  1. Hi, 10men. To be honest I dont think you asking for a default to be removed is going to have an adverse effect on your case. I too am at a simalar stage to you and my AQ has been dispensed with, as have many others. I cant tell you how long it will be before you receive the transfer to the court to come through but I wouldnt of thought it would be that long. Lloyds have 28 days from when the claim was served so in your case 4/4/07, so they until tomorrow if my maths are right. The courts are quite clogged up at the moment so although they should have submitted a defence by tomorrow you may not receive it straight away. It took the court 2 weeks from when the defence was filed to send me a copy. If your court does dispense with the AQ take a look at this. Is your court dispensing with the Allocation Questionnaire? good luck in your claim. matt

  3. Going to send a letter requesting the draft order anyway, cant do any harm. ive read through what is needed to be sent should the judge approve and I think I have a decent understanding of it. Hoping this spurs [problem] into action.

Hi GuidoT, thats all the letter says, its 2 lines long Dear sir/madam, Re: Me v LLoyds Tsb Bank Plc Case NO..: 7WR00725 I enclose a copy of a defence received on the above case, the file has now been refered to the District Judge for directions, these directions will be forwarded in due course. yours faithfully, Mrs XXX issue section The defence is just the normal 9 point defence I have read on other threads. Do you think its worth ringing the court and asking where the AQ is.

    Advice Needed

    Hi, you can try offering them a lower amonut of money tell them that you can only afford to pay £25/£50 per month. Tell them if they agree to that then you will pay the agreed lower amount each month they should settle for that.
  8. Received the famous 9 point defence today served on the 10th april. Got a letter enclosed from the court saying that the file has been referred to the district judge for directions, these directions will be forwarded in due course. I take it that means the AQ. Really feel like im getting somewhere now. Just 1 quick question in [problem]'s defence they mention about contract with them, as I opened the account when I was 12 surely I cant agree to a contract???
  9. Received acknowledgement today dated 5th april. Its taken the court 3 weeks to get it to me. LLoyds had until 24th to file a defence. I have read on a few threads that lloyds had been using some different solicitors. I have been lucky and got the delightful bunch from [problem]:rolleyes:

  11. Hi again, I wouldnt be surprised if you dont hear anything for a while yet. I filed against lloyds at worcester county court too and lloyds had until 10th April to acknowledge and until the 24th to defend. I only received a letter from the court TODAY saying that they acknowledged on the 5TH. apparantly they are miles behind at the court

  13. Right im off to court today to put my N1 in. Just a couple of questions before I do. 1, do I put the defendant as Abbey Plc/Abbey National Plc/Abbey Bank Plc??? 2, When sending my prelim and Lba to them I included the bit about a default being removed as abbey had sent me a letter a couple of months ago informing me that in 28 days they would be defaulting my account. They also sent my account to DRMS, which I think is their in house debt collection people.I have look at my credit report and they have not actually entered a default but stopped just 1 step short. Should I still ask for this to be removed?? 3, If the answer to question 2 is yes I should ask for it to be removed how do I enter this on the N1 form?? I guess it would need to go on the breif details of claim and the POC section but does anybody know how to word it?? Thanks guys, matt
  14. I believe that under your circumstances you would be exempt from paying court fees.
  15. yes add them to the schedule of charges. Just one thing, have you sent 2 letters? a prelim and a LBA?
  16. Hi, do not bother to reply to their standard letter it is just a delaying tactic and/or to put you off. I would still send your N1 as once it is deemed served they still have 28 days to enter a defence. (14 days to acknowledge, then a further 14 days to file a defence). And yes, you can add the new charges on to the N1, its only after you have handed in your N1 that it becomes more differcult. good luck and have a nice holiday. matt.

  18. still not a peep from lloyds 9 days since they shouldve acknoweledged my claim. If I ask for a judgement now and lloyds ask for it to be set aside will it delay things?? is it worth sending a letter to lloyds telling them to pull their finger out??
  19. you can either do it on moneyclaim or at your local court. Money claim is here www.moneyclaim.gov.uk or if you want to do it at your local court pick up an N1 form or you can download it here http://www.consumeractiongroup.co.uk/forum/bank-templates-library/681-4-particulars-claim-n1.html. If you pop into your local court to do it they have a number of leaflets you can pick up which are really helpful. They tell you how to fill the forms in, tell you what to expect and so on. good luck . matt
  20. you will probably be able to come to an agreement with the DCA so you can pay back what you can afford. I have only just had a reponse after sending my LBA. Did you send your letters by recorded delivery, if so you will have proof that they arrived so just carry on with the court claim. If you didnt send them recorded delivery it might just be worth sending them another LBA by recorded delivery. good luck
  21. After reading alot of threads on the abbey board it seems like abbey have no idea what they are doing and today proved this for me. I received a normal fob off letter from the abbey today. The letter was dated 12th April and started with the normal. Dear sir, As you know we are currently investingating your complaint you raised with Abbey 4 weeks ago. I am not aware because they didnt reply to my prelim letter and it was on the 20th March they received it which was only 3 weeks ago. Our research is taking longer because we want to make a full investigation. Yeah, course you do. We will write to you again in 4 weeks to let you know how we are getting on. I dont think so because in 10 days if you havent given me my money back im going to go to court. We would like to reassure you that your complaint is very important to us. Yeah along with the 1000's of other that you send the standard letter to. 10 days and counting Abbey.
  22. hi Sempei, I am at a simalar stage as you lloyds had until the 10th April to acknowledge my claim, I rang the court today and they have nothing on file but said they were backlogged and told me to either wait until monday or request for judgement. I am going to wait until Monday just incase. good luck matt
