It wasn't for an overdraft. It was a flexiplan account with a £3000 limit. I could transfer upto this amount into my current account and it was paid back by standing order at £100 a month.

Hi , Wigan CC have stayed my claim . I filed on the 8th May and was still awaiting directions , unsure if they are staying all claims. Joe

Hi Claire, Is your hearing still going ahead , as i rang Wigan CC on Friday and they said that my claim has been stayed until after the OFT test case. Joe

Hi Claire, Give the court a ring to see if Abbey have filed a defence. If they haven't then you should be able to file for judgment by default. Hope this helps. Joe

Hi Skinny, I never filed through MCOL , i took my N1 to Wigan CC in person so didn't have to wait for it to be transferred. I haven't got a court date upto now as there is a big backlog of cases there. I filed on the 8th May and received AQ a couple of weeks later when A&L filed a defence which i returned on the 7th June. I then received a derisory offer of £273 out of a claim for nearly £3000 , now its just a case of playing the waiting game. Joe

Hi, When i've cashed postal orders at the post office they always scan them on the computer , so i would imagine you could ring Royal Mail up and ask where it was cashed. Joe

Hi Claire, The Allocation Questionnaire arrived a couple of days after A&L filed a defence. The Draft Order i mentioned , would if granted by the district judge speed up the process hopefully. Hi Claire, I have a case against A+L at Wigan County Court and they sent me an Allocation Questionaire. They are pretty easy to fill out and just add the draft order for directions to it. Just awaiting to hear from them now. Good luck with your claim. Joe

Hi pudkids, Have you used one of the spreadsheets off this site as this will automatically work out the %8 interest for you. There are quite a few people on this site who have claimed over £5000 and it has stayed in the small claims court so i would personally add the interest as you are entitled to it. Joe

Hi Evo, Just change the first line to "i'm very disappointed with your response to my letter dated XX/XX/XX". The letters in the bank templates library can be altered to suit your needs if you so wish. Joe

Hi pudkids , you just need to take 3 copies of your N1 with 3 copies of your charges list attached to each one and your court fee which depends on the amount your claiming. Joe

Hi butwhy, The 14 days for the prelim letter and 14 days for the LBA are minimum periods as set out in the Civil Procedure Rules so as long as youv'e given them these timescales you will be alright. You will still be alright to reply to these responses as long as you dont leave them for a few months in which case just resend them. Joe

Hi Granny, Yes there are a lot of us in a similar situation to you at the moment , either waiting for a court date or just received one. I myself am just awaiting a court date claiming just under £3000 so hopefully will get one soon. Patience is the key with A&L for claims above £500 as they usually take it to the wire. Joe

Hi bp, I think this is standard practice countrywide , as i have had home visits for all my kids before they started school. It's so you can ask any questions you may have and get to know them a bit better. Unsure if you can refuse or not though. Joe
