      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Well got a nice letter today from Vanquis (dated 10th September), saying:

 

'Please find your cheque (it was a Postal Order) returned, as we do not charge for this service.'

 

'The details of your enquiry are currently under investigation and I will contact you with a full response within the next 28 days.'

 

'In the event that I have been unable to fully resolve the matter by that date I will provide you with a progress report on the investigation.'

 

'You are still required to meet your obligations as outlined in your Vanquis Card terms and conditions whilst your complaint is being investigated including to continue paying at least your minimum payment.'

'I am enclosng our leaflet 'Our Commitment to You', which details our internal complaint handling procedure.'

I am guessing this is a standard response?

 

Interesting, that I haven't complained YET!

 

And Postal Order returned (not even sure if I can get my money back with this as it is addressed to them?)

Hiya, Just to let you know. I sent of a sar to obviously get my statements to see what charges i had. They sent me the statements and a letter offering me £45. I hadnt even actually requested this be refunded. I was after the statements. Well the charges only totalled £60 so i wrote a letter declining this offer telling them that i want the £60 plus interest.

 

I had a letter within a week offering me the full amount plus interest.

 

I couldnt believe how easy it was. I know its not a big amount but its still my money they have taken.

 

So i wish you luck with your claim and i hope its as easy as mine.

I fortunatly have many of the statements from them already, as I saved the last couple of years, its just the early ones I am missing, but I am pretty certain I won't have charges on them anyway. So if they play silly monkeys about sending them out, I might just proceed with the ones I have already.

 

I'll give them the 40 days and then a reminder, and see where I go from there.

 

I am pretty sure, I have probably paid a reasonable amount to them, as my credit limit was pretty high.

 

If they don't offer before I send in my prelim, I will definatly go for contractual as there interest rates are so high.

 

Currently I have agreed to pay £200 per month to their DCA, so i might look to get the default removed as well.

 

Anyone gone after Vanquis for contractual compound interest yet? Anyone got as far as court with them?

 

 

I have checked several threads, but they seem to make an offer quite early in the process.

Still no news from Vanquis....Like I am surprised.

 

My CCA is up on Friday, going to send them a reminder Monday, but I need to prepare it now, as I have to email it to get it printed.

 

Can someone please confirm, the 30 days start when the 14 days are up please? or from when I first sent the CCA? Also working or actual days please.

Well today, I got another leter from Vanquis.

 

Giving me a refund for the charges.

 

Also attached was a list of charges

 

 

And then mention in the same letter saying about the original credit card agreement being looked into.

 

Seperate letter was a statement, with a reduced credit limit!

Today a letter will go out to let them know they didn't comply fully with the SAR as no mention was made about manual intervention and as this is now with a DCA I am assuming there must of been something written.

 

CCA reminder expires on 3rd November.

 

So hopefully will start seeing some decent correspondence from these people soon.

 

I feel court coming on soon for these folks!

Well two things really.

 

The first is that they didn't refund any interest.

 

But also, if they do not have a true copy of the agreement, then the actual debt is unenforceable.

 

We will see where this one goes.

Yes but you can't have an unenforcable debt and claim charges as well, its one or the other isn't it? And surely if you've actually accepted the charges refund thats acknowledging the debt. I know I'm probably being dim here but its been a long day! Good job I've never had to do the CCA thing cos I can't get my head round it. And Cobblers (Natwest solicitors) have done my head in today as well, but they're so crap (but nice with it) that you just have to smile.

The interesting thing I guess is ..

 

I applied for statements and they refunded....I haven't accepted or even asked for charges back..they have assumed and refunded. I still don't have the statements, but a list of charges.

 

I was purely at the investigation stage, ...ask for statements and ask for a copy of the CCA.

 

I havent put in a Prelime yet!

 

I haven't acknowledge a debt or accepted the charges yet.
