  2. No, stick to your timetable not theirs! They rarely seem to even acknowledge your LBA. There is generally an offer of around 70% of what you're claiming, it's totall up to you if you take it or not. You'd still have to pay the £120 fee for filing the MCOL though. We're all here to help don't worry!!!
  3. In light of the antics in Birmingham yesterday I thought I'd start a thread off so as and when people get a date for Court they can post it here. This will allow others at earlier stages of their claims to follow the case and allow the mods and the more knowledgeable members of the site to help people prepare for court and help prevent a repeat of yesterdays verdict. My case is with the Judge at the moment and when I get a date I'll post it here. I suspect those with dates in the near future will be worth keeping an eye on. r-t-v

  5. Emma You're not dealing with HSBC anymore you're dealing with DG. You'd think that HSBC would forward your schedule of charges on to them wouldn't you! Send them a copy of your breakdown today via recorded post. At least your claim is being looked at. I assume the delay is due to a massive backlog at the court you're dealing with.

  7. Hi Banff MCOL can be paid for with any debit/credit card. there's a guide to filling the MCOL in on the site, I'll find a link in a bit. Once you have done the MCOL you need to send 2 copies of your breakdown of charges to the Court in Nottingham, requesting that they be attached to your claim.
  8. Yoko Welcome to the forum, first off i'd start your own thread. You stated that you've got a copy of the banks AQ, did you fill in one yourself and send a copy to them? If this is the case then your 'file' will now be with the Judge. I can pretty much guarantee that there is a backlog of cases (not just bank claims) at every court in the land. The Judge will get round to it in good time, don't panic. Might be worth giving the courts a bell to see what the state of play is. Once the Judge has got to your file you'll hear from the Court telling you what course of action he/she has decided to take. Int he mean time I'd download the court bundle from the site and familiarise yourself with everything incase you have to go to court. r-t-v
  9. askus. Welcome to the forum. Now that you've filed you MCOL, the bank have 14 days to acknowledge it, once they have done this it then buys them a further 14 days in which to enter a defence. So you're looking at 28 days in total. The bank usually enter a defence at the last possible minute! What I'd do is around the 27 day mark, go the the MCOL site and try to apply for judgment. It won't let you if the time hasn't run out so don't worry about clicking on it every hour on the hour!! I'm hopeful for you but it's quite rare that the bank don't enter a defence. Once the bank have entered a defence you'll get a notice stating that a defence has been enetered and a notice of transfer moving the case to a court in your neck of the woods. hth r-t-v

  11. Just a quick update, I phoned the courts this morning and low and behold, DG have not filed an AQ, no great surprises there! The file is with the Judge at the moment and there's a backlog. (I wonder if there has ever been a time when the Judges don't have a backlog!) Think I'll fire off a quick nudging letter to DG today. See if I can't get my name to the top of someones inbox for a few minutes! r-t-v
  12. Whilst I am gutted for Kev, (I hope he appeals and takes them to the cleaners by the way!) I for one have no intention of dropping my claim against the bank. Todays events have only made me more determined to make sure I've got everything right when I get my day in Court. I've filed my AQ and am waiting for a court date to come through. I intend to post here in due time and seek the advive of the forums extensive knowledge base. I can understand that some people may now be very worried, but my advice is simple. Harness any worries and fears you may have and channel the energy into making sure you are 110% prepared for any possible outcome. In the FAQ's which should be the first thing to be read and re-read before you even beging to start a claim it clearly states that this may end up in court. I myself have been guilty of getting a little complacent and thinking "It'll never get that far!" and in most cases up until this point the bank have settled before it gets to Court. Today has been a rude awakening, this isn't just an easy way to make a fast buck, it's serious stuff. An appeal could end up in the High Court! That's a place that I've only seen on the TV! It's not easy money, but if you get it right, (as I hope I have and continue to do!) then I firmly believe that cases will still continue to be won. I say all hands to the pumps and lets keep fighting the good fight. If it goes to Court and you lose, face it what's it cost? £120 possibly for MCOL and another £100 for the AQ. £220 to pay for having a damn good go at the bank doesn't seem all that bad to me. If I quit at this stage I'd regret it for a very long time. I've already paid my £220 so the only thing it's going to cost me from this point on time spent in research and preperation. It is by no means the end , the Fat lady hasn't even got the part yet let alone started warming up! Don't go to court unprepared and use the wealth of subject knowledge at your disposal on this forum. I look forward to seeing how kev proceeds now and I hope he appeals against the Judge in Birmingham and gets the result he deserves. peace r-t-v
  13. Kev. I was wounded for you when I heard of the farce going off in Brum today. I'm waiting for a court date to be set myself. I'm not going to let it dis-hearten me as I suspect that this was a 'fluke' and nothing more. I'll have to jump on the band wagon and say you should appeal. But only if you feel you are up to it. There's masses of support coming your way from everyone on this site, from people with far more knowledge than my limited ammount! And the offer of help from Martin Lewis is a blessing. If you're going to take it further then you'll have to be armed to the teeth so the weasels from Lloyds don't stand a chance. Might be worth trying to see if you can get in touch with Tom Brennen as he would probably be able to help you no end. Keep your head up mate and give em both barrels at the appeal! I'll pledge if there's going to be an appeal fund set up. r-t-v
  14. Thanks for the views Lattie. Glad to hear your psychic powers are back on track again, and congrats on your win on the Lottery by the way! I am quite confident I'll get the money. besides, I'm not due out of the country for a good few months now so I've got nothing but time. Every 2 days DG drag their heels is about another £1 in interest I'll be adding to my claim. I was going to be really cheeky and bill them for all the items I've had to send via recorded post, but I figured that was straying into taking the p1ss territory! I'll give it a couple of days and then ring the court and confirm they got my AQ, also get them to conform that DG have failed to return theirs on time too. Which seems to be the usual thing to do. Yet another stalling tactic! The bright side is that everything is done for now. I've downloaded the basic court bundle from the site and have it ready to print should it be required, along with all of my statements and the like. Hopefully it'll never get that far, but a much wiser man than me once told me "Time spent in preparation is seldom wasted." Will update as things happen. peace r-t-v
  15. Thanks for the help lattie & PD, I had put that little snippet in the particulars of the claim, so I've included it in the recent paperwork bundle I've sent to DG and the Courts. Looks like it's time for a little more waiting me thinks....... Should anyone want it, here's a copy of the covering letter to DG. Please find this attached to the rear of my completed Allocation Questionnaire paperwork. To halt this court action against you, I am now only willing to accept the sum of xxxxx, plus £x.xx per day from xx/xx/xx (date claim was filed) until judgement or settlement.   17. OK, to update. My AQ is filled in and will be posted tomorrow, damn this bank holiday, I only remembered the post office wouldn't be open once I'd got there! DOH! I'll also be sending DG a revised copy of my schedule of charges tomorrow. I do have a question though. I've always been sending my original schedule of charges, which was drawn up at the end of Jan this year. This was also the figure that I based my MCOL on also. Obviously there has been a good 100 days since I calculated it originally, which will equate to more interest. Should I be revising the spreadsheet every time i send it out? Or am I bound to this figure now that the claim has been filed? peace r-t-v

