  1. Can I just add that the best basic account on offer is the Cashminder account with the Cooperative Bank. You get a Visa Electron Debit Card, link cashpoint access, online banking, standing order and direct debit facility, the telephone custmer service is excellent and has always been friendly. And more importantly you can never go overdrawn!
  2. They also seem adament, this is part of their scare tactics. Ignore them and request that all communication is put in writing. If they continue then report them to the OFT for telephone harassment. They will eventually agree to the £40 per month. You are more than welcome to PM me if you need advice etc.
  3. Good old BCW, the chased me for 3 years for a debt which I paid off £5 per month, they wanted more, I said no, they threatened, I laughed at them and surprisingly they went away in the end.
  4. Green & Co are RBS's internal solicitors and usually act on behalf of Triton. It's just RBS's way of trying to intimidate you. Please don't worry yourself sick about it but even though you owe the debt please CCA them as the debt has to be proved for it to be enforceable and whilst you are disputing the debt they cannot collect.
  5. It is rare for any DCA to refuse a payment as that is the reason for their existence, to get payments. They always ask for more than what people can afford. You cannot pay more than £40. If they won't give their bank details out then send them a postal order (there is a post office fee for this) but never pay by debit card as they can keep your number and charge the card whenever they like. First of all please send them a CCA request to check that the debt is enforceable.
  6. If you have proof that your wife has paid the account in full by having a copy of the bank statement then you don't have to pay anything. Do you have a final copy of a statement from adams stating that the balance is zero?
  7. Don't forget to add some bits of gone off food from the bin along with some stones, rocks etc etc!
  8. I wouldn't worry too much about this to be honest. Generally DCA's threaten people with court action and think they can get away with it. The first thing I would do in your situation is to send Triton a CCA request with a £1 postal order which puts the ball firmly in their court. If they can't provide a copy of the original signed credit agreement then the debt is unenforceable. Occasionally they take people to court but this is rare as the judge is likely to laugh them out of court. You've offered to pay something per month that you can afford which is reasonable, they've declined (expected), so I would pay them the £40 per month away via standing order so that you control the payments, ask Triton for their account details. A DCA is very unlikely to refuse payment and if they did and then took you to court the judge wouldn't look on them too favourably. Also the majority of the time the "solicitors letter" is some official looking piece of rubbish that is sent out from their in house litigation department to scare you. Don't phone them again as they will run rings round you. Put everything in writing to them (preferably by recorded post) and if they call you tell them to bog off! I've been threatened like this on 100's of occasions and nothing has ever come from it.
  9. A lot of the DCA's send what's called a "threatogram", which is basically a gutless threat to try and get you to pay more money to them. A genuine court document normally comes from Northampton County Court which is basically a court that the majority of DCA's use. Have you received any blue court papers or forms?
  10. Send them an email stating that: They cannot contact your employer without a court order. To get a court order they need to go to the court. The court will most likely order you to stick to a payment plan with them. If you then default on the payment plan it is only then that they can APPLY to the court for an attachment of earnings.
  11. First of all do NOT take out any more payday loans as this will land you in even more trouble. I have dealt with several payday loan companies, all very successfully so I am more than happy to try and help you. 1. Cancel your debit card as they will have your details and can charge your card at any time and they will. Report it to your bank as "lost" 2. Write/Email Tower Capital to inform them that the money hasn't cleared and see what their response is. If you don't get anywhere my advice would be to cancel the loan (most companies give you 14 days from when you agreed to the loan). I know this will leave you short but is their anyway you can borrow from friends/family or your bank? 3. Keep an eye on your bank account as Tower could try to set up direct debits. If this happens just contact your bank and get them deleted from your account. If they do take money via this method then contact your bank and put an indemnity claim in. The bank will then refund the money to you.

  13. Hi guys, Have a debt with Capital One and am paying them via my CCCS DMP. Anyway they have sent me lots of texts asking me to call them which I won't as it is an 0870 number so I emailed them instead.... And now they are calling me non stop at work....they try my house phone first which my husband answers as I am at work....they then phone my mobile and hang off as soon as I answer......then then phone my work number and despite me telling them that I am work and can't speak they carry on the phonecall which I have to eventually hang up on. Is there anyone I can complain to about this as it's very embarassing
  14. Only you can change the amount/frequency and date of a standing order from your bank account. Keep paying them this way, it means that they cannot take any extra money that you are now aware of.
  15. I got a letter from Lowell stating that I could "Bid and buy back my account"?! How on earth could I buy back the account as I know it's mine and am paying it through a DMP. Very funny though The debt is for £1000 + so I offered £50!!! Ha ha
  16. Although email is cheaper and quicker it is far better to use recorded delivery for sending letters to a dca. By all means email them a copy of the letter as well so that you are double covered.
  17. :DDear fellow caggers, I just wanted to say a BIG THANKYOU to all that have advised me over the past few years of being a member on this forum. I have managed to pay off over £3000 on my DMP, have got one debt written off and have had a complaint upheld by the FOS. This is mainly due to other people helping me and me learning. I am now helping other people on the forum and if any DCA's ever call me (very rare now) I am confident in dealing with them and I know what my rights are so they no longer run rings round me:-D This forum is fantastic, cheers guys!!!!!!
  18. Hi Lilianmay, First of all love and hugs to you. I know what depression is like having suffered from it in the past and now suffering from OCD. It helps typing away on this forum to control the OCD! Now please ignore Activ Kapital (any company that doesn't use proper english in it's company name should be laughed at!)! They chase me for a debt that I didn't owe and I refused again and again to pay it and disputed it at every level. Eventually they wrote it off due to my perseverence so if you need help in the future please contact me. Don't ever phone them as they try to run rings round people. Just ignore them! If you say that you haven't borrowed anything since 1999 any debt that you are now chased for is statute barred. Take care Katpuss
  19. RBS are just trying it on. If they cannot produce a signed by you credit agreement then they cannot enforce collection of the debt until they do. Thye won't write if off but they must cease any collection activity. Just wondering, what type of debt is it and how long ago did you take it out with them?
  20. Capital Finance One are a bunch of cowboys and are hopefully soon to go out of business as their systems keep failing again and again. I took a loan out with them and then cancelled as after over a week the money hadn't transferred in due to "system errors". Are they able to get payment from you?
  21. Have you taken the loan out within the past 14 days? If so you can cancel as per the credit agreement that you should have received before the money was transferred.
  22. This company is a joke! I took out a loan with them but cancelled within the 14 day cooling off period as the money had still not cleared after a week. Fortunately they haven't taken anything from my bank but this is probably only due to the fact that I cancelled the loan. I hope you get your money back from the bank Michael, I really do.
