  2. Update - Had a reply to LBA - they say they're not going to increase their offer - their final response - advise we put this behind us and save the court's valuable time.
  3. Nothing more from Lowell, however, just received a letter from Hamptons Legal saying the account has now been passed to them. It's threatening legal action in 7 days unless some payment made. (Just spotted at the foot of the letter that Hamptons is a trading style of Lowells.) Just as you predicted CB! Should I now respond by pointing out that they have not complied with my CCA request?

  6. POET - yes CCA'd them, and you're right, they responded very quickly. Rory - I'm begrudginly giving them the benefit of the doubt. In my 1st letter I'd only referenced one account number, but the wording was specific, taken from the letter template on this site: 'Please supply me with a complete list of transactions and charges relating to my loan history with your organisation.' I assumed that was sufficient but apparently not. In their 2nd reply they wrote: '...I take it that you require a full Data Subject Access Request (Sigh, I'd stated that twice) ...' and gave previous account numbers. Was just going to write back and say 'by jove I think you've got it.'

  8. Lol, the 'experts' are all ebay users, absolutely no staff involved. They all give their time voluntarily to help people and give advice on how to sort their account problems etc. I've used eBay for 4 years and only encountered one problem in that time from a non-paying bidder. But, I don't use PayPal for UK, cheques only.
  9. There's no CCA for eBay. You just register online with your personal details and away you go. They have 11 million UK customers alone.   10. Just about to send my 3rd SAR letter to Black Horse, as they are messing about and playing games by only sending partial information. This has been going on since July. Meanwhile, they have served a default notice. Can I ask it to be removed whilst all this hassle is going on due to their non-compliance?

  12. Update. BH are so tedious. Got another letter from them at beginning of Sept enclosing a load of screenshots etc. It is quite evident they are being pedantic and write 'I take it you want a full Data SAR? As I had already headed my previous letters 'Data Protection Act 1998 Subject Access Request' I couldn't really put it any plainer. So a 3rd attempt will be going in the post this weekend. Meanwhile, my son has since been notified that they have served a default notice on him. Can he request its removal whilst all this hassle is going on?
  13. 5 years? No they're wrong. They must respond to your request for a copy of the CCA. From the advice I've been given in recent weeks, I would just ignore this letter and play the waiting game. 12 working days to comply to your CCA request otherwise they default, then a further 30 days before they have commited an offence.

I wish to stress that I will accept your offer as partial payment only towards my claim. The money transferred to my account should not be viewed as my acceptance as a full and final settlement. As my Particulars Of Claim state, I am claiming contractual interest (compounded daily) at 34.9% APR which is the rate that has been applied to my account, and is the most current interest rate being applied according to my statements. I am a reasonable person and would be happy to negotiate in an effort to bring proceedings to a close, but in the absence of any serious attempt at settlement on your part, you can be assured that I will pursue this claim in the most vigorous manner, in a County Court if necessary. Should you wish to settle my claim in full, please forward the balance of the claim (£....) without conditions, within 14 days of this letter. I trust this clarifies my position. Yours faithfully
  15. Update - finally mastered the spreadsheet and sent off the prelim letter with claim for £1400. They have now replied offering £300. What's my next step, do I accept as a partial settlement or refuse this offer?

  17. Morning CB. Oh, right. But as they've sent the application form - trying to pass it off as a CCA - they are waiting for a reply. So I should just wait now until their next letter?
  18. Forgot to ask, is my next step to send them a default letter, and if so, can anybody supply a link?