  20. Morning all. r-t-v is back and has got the sunburn to prove it! I was in for a nice surprise when I go tin from Gatwick this morning, to my amazement there was no letter from DG! As you can see my sarcasm also made it back from holiday! So my AQ and £100 will be on it's way to the Court this morning. Haven't had a chance to read up on the plethora of new threads since I've been away so I hope everyone else is getting what's theirs! Did but an english newspaper the other day (Daily Mail) and there was an article on Tom Brennan in there, good to see he's still fighting the good fight!   23. I'd expect an offer in the not so distant future, you might get a Court date set in the mean time. When they do offer you what you're asking for, don't halt the action until the money has cleared into your bank mate. Whether you do or don't harass DG seems to make no difference. Some people just get their offer sooner than others mate. Your time will come! r-t-v
  24. Dondonlb, first off, don't panic! As things are at the moment, you won't get an AQ with your transfer paperwork. The next thing you'll find is that you'll get a letter from the Court the case has been transfered to, and it'll either contain an AQ for you to fill in and return or it'll be setting a court date. If it's the latter, then you have managed to bypass the AQ stage. It took a couple of weeks for the court to get in touch with me, so don't worry if you've not heard anything yet. In the mean time, you need to send a copy of your breakdown of charges to DG. Their address and the name of the person dealing with your case will be on the bottom of the defence paperwork you should have received with the transfer info. Lattie (bless her cotton socks!) has drafted a letter that makes a good covering note to attach your charges sheet to, it can be found on post 1 of this very thread. Send it recorded of course! Then it's a waiting game, just for a change! Read up of the AQ stage so you're prepared if they chose to send you one. It seemed a little daunting to me at first, but once you start to fill it it, it's pretty common sense. Never the less, if you're struggling to get your head around it, there's help aplenty on this site, if you can't find what you're looking for, just ask! Good luck mate Keep us updated r-t-v
  25. Afternoon all. I've just got off the phone with the Courts after asking for a couple of days extra to be added to the deadline for my AQ, which they said was not a problem. So I'll file it when i get back from holiday. I've also drafted a letter to DG to get my name to the top of someones list (for a couple of seconds at least!) and as an excuse to send them yet another copy of my breakdown of charges, and finally to warn them to pony up or I'll be adding another £100 to the total for the AQ. Dear DG As you will now be aware, Allocation Questionnaires have been dispatched for this case. I have completed mine and intend to submit it to xxxxxxx County Court at the end of the month. When I submit this questionnaire it will obviously add another £100 in costs to my claim. To avoid any more costs and for me to halt this Court action against you I am willing to accept the sum of £xxxx. I do not agree to waive my rights in respect of any other actions, nor do I agree to a clause of confidentiality. If I have had no contact from you by the end of the month, I will file my Allocation Questionnaire with the Court and send you a revised copy of my breakdown of charges sheet with the further £100 in costs added to the total claim amount. For your records I have enclosed a copy of my current breakdown of charges. I look forward to hearing from you.
