      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Sent letter requesting statements which I received free of charge within 10 days! I've added up the 'charges' on the GM card and wondered if I can claim back the interest charged on these 'charges' and if so at what rate do I calculate it.

On statements monthly interest rates are 1.530% (18.4%pa) on retail transactions and 1.655% (19.9%pa) on cash advances.

I'm not sure if the charges would be counted as retail or cash but I'm sure interest will be levied against them - to be honest I'd be happy with the lower amount but still need to know how to calculate it.

Have finally got around to working out the interest and sent off my request for the repayment of £2953 (charges plus interest). Received a letter this morning as follows: -

 

Dear Mrs XXXXXX

Re: Account XXXXXXXXXXXXXXXX

Thank you for your letter dated 26th June 2006; I have now fully investigated the matters raised.

Default charges are charges payable if customers do not make the required minimum payment by the payment due date, if they exceed their credit limit, or if a payment to their credit card account is returned unpaid. The amount of these charges, and the circumstances, in which they are applied, is set out clearly in HFC Bank Ltd’s credit card agreements. We believe that our charges to customers are fair and reasonable.

The OFT has recently published the findings from its enquiry into default charges on credit cards. HFC Bank has carefully considered the OFT’s publication and does not accept its findings. However, the OFT’s investigation has let to a change in market practices and we have therefore decided, for commercial reasons and in the interests of customers, to reduce our credit card default charges for the future. These changes do not affect charges that have already been applied. Accordingly, I regret that we are not prepared to make any refund of default charges or provide any compensation payments. I hope I have been able to clarify HFC Bank’s position on credit card charges.

Thank you for taking the time to contact me to bring this matter to my attention, I am only sorry it was necessary for you to do so. Yes! Definitely carry on with your LBA.

 

The reply you received is a standard 'sod off' letter meant to frighten you off and make you think there is no point in pursuing the matter.

 

Be patient and stick with it and provided you follow the guidance in this forum, you will succeed!

Going to be taking these people on soon and have the following addresses for you.

 

Their name seems to have changed to Beneficial Finance (instead of Household Bank) - beneficial to whome? :-| PO Boc 1071 Bootle L21 2WF.

 

However on back of statement it states this Beneficial Finance is the trading name of HFC Bank let which has its registered office at: North Street Winkfield Windsor Berkshire SL4 4TD.
