The Fb post was made in March, it is now June, time has passed, and when the suggestion was made, no further information was given on how I should progress beyond "send a letter", which has meant that I've needed to start another stream - this one, but only after taking the time to research first.

    • Hold on @BankFodder, that was a bit harsh. I spoke with the EVRi complaints Facebook group to begin with, a user on that group told me to send a letter but didn't give any specifics. Here at CAG, I was looking more for specific help as I've never raised such a claim before, and wanted to be sure that my claim was correct, which is why I've researched information with the other groups too, to be sure; but you seem to have assumed that I've made some form of contact with the other groups, such that I find your comments and tone to be very unfair. And I do know a thing or two about forums, that forum users are unpaid volunteers, I happen to be a Tableau Ambassador, and so perform a very similar role helping others in an unpaid capacity

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I am sorry to ask another question about HFO but I have tried to find a post with my situation in vain.

 

My OH had a Barclaycard account in dispute with Lowell, who did not provide a CCA. HFO demanded money on this account in May 2010. Sent them 'in dispute' letter as advised by CAGgers.

 

HFO have come back a year later, with (as I've read on other posts) an entirely arbitrary amount of money they say is owed; hassling OH's ex-wife on the phone and threatening a charging order on the house she lives in with OH's kids. The threat-o-gram has come with an attachment saying how much court will cost us! Though the dolts have sent it to the wrong address despite OH's correct address being provided last year.

 

It was my understanding that an account in dispute, ie no CCA provided, cannot be sold on to another DCA in this manner, and that HFO cannot take OH to court.

 

Any advice - I've already sent them the 'debt passed on to another DCA while in dispute letter' - much appreciated. (I cannot read through loads of emails due to poor health.)

They are perfectly within their rights now to pass the debt to a DCA. Your best way forward is to inorm the debt is still in dispute with the original creditor and send them the Prove It letter to ask them to prove they have the right to be collecting this account. Alternatively send them a CCA request and place it into dispute with them when they can't supply the agreement either.

Update:

 

72 hr notice of litigation letter received from hfo just before Easter, lol.

 

As advised, CCA request banged off, 12+2 working days up on 13 May.

 

hfo refuses to send correspondence to current address (keep posting to OH's old house which they think they can get a charging order on, with two minor children still living in it) - refuses to deal with me as OH's appointed rep - refuses to send CCA - :mad2:

 

Today another letter (to old address): a 'schedule of litigation' with 'solicitor's costs' attached.

 

Having read Hillard's thread I take some comfort that this is all hfo's usual incompetent modus operandi. And that without the CCA they can't do anything.

 

Also have banged off complaint to TS, for once they seem to be interested and have asked for further details.

have you complained to the OFT,James Waldron, and the address is OFT, Fleet Bank House, 2-6 Salisbury Square, London, EC4 8JX.

Have you contacted Barclaycard to find out the last payment date on this and exactly which company this was sold to and when? Get them to confirm everything in writing. I imagine Lowells were chasing it for Barclaycard?? but HFO will have bought it Is there a Notice of assignment from HFO or BC? It may also be worth a SAR to Barclaycard.

And (soz for dumb question) when OH rings Barclaycard does he just need details from HFO threat-o-gram?

 

2 years ago Lowell never produced CCA on this and slunk away.

She just needs her security details as were logged with Barclaycard. As said, get the date of default but most importantly the date of last payment, and exactly to whom and when it was sold.

 

Send the account in dispute letter recorded/signed for once the 12+2 is up.

This is the most trouble we've ever had with a DCA, the nastiest, most unprofessional and most incompetent of the lot, even worse than the lovely Leeds Losers.

Posted 'Failure to reply' letter to HFO and detailed letter to Mr Waldron with several attachments such as threatograms from HFO, CCA request & proof of posting, etc..

 

Does anyone know if credit protection insurance might be an old name for PPI?

Update: Letter from OFT re my written complaint about HFO:

 

'We have ... recorded the details of your complaint, and we will consider this alongside any other complaints we have received with a view to any consumer credit licensing or other action we may decide to take'

 

Better result than last time!

 

There's an OFT consent form - don't mind if OFT discloses my details to HFO if OFT do take action. In that case, there's a dca that knows we do what we say we will.

 

I hope this encourages other people to make written complaints if they too have been badly treated by HFO.

And don’t worry – they issue lots of idle threats designed to worry you. If they’re silly enough to take court action, we’ll be here.

Dolts :razz: have sent (to wrong address!) an application form from 1980! No agreement of any sort, enforceable or non-.

 

I suppose they're hoping for an HFO-friendly judge if they plan on taking OH to court...
