  1. Hi Bassplayer, Personally i took mine to the court but i think you can post it. Make sure you take 3 copies of this to the court with your charges spreadsheets attached to each one plus your court fee. They usually send it to the defendant a couple of days later and they have a couple of weeks to acknowledge it. You might receive the acknowledgement from the court while your away so you should be alright. Joe

    Hi Claire, I found this definition of estoppel if its any use to you, A legal restraint that stops or prevents a person from contradicting or reneging on his previous position or previous assertions or commitments. Joe
  5. Hi Jess, Yes they have asked for a 1 month stay , hopefully the judge will reject this. Hi Blue have they given a name for the witness. Also have they called for any expert evidence or asked for any directions. Joe
  6. Hi , Just a quick update , took my allocation questionnaire plus draft order for directions to court today , and received a copy in the post of Wragges AQ which states they dont intend to call any witnesses. Joe
  7. Hi hgj, You will probably receive a 6 page defence of Wragge & co. soon. If it says you have provided insufficient particulars of claim the send a copy of your charges to Wragges and A&L even though you probably have already done so as they have done this to quite a few fellow claimers on here.   10. Hi all, I received an AQ N150 on Friday and i was just making sure , do i just print off post 2 of this thread as my draft order for directions and can i add a reply to the defence as they quoted the limitations act and none of my charges are over 6 years. If so what do i do. Thanks Joe
  11. Hi Steve, 1 When i done my N1 i took 3 copies of this with 3 copies of my charges list attached to each one which included the 8% interest. 2 It wont matter about the overdraft interest. 3 Yes you can still claim the daily interest. 4 The address to use is Narborough. Hope this helps Joe

Hi, On Friday i received an Allocation Questionnaire from Wigan County Court and was just wondering do i just print out post 2 of the new strategy for allocation questionnaires as my draft order for directions plus post 3 as other information (Section H). Also can i add a reply to the defence as they have quoted section 32 of the limitations act but none of my charges are older than 6 years , the first being from December 2001. Thanks Joe

  14. Hi Trix, The 40 days is for the banks to send your statements to you. The 14 days for the preliminary letter and the 14 days for the letter before action are as set out under the Civil Procedure Rules. Joe

  16. Hi Bakery, It is recommended to open a parachute account as A&L will more than likely close your account. Your statements will probably come around the 40th day after they received your SAR , so this would be a good time to spend the next few weeks reading through other A&L threads to get a feel of what to expect. Also read through the FAQs and Bank template letters section as this will give you the procedures for you to follow. Good luck Joe

  18. Hi , At some stage during the court claim they will transfer it to your local court anyway , unsure when as i didn't use MCOL. Joe

Hi , I personally didn't claim the overdraft interest as it wasn't that much anyway but i think you can only claim that part of the interest that is apportioned to the charges when you went overdrawn. As regards the %8 , this is s.69 interest which you can claim for on your N1 form when you file with the court. Have you filled a spreadsheet out that you can get of this site as this will work out the %8 for you. Joe
  20. Hi Jess68, yes point 8 of their defence states, It is denied that the charges, or any one of them, are punitive in nature and/or a penalty. The charges were incurred as part of the banking services provided by the Defendant and calculated in accordance with the Defendant's terms and conditions agreed to by the claimant. So it seems a standard defence. Joe

Just follow the procedure as set out by CAG which follows the Civil Procedure Rules which you will find in the FAQs. Also it would be better if you start your own thread in this forum called Bongorob vs A&L and then others will be able to follow your claim and answer any questions you may have. Joe
