Just to update, I rang the court yesterday and despite them having my file ready for the Judge to look at for the best part of 4 weeks now, it still hasn't been viewed, so I get to wait a little more. Think it's about time for my 3rd letter to DG............ Keep on fighting everyone! r-t-v
  3. Hi Mrs Abs, sorry to hear you've been let down by the courts again. My AQ went in at the same time as yours and the judge hasn't even looked at my claim yet, so your court is way ahead of mine! Hope it all works out one way or the other on Wednesday, I know the frustration all too well. Easy for me to say but don't let the bar stewards get you down. r-t-v
  4. Get in there my son! gald to hear of your result mate! Hopefully i'll not be too far behind you. That's if the judge ever gets around to looking at my claim! I phoned today only to get a talking brick message saying that the courts have taken an extra day off for bank holiday tuesday! lazy, workshy, chiseling...... Sorry, meant to say they deserve it! Guess i'm in the wrong job, I had the plague last week and I still had to go to work!!

  6. Mandy, as we speak HSBCrusher is in the process of trying to compile a Library of all the previous T&C's for as far back as he possibly can. What 'correspondence' have you lost/had binned for you? r-t-v ps Don't panic!!!!!!!!!!

  10. Hello all. Well as I stated in an earlier post, I wasn't holding my breath, and sure enough, HSBC didn't deliver. Here's a scan of the letter I got in return. Sorry they weren't more useful!   16. OK, so I phoned HSBC this afternoon and spoke to a lady who sounded quite helpful. I requested to be sent copies of Their personal banking terms and conditions from today and then every revision dating back to to 1996 (when account was opened). After a short while on hold whilst she spoke to the relevant department, (of filed her nails or what ever!) she said that she'd get them in the post to me. I'm not holding my breath but if i do get them I'm scan them all and forward them to you HSBCrusher. r-t-v
  17. I generally means that the Judge will give them more time to comply, possibly setting a date for them to do so by. If they fail to submit the paperwork by then you can apply for judgement. Your case will be in a big pile waiting for a judge to look at it i suspect. You'll hear from the court when the Judge has looked at the file and decided on a course of action.
  18. Hi Mrs Abs I'm on about the same time line as you so I though I'd say hello. My AQ has gone back and I sent another nudge to DG yesterday, as they seem to think they are better than everyone else on god's good earth, meaning they don't have to follow the deadlines that us mere mortals do! I'm waiting to hear from the courts as to what the Judge plans to do. Probably give them another 6 months to return their AQ knowing my luck! My case differs from yours in the fact that I've not heard a peep from DG at all, despite the plethora (what a great word!) of letters I've sent them! They all went recorded so if it comes to it I can prove that I've been trying to resolve the matter before it gets to court. I'll be watching your case to see how things pan out from here on in. Looks like me you and kingmills might be able to help each another as we're all around the same stage. keep smiling! r-t-v
  19. kingmills, at least the Judge has got round to looking at yours, I'm still waiting and as of yesterday DG hadn't filed an AQ. I sent a hastner to them yesterday, will let you know if I hear anything back from them. r-t-v

  21. HSBCrusher, I got this attached to the terms and conditions I received in October last year, unfortunately I think I threw them in the bin! I'll have a rummage later and let you know.   22. Outstanding post rbrears, I've only had a chance to quickly skim read it but have printed it off to read thoroughly when I get a chance later on tonight, waiting for a court date as we speak and this information will no doubt prove very useful.
  23. OK, so I've modified one of lattie's (thanks yet again!) hastners which I'll be posting today to DG with yet another breakdown of my charges. I was also considering writing to HSBC and asking them for a breakdown of how the £xxx 'total charges' fee which they hit my account with every month is broken down. I know that they won't reply to me but if I get to Court and the Judge ponders over this then at least it'll show willing on my part that I've been trying to resolve this matter and not waste the Courts time. That and the multiple letters I've sent to DG up to this point might work in my favour. Also trying to get copies of their terms and conditions dating back to 2001 as they might prove critical in my case. Any thoughts? r-t-v
  24. Hi titch, are you blind like that cat? Good luck with your claim. Not sure if you're aware but Lloyds won a case yesterday in Birmingham, there's a long thread on the ins and outs in the Lloyds forum, i'd give it a read. It is by no means the end of this as it was just one case in a court where laws can't be set so no Judge in the land is bound to follow suit. Indeed up until this point there has been no other bank victories and it would appear that this one was just a fluke. Good luck and if you need any help you know where I am. r-t-v

My apologies sarah, the fee depends on the amount you're claiming, in your case it'll be a fee of £120 because your claim is between £1000-£5000. up to £300 = £30 £300.0 - £500 = £50 £500.0 - £1,000 = £80 £1,000.0 - £5,000 = £120 £5,000.0 - £15,000 = £250 £15,000.0 - £50,000 = £400 £50,000.0 - £100,000 = £700 r-t-v
