  4. GaryH Apologies for the thread hijack, but I'm in the process of claiming against HSBC. The deadline for AQ's was 5 weeks ago and the defence have still not filed. The Judge seems to be taking his/her merry time in gettting to my case despite my weekly phone calls I've still not heard anything from the courts. With this in mind I've drafted a letter to the courts requesting that my case be struck out on the grounds of abuse of process by the defendant. If you could spare a couple of minuted to look over it and tell me what you think I'd be most grateful. Dear Sir/Madam I write to bring to your attention to the fact that the above mentioned claim has been waiting for action on the part the defendant for quite some time now. Over 5 weeks have now elapsed since the deadline for submission of Allocation Questionnaires, and as of xx/xx/xx the defendant has yet to file theirs. In my opinion I believe this to be totally unacceptable, with the defendant showing a severe disregard for the clear instructions set out by the Court. Therefore, I respectfully request that the above claim be struck out on the grounds of abuse of process by the defendant. In my attempts to resolve this matter without further misuse of the Courts time, I sent the defendant a letter reminding them of the aforementioned deadline dated xx/xx/xx. Please find a copy of this letter attached, also attached is proof of both postage and receipt, via the Royal Mail’s recorded delivery service. Furthermore to this I have also sent the defendant 3 separate letters, dated xx/xx/xx, xx/xx/xx and xx/xx/xx in my attempts to resolve this claim. Copies of these letters along with proof of postage and receipt can be supplied if required. Each time I have had no response from the defendant, not even to acknowledge receipt of my letters.   5. Lattie, I've sent 3 nudges to DG, also a covering letter with my AQ trying to settle the matter without wasting the courts time. I'll amend the letter to include these dates. Hopefully as you say, the court might realise that it's me doing all the running with no response whatsoever from DG.

  8. Hello all. Pete, to answer your question, when I contacted the courts last week I specifically asked if the defendant had submitted their AQ, the nice lady on the other end of the phone said no. Auburngreeneyes, they have my paperwork, I'm sure of it. I called a couple of days after i submitted my AQ to confirm that they recieved it. I think a letter of some description is called for and I'll draft one this afternoon and post is on my thread. Thanks for your support! a "can't believe the weekend is nearly over" r-t-v

  11. Hello lattie my flower, I kinda figured all I can do is wait some more. I'll be pestering the courts yet again on Monday and still expect to be fed the same junk they've fed me the last 3 times. DG will be getting a 4th nudge soon too. I read somewhere that they should reply to any correspondence, at the last count, I've sent them 6 or 7 letters, two emails and a fax and I've not heard a peep. Might write to HSBC demanding to know why there are ignoring all the stuff I send them. Would maybe also look like I'm not the one with the problem in the eyes of the Judge if it gets that far. Still, I've got all the time needed to beat those jokers, just wish I was making progress instead of having been at a standstill for the last 5 weeks. A rather laid back enjoying the sunshine r-t-v
  12. Thanks for the vote of confidence lattie!! I'm always banging into stuff! As for my claim, it's still with the judge, AQ deadline was 5 weeks ago. I've phoned the court every week since, to be told the same thing (getting sick of hearing it now) "It's waiting for the Judge to look at it, not sure when that'll be." DG still haven't submitted their AQ, (no surprise there!) and I'm about to send them my 4th nudge letter. Until the courts sort thier lives out, there's absolutely nothing I can do. Would love to "BANG" into the Judge that can't be bothered to spare me 5 minutes of his precious time! Who knows, maybe I'll go for the record! Anyone else been waiting for the courts longer than 5 weeks???? A thoroughly bored of waiting r-t-v

  21. Wounded for you Mrs Abs. Typical DG tactics by the sounds of things. Never mind, try and get your head around the court bundle so you're prepared for that stage if it comes to it. Have you been set a court date yet? a very sympathetic r-t-v
  22. It would seem that this is an odd switch in tactics by the courts. It seems strange to me that they are prepared to go down this road based on the strength of just one claim, which Lloyds managed to win. despite the thousands of others that have been lost by the banks up until this date. I wonder if perhaps this is a new tactic that the banks solicitors are trying out to put the frightners on people. just my thoughs r-t-v
  23. I got a reply from HSBC stating that they didn't keep their previous terms and conditions, (yeah right) and all the could supply me with was the current ones.
