      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello to all, I am in the process of sending for my 6 years worth of statements.

The account is in joint names with my husband, do we both have to sign every letter/form we send out to our local branch?

 

Can I take the SAR to my local branch with the £10 fee and ask for a receipt?

 

But in the mean time, the other day I was overdrawn, got charged 3 days worth of £ 8 a day for being so! Just checked now and they have also charged me £25...Just rung to be told that that is what they charge and they will do nothing about it, I should run my account better! They have not lowed their charges and they will remain at £25..is this right?

A little help in understanding it all would be much appreciated...

Hi there,to be on the safe side I would sign with both names.They have used this as a delaying tactic in the past.So why give them the chance to do it again.As for lowering their charges all the banks seem to be slowly falling into line with this.But at the moment they seem to be selective who they are telling.Dont worry about it though,you are going to be claiming it back anyway

Right ............after weeks of reading up on this forum I have just printed off the S.A.R - (Subject Access Request)....I am about to write a cheque for the £10 fee, do I address the cheque to Yorkshire Bank?

S.A.R - (Subject Access Request) taken into branch today with cheque. Got a receipt...

Had more hassle with them, they could not stoop any lower if they tried! They have just taken a £1500 od off us, and left us right in the ****! BUT BUT have offered us a loan to cover it ....they would then pay the CC off and close it...how bloody rude of them, the CC is all up to date being paid by DD...

Our account did not warrant having a 1500 od.....but we are good for a loan....the cheek!

Anyway the 40 days are ticking!

You could write and place the account in dispute which would mean they could take no further action until the dispute is resolved.

Thanks for the idea, but we are just in the middle of applying for a bank account with another firm, yes prolly out of the fire and into the frying pan...A & L...

But wont be doing anything until I know whats happening with that....:)

Unless you are 100% that you will never go over your OD limit be very careful with A&L. Their online statements are very misleading, and any payments out are done before money coming in so you can easily be caught out with them. Probably they are all as bad as each other though.

Thank you for that, but I do think they are all going to be as bad as each other...looking through the net at all bank accounts these seems to be the lesser of all evils LOL

OK new bank account set up, sorting all the DD etc...still waiting for any reply from my SAR....wooohooo I am going to enjoy fighting against YB.....

4th October £10 cheque cashed for my SAR, still waiting to hear something in the post.

If I close this bank account next week does it make any difference to the process?

Letter in post today saying:

 

DATA PROTECTION ACT 1998

 

We refer to your recent letter requesting information held by the bank under the terms of the Data Protection Act and note that you have paid the £10 fee.

 

We confirm that we shall be able to provide you with copies of your bank statements from Sep 2000 under the right of access under the Data Protection Act 1998.

Within the terms of the Act we have 40 days in which to provide you with the information we hold.

With regard to your request for information relating to manuel intervention on your account, there is no specific mention of manual intervention within the Data Protection Act and as such we are under no statutory obligation to record or provide this information.

Am I right in thinking the 40 days started on the day they gave a receipt for the SAR?

It starts from the date they received your letter, so if sent first class the day after you posted it.

Was taken in by hand and a receipt got for it....25th Sep....I hope they hurry up with those statements...I am guessing I will be checking them for hours

Statements came in todays post, shall spend all weekend going through them with a fine tooth comb....

Have another bank account all set up and working, took all my money out of YB bank, just waiting for a £40 transfer I made to show up and then YB will be closed down :)

Receipt from local branch for Prelim and copy of charges.

Lady behind the counter asked my husband if he had been reading the paper and thats why he was claiming charges back....he said he just smirked and said nothing :)

YB account now closed as of today, lady again said why not leave it open incase they pay you!!!! Hubby said no thanks they can pay me by cheque! LOL
