  2. yeah just keep going guys on your timescales dont let the bank dictate the times. I had a simalar response to my 1st letter after about 10/11days. Just waited until the 14days were up and sent off my LBA. didnt receive a response to that so I filed for court today.

  4. thanks happy. As it happens I received some missing data today. they didnt send me statements though they sent lists of charges and thats it. Will these lists of charges be suitable to use as evidence when it comes to preparing court bundles as from what Ive read it says to include statements.

  7. I have those on my abbey charges but not lloyds. I think it is the same as lloyds's O/D excess fee
  8. hi hands, just subscribingto your thread. i am at a very simalar stage to you as the 14 days of the LBA has expired. you can pick up an N1 at your local court or do it online through MCOL. good luck. matt
  9. right collected a N1 form from the court and im filling it in. for the POC to I just copy and paste it from the templates section and just add my account no and other details and print it out and attach it or do I actually write it onto the form? Do i attach an upto date schedule of charges,if so is it 3 copies? Do I have to send lloyds a copy or do the courts send it? And 1 more when it comes to totaling up what im claiming, the 0.00022% daily interest is that on the charges or the complete total ie charges + 8% interest + costs . thanks. matt
  10. put in the letter what accounts you want the data for and 1 £10 payment covers all accounts
  11. in all fairness i received all of my microfiche printouts inside 4 weeks...........they just missed out 2 months of the statements. lol
  12. well done tracey on reclaiming your charges twice, it gives us all confidence with our claims. I going to get a N1 tomorrow as my LBA was sent 14 days ago...no reply. good luck with all the other claims. matt
  13. yeah, i know. thanks dolly the only problem is my printer is knackered at the moment. its a real pain because all my letters i have to email to work or to my parents so i can print them off and to make it worse my parents are on dial up:rolleyes:
  14. right their deadline to respond to the LBA is up on monday so its off to the courts on monday to pick up a N1 form and get that filled in.
  15. Right gone through statements/microfiche with a toothcomb and it wasn't quite as much as i first thought as some of the microfiche printouts overlapped statements so i added it twice. (glad i spotted that before i sent anything off). total is £3135 so prelim going on monday..# Abbey here i come

Received all microfiche printouts today aswell. still missing 2 months of statements. sent them 2 letters late last night reminding them they have just 14 days left to comply, typical. hopefully though the letters will trigger them to send out the missing 2 months. Although 2 months might not be alot the month before the missing ones i was charges £150 and the month after i was charged £220 so those months could be anything from £0-£400 and i want to make sure i get back everything im entitled to. oh and a quick scan shows a total off £3467
  17. hey mistie, i said we were at very simalar stage, i got all my microfiche printouts today too. i put 2 letters in the post late last night elling them they only have 14 left to comply lol. i am still missing 2 months of statements but im going to crack on now with the prelim hopefully should receive them before i have to file for court. ive had a quick scan and it totals £3467. good luck with yours. matt
  18. ive had very simalar problems. my acccount is £900 OD i have sent a SAR asking for my data. received 12months and they promised to send me the rest. In the meantime they have transferred my account to DRMS (a collection agency) I spoke to them today and in all fairness to DRMS they were quite helpful. I agreed to pay back £50 per month. obvoiusly it is not good that my account is now with them but once I get all my statments from them I am going to insist that when I make my claim that they remove any defaults as it is the charges that have caused it. the 12 months data that i have is for more than the £900 that i owe them. If you ring the number on the letter, which I assume is from milton keyenes and try to arrange to make monthly payments to them,they may agree to that.
  19. yeah, i have been keeping an eye on your threads as we have are at a very simalar stage. i have drafted my own letter and im going to send it tomorrow. LTSB going ok they have until 20th or it is time to start court action. good luck mistie. matt.
  20. mistie, they have got until the 31st march. I am thinking of writing a letter to them as im still missing 2 months of the 14 months they promised and also all the microfiche printouts. I was just going to send them a polite reminder that they have 14 days left and im sure that a business like theirs would not to fail to comply with the DPA
  21. you can write back and say refuse it or accept it as part payment, so yes take it off the total amount of charges
  22. just posted this in the general board but seems quiet over there a the mo so have copied and pasted it here to see if anyone can help. At what point does a bank account become in dispute??? I am making a claim v abbey and have sent a SAR. I havent had all the info back yet (deadline end of this month). I have just had a phonecall from DRMS (abbey's collection services i assume). They refused to speak to me and would only talk to my wife, who is not here, although it is a joint account. Is my account in dispute yet and can they transfer it to a debt collection agency or is it once my prelim has been sent that it becomes in dispute?? thanks. matty

  24. I have statements dating back to july 2002 which you can get from online banking with lloyds. If you are not registered for online banking with them just set it up, it only takes about 3 days i think. I am claiming back charges until 2002. I am also waiting for my statements from them but i am going ahead with a claim for what I already know about so the ball is rolling. I have already sent a prelim and a LBA to them.
  25. hi mistie, its funny that we are both claiming against lloyds and abbey and both seem to be around the same stage in our claims. I have had 12 months out of a promised 14 months and have £950 in charges. my account has been pretty dormant since about august so its only really about 8 months charges that have made up the £950. like you im worried that when i finally do get my 6 years worth of data that i will be above £5k. I will keep an eye on both your threads and offer any advice if possible. good luck. matt
