PCN illegal?
  9. Just wanna say what a load of crap these credit files are!! I have 2 Mobile phone contracts, a store card, 3 credit cards, 2 bank accounts and a next catalogue, all of which have an excellent history (never miss a payment etc) I have lost count of the amount of times my cards have been maxed out and paid back! A payment was made on a credit card that I no longer use and I was unaware (£15) so i missed the payment for 2 months. £15 became £62 and I paid it in full, but now I can't get a loan for a car over a £15 website renewal when my credit cards have thousands paid on and off them every month (I use them as my company credit cards buy stock etc) Does anyone else think this is ridiculous?

Hey There I have been in dispute with the energy company about missing payments I sent them with regards to my business premises, and have refused to send them any money till they sorted it out (they claim i have 9k arrears, but its acutally about 5 since i refused to pay anymore), I got a letter last week stating they were going to have the supply disconnected, and last week was just a bloody nightmare with the bank and bin suppliers etc so I forgot about it. I went to deal with it today, and they have already been in and changed the locks. Now they claim that they had a warrant, but I'm pretty sure I still have 7 days to reply and they never issued me with a warrant. Is this legal? P.s. I'm in Scotland. Cheers
  11. Thats what I told him to do, but I don't think the fines are excessive for the offence, drink driving etc are way worse, nobody has been hurt by his van

Hey, have a court hearing next month for driving an overloaded vehicle, as the vehicle was severely overloaded, I am thinking this fine could go into the thousands (50% overloaded saw someone get fined £800 for being 15% overloaded!!) There is no way realistically he will be able to pay a fine that large, and he is saving up to apply for bankruptcy due to massive debts. If this fine does tip the scales, can it be added to the bankruptcy order? If the fine is a few hundred pound I'd tell him to bite the bullet and pay, but 1-2000 or more is not the kinda money the average person has available for fines.

  16. Hi i have heard about a piece of scottish law, and i just want to know if its true or where the origin of the rumour is from? Apparently if you request a copy of a loan agreement and it is not produced within 28days the loan becomes null and void??

I dont think they are after whiplash claims, But this idiot is trying to get a new car out of my brother, when he offered to pay for the repairs cash, he has only been driving a week and doesn't want it to go via his insurance as he doesn't want his premium to sky rocket, but this guy is being awkward and wanting to claim all the way. I can't see how anyone will be able to claim of my brother's insurance with no ommission of guilt, a few bumps which could have been there years, no cctv, no witness statements, and no police report? Especially when my brothers car is now fixed.
  18. So my brother skidded in the rain the other week and crashed into the back of someone. He gave the guy his ins details and contact dets and when he asked for the guys details he said "i don't remember" and gave my brother the first line of his address, no postcode etc, and left the scene of the accident My brother has pretty much fixed his car repairs, and offered the guy money to fix his number plate and the guy said "i dont know, its my mums car" So we assumed he was not insured to drive this car now he has called up saying that he wants to claim off my brothers insurance (he has only been driving 1 week and will never get insured again!!) so my dad has taken over and has told him to whistle for it as he has committed an offence by leaving the scene of the accident without reporting it has basically told my brother to deny deny deny. .....what shall we do, he has no witnesses, we still dont know his address or his insurance and my dad is refusing to let my brother pay him anything as he was rude and in the wrong and my brother is freaking out that he is going to get sued. Please help
  19. Its not banking unfortunately, its a stupid hire agreement for all the furniture in one of our bars! Kinda need them not to repossess the items I have sent them a modified CCA telling them i want an explination of the interest/charge added...we'll see what happens

  21. sorry, i have read that back and it doesnt make much sense. the company i work for have a hire agreement with rbs for some furniture or something to that effect. they changed bank accounts and the bank missed a payment and as such rbs have passed the debt onto daniels silverman (after missing one payment, i think that is really bad). so the debt had now increased by £1000 and when my boss asked them why he was told they dont know and dont have to provide him with that info. I am writing to them on behalf of my boss, to request this info, but i dont want to SAR them as its £10 and i think if i write to them they'll more then likely reply fingers crossed. just wondering if there is something similar to cca/sar to request a breakdown of the debt, which i can try before i sar them. apologies for the poor grammer etc, but im on a netbook and its really annoying me! thanks
  22. Hey everyone, i am dealing with a DCA that has refused to explain/give a break down of why the debt has increased by £1000.....on behalf of my employers.... I know i can SAR them for a break down of their interest and charges added and then fight with them if it is not given within the 40days, but i dont really want to spend £10 when the chances are they will tell me £1000 interest added, and i'm out £10!! Is there something else i can do something along the lines of the CCA request? Cheers
  23. Its in the uk a one way rental from scotland to manchester i was apparently over by 39mins. I entered my pin on a cc machine when i was picking up the car to authorise a £35 one way charge but this was when i picked it up. when i dropped it off i did nothing but drop the car off and go after being told "everythings fine" I actually refuse to phone them as their phone number is expensive and they keep you on hold for hours, i will only communicate via email. The bad thing is Europcar are the same as National and Alamo everything else so you kinda have to use them if you are hiring a car
