  2. I am very annoyed with the title of this thread. "The best way to get charges back"?? Suing them is the only way that works with these greedy people unfortunately. We shouldn't even give them the opportunity with prelim. letter and letters before action but as moderators say courts wouldn't like that. I never thought I could feel so angry about a corporation..... Degrading situations they put us through when we were down. If it weren't for those charges we would have recovered much earlier from the nightmare episode which lasted 3 years. So nobody should tell us there is a better way to get these charges back which includes being nice to

  3. Hi. Sorry for the late reply I have been very busy. You are in luck. 1st get a copy of the terms and conditions for the card. As you will note, there is NO 120 day limit. You did not sign anything stating that you had to contact them within 120 days. If they say its in your TOS, look at it, its NOT there (I have looked at the online version for the Platinum credit card).   6. Hi Gary, The banks referral to the Ombudsman is a diversionary tactic, which they hope will bog you down for ages. Best bet is to start from scratch using the help and support here. It really does take a few days to get your head around all the arguments and all the information. You will be setting a timetable (the timetable that the bank says it will work to is irrelevant). In the FAQ you will find 'Step By Step Instructions.' A few pointer about the AQ: When it says 'what amount of the claim is in dispute' don't put a figure write in the box 'all of claim' When it asked for witnesses remebr to put yourself down and you are witness to 'all material facts' Estimate the trail time of 1 hours at a minimum. I'm sure they'll settle!

Start this, be clear on what your first step is (which is requesting the info from the bank as you have done already). At this point you can only claim the charges they have taken from you, and the interest THEY have charged on the charges. The 8% APR is ONLY included when you raise a claim in the court.   11. Phone them and ask them if a defence has been file in accordance with the reply pack or have they only indicated they will file. If its only an indication, then under the CPR (applied strictly) you are fully entitled to file for a default. If they say 'weel they have indicated a defence will be filed' ask them 'can you direct me in the CPR where it removes the right of a claimant to file for a default judgment only on an indication from the other party'. I had this recently. I went to court to file for a default on the 28th Day. The court staff tried to fob me off by saying 'we only accept these applications after 1 month'. I

  12. I'm with you on this one Bookworm. I work as a carer, and I see no reason why property shouldn't be sold to pay for care. As long as there is nobody left living in it, then why not? The word "home" is used a bit emotively I think, as surely it changes from being a home to a house once someone leaves it for good. I'd be more that happy to sell my home if I moved into a residential home, after all It's no different to selling and moving to another house, except from the inheritance aspect

  14. I don't know if they are allowed to do it - but they do it with great regularity. They cancelled my DD for my life cover linked to my mortgage and, yet again, didn't inform me. One thing with NatWest is they can't even claim to incur costs in sending a letter - I haven't recieved one for years!

  15. Hi - I've removed some of the "the" and "a"s and other small words to reduce the number of words. Whether this will reduce the total number of lines not sure, but the meaning is still the same? It was 194 words, 1070 characters and is now 174 words and 996 characters Neil.

  18. i do understand your position charger as seeing as its a bank holiday which means you get the day off i would like to argue the case with you but to be honest i havent got the time as some of us have to work today to try and pay back some of the banks charges which seem to go towards the works anual piss up i hope you enjoy my cash when next you have a day off sat in the garden drinking chablis.

Looking at other responses from other users etc, it seems that the Bank will always choose to defend, but more often then not offer a "deal" just before entry in to the Court of the full amount, plus interest and plus costs. They normally do this, or you go in to the Judges chambers withour the Bank and win by default , which is ideally what you want in my opinion. That is a nice tidy sum you have there
