    • Yes, it was, but in practice we've found time after time that judges will not rule against PPCs solely on the lack of PP.  They should - but they don't.  We include illegal signage in WSs, but more as a tactic to show the PPC up as spvis rather than in the hope that the judge will act on that one point alone. But sue them for what?  They haven't really done much apart from sending you stupid letters. Breach of GDPR?  It could be argued they knew you had Supremacy of Contact but it's a a long shot. Trespass to your vehicle?  I know someone on the Parking Prankster blog did that but it's one case out of thousands. Surely best to defy them and put the onus on them to sue you.  Make them carry the risk.  And if they finally do - smash them. If you want, I suppose you could have a laugh at the MA's expense.  Tell them about the criminality they have endorsed and give them 24 hours to have your tickets cancelled and have the signs removed - otherwise you will contact the council to start enforcement for breach of planning permission.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Please can you help me in what i should do.

 

I use to be a member way back and have already started the ball rolling sometime ago.I got to the stage where they offered £720.00 which they paid straight into my account,Which then isaid i would accept but NOT as full payment and would persue the rest.

 

I never heard from them again ,Time passed i got cold feet but now i feel stronger to fight them how do i go about sending letter to say that i am taking them to court if they do not pay me.

 

It as been over 6 months since i sent them the letter about i accept as part payment.

 

Do i just send the letter and see what happens/LBA?

should i put cover note in explaining why so long?

 

 

Or can you advise which template.

Also will get help as now i am unemployed.

Not sure on how to advise you I'm definatley not an expert. How far exactly did you get last time...did you set them any time scales e.t.c to comply with?? If not I would just continue where you left off.

 

But would definatley check with the more experienced members. I'm sorry not much help...but will try where I can. Good Luck

Hi Jilly

 

Was the GoGW payment in response to your LBA? If so, then you can start Court proceedings now.

 

You set the timescale originally, and you do NOT have to justify the delay.

 

However, if the GoGW was in response to your Prelim letter, then you will have to send an LBA before proceeding to Court, but again you do not have to explain the time delay between your original request and now.

 

The LBA will most likely be ignored, but as you iniatiated the "complaint" before the OFT announcement, it should not be subject to the constraints imposed by said announcement.

 

Let us know exactly what steps you have taken so far, and then we will be able to help you further.

 

"We" being the "royal we", that is :D - I am still a basic novice, but very willing to help out if and when I can!

Thank you for the responses help is very much appreciated.

 

I got to the stage where i sent LBA

 

They responded with we will give you £720.00 as a gesture of goodwill,then the same of boring dribble.

 

I responded with thank you for the offer i do accept but only as part payment and will pursue the rest with a county court claim (used template letter response to settlement offer).

 

That is where it got left i got cold feet as they did not respond after this ...

 

So what do you advise i do ...

 

I was just going to send them response offer again and this time if they did not reply i would pursue in court.

 

Or shall i just send in the court proceedings online.

 

I am also now unemployed so how do i go about to see if i can get court reduction or help with paying the court fee....If i apply online.

Okay, so as you have followed all the steps so far, your next course of action is the Court claim.

 

May I say I would strongly advise against filing online; you are very limited for space on the online form, you cannot send your schedule of charges off with it, and then once it clears the system it is typically transferred back to your local court anyway.

 

With the N1 you can send attachments etc, and it goes direct to the local Court. Here is the revised PoC for the N1 taking into account the test case (which will not fit on the MCOL form):

So i need to send n1 along with list of all charges and just put on the bottom -£720.00 which they gave me a Gogw.

and hand it in to my local court and ask for a exemption form for not paying court fees as i am now on family tax credits.
