      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi everyone! ok my claim is for £2671.28 including interest of £337.28 and the £120 court fee. The claim was served on the 14th of july 2007 and on the monday after the 18th thinking cobbetts had not acknoledged my claim i proceeded to enter judgement by default (at this time i had not found this site) thinking i would instantly win only for it to come back rejected as cobbetts have filled an acknoledgement of service saying that they intend to defend the whole claim. if only it were that easy lol. now it is comming up to the 28 days which i beleive is this saturday obviously nothing will happen untill next week? i'm a little unsure as to what happens next if anything and what i have to do next?? any help on the matter would be greatly appreciated thanx Ian!!

ps Down with the banks!!! lol

Cobbets served there defence on day No.28. was amazed!! but there you go. if they file, you wait for the AQ to be sent out, if they dont, I believe you apply for Judgement by default..

i entered judgement by default at the 14 days but it came back rejected now the 28 days is up but it just says Your judgment request has not been accepted. You are unable to take any further action online on this claim.?? so do i take it i now just have to wait?:?

you did it by MCOL? I would find out what court it was referred too, and then ring them up.

You should receive notification from Northampton court shortly that your claim has been transferred to your local court. Another copy of Cobbett's defence may be attached to the notification - possibly with a CPR part 18 request for further information.

yer dit it by mcol like i said i found this site after lol. ive prepared two letters now one to the courts and one to cobbetts enclosing a schedule of charges ill phone and find out as you said which court it has been transfered to if any yet and send them both recorded delivery first thing in the morning!

Ok so Next Update!!!!!! i've just rang the mcol help de sk and she says theyve recieved a defence from cobbetts yesterday and that it would be delt with at northampton not being moved to another court as all cases are being stayed??? till after test case?????:eek::mad::(:p:rolleyes::cool: any comments u guys?

hi again i've just recieved a defence from cobbetts and request for further info and clarification cpr Part 18 with regard to cpr rule 27.2(3). and although when i rang northampton court they said all cases are being stayed i've had no written confirmation on this as yet, i presume this will happen afte i've sent in my particulars etc?

You should receive written notice of the stay within the next few days.

 

In the meantime, make sure that you respond to Cobbetts intimidatory request for further information. Click on the link in my signature for Nat West Claimants and scroll down to the CPR part 18 info - you'll find a link to a short letter to send to them along with a copy of your schedule of charges. Make sure you keep a copy for yourself as well. :)

Wadsi, don't send a court bundle off - you only put your bundle together/send to the court and Cobbetts when ordered to do so by the court (e.g., when you receive your final hearing date). It wouldn't make sense to the court or Cobbetts if they received your bundle at the moment ;)

1) Following the filing of a defence or holding defence the claim shall be stayed pending judgment in the office fair trading test case.

 

2) Liberty to apply with an explanation.

 

Note: Any Party Affected by this Order may under rule 3.3(5) apply to have it set aside, varied or stayed. such a party must apply under rule 23.3 within 14 days of service of this order.

 

then attatched is a copy of cobbetts origonal deffence saying it was not particularised. etc crap18times

Phone Northampton tomorrow and ask if they've received your request to lift the stay. Ask for further advice also - they'll be able to let you know if applications to request stays be lifted are being considered and, if they are, if there's a charge to do so. :)

ok so ive just had a letter saying my case is being transfered to nottingham county court for the court to deal with the claimants application to rmeove the stay.

 

the court will refer the application to a judge, or if there is to be a hearing. will send you and other partys notice of that time date place of hearing.

1)the claimants letter stands as an aplication for leave to lift the stay

 

2)no fee payable

 

3)transfer to claimants home county court

i take it this is a good thing i was thinking of giving up!! i presume i should wait now? in the meantime i shal read up on what an allocation questionair is????:cool::confused::D

With regards to the AQ, if it's been dispensed with you can still apply for the draft order for directions. However, I'd be inclined to wait and see if the stay is lifted before you do this.
