  1. Hi, if she's not earning enough why no deferral? Wonder if it's the same situation as my son - they keep losing his paperwork. Who can risk a CCJ - there are thousands of people in the same situation at the present time! But many will not tolerate bullying and intimidation from a loan company who may not even be legally entitled to collect the debt. I doubt that your friend will be left alone even if she arranges a repayment plan, this may be the start of a very stressful episode for her. Advise her that she needs to CCA the loans company - send a letter and include £1 postal order. In fact we haven't had any response whatsoever which indicates that they are not legally entitled to collect the debt. So, attention now moves back to SLC. Your friend needs to spend some time on this site reading up on consumer law and her rights, and not bow down to bully boy tactics! A £10 fee must be enclosed with the letter.   2. Hi, I sent an SAR on behalf of my son, but not a CCA because he doesn't dispute the debt. He too is being threatened with court action, which is their fault as they regularly lose his paperwork. I'm not sure but some threads say that the SLC is not regulated the same so they don't have to supply a CCA. I sent an SAR to them on behalf of my son but not a CCA. He also thought he'd deferred, but they consistently lose his paperwork and send letters to the wrong address. They are so inefficient.   7. I'm helping my daughter sort out her finances and would appreciate some advice on this. In 2004 she owed £198 council tax, according to a letter from 'Jacobs Certified Bailiffs...' in which they demanded repayment of £50 a week. To cut a long story short, a couple of months later and the bill shot up to over £300 which she paid in one payment. Three years have passed now, is it too late to try and reclaim those charges?
  8. My daughter's former employer (county council) overpaid her by about £1,500 over a period of about 5 months. She didn't even realise she was being overpaid as at that time she had 2 jobs in the care sector and worked incredibly long hours, often 7 days a week, 15 hours a day. Hence her salary was always high. She adored her work, for her it was a vocation. She lived, ate and breathed her job, the money was secondary. She never checked her time sheet or wage slip. (Silly girl!) Anyway, it took the council EIGHT months to discover the error, then they wrote and asked for the full remittance saying 'I apologise for any inconvenience caused...' Sadly I didn't find out until recently and now I'm helping her with this and her other problems, thanks to the existance of this most excellent site. As far as I know they didn't pass it on to a DCA, but I think she now has a CCJ against her (we're just waiting for her credit report.) Any advice on what to do about this will be gratefully received.

  12. Hi, Sent CCA on 25 July so the 12 days are definitely up. Are AK now in default? If my sums are correct I think the 30 days are up on Sept 9. Should we be doing anything or just wait patiently?

Just 2 mini queries: There are 2 columns on the page named - '8% on Penalties' and '8% on Interest on these Penalties' What should I change them to? Also, the APR is 34.9% but the box is changing it to 35%, is this right?

  21. Hi Steve I think they're fibbing, they sent my son all his. Re: the statement issue, yes they can charge. The advice is not to ask for statements, but a complete list of transactions and charges for your account history with the organisation. You need to send them an SAR, and include a cheque or postal order for £10. That is the maximum fee they can charge.
