hi Ive decided to send another LBA and request payment,If no response in 7 or 14 (which shall i use)days.I will goto local court and file N1. I think this is best considering time delay response.

also do i claim for interest at this stage????

So i need to send n1 along with list of all charges and just put on the bottom -£720.00 which they gave me a Gogw. and hand it in to my local court and ask for a exemption form for not paying court fees as i am now on family tax credits. I got to the stage where i sent LBA They responded with we will give you £720.00 as a gesture of goodwill,then the same of boring dribble. I responded with thank you for the offer i do accept but only as part payment and will pursue the rest with a county court claim (used template letter response to settlement offer). That is where it got left i got cold feet as they did not respond after this ... So what do you advise i do ... I was just going to send them response offer again and this time if they did not reply i would pursue in court. Or shall i just send in the court proceedings online. I am also now unemployed so how do i go about to see if i can get court reduction or help with paying the court fee....If i apply online. Thank you i await your replys ....

I use to be a member way back and have already started the ball rolling sometime ago.I got to the stage where they offered £720.00 which they paid straight into my account,Which then isaid i would accept but NOT as full payment and would persue the rest. I never heard from them again ,Time passed i got cold feet but now i feel stronger to fight them how do i go about sending letter to say that i am taking them to court if they do not pay me. It as been over 6 months since i sent them the letter about i accept as part payment. Do i just send the letter and see what happens/LBA? should i put cover note in explaining why so long? Or can you advise which template. Also will get help as now i am unemployed. thanks in advance

hi bish I received a letter from abbey today and they basically saying they will pay no more so off to court i go. Just a few quick questions: 1)Filling the N1 form in where do i address to? 2)How do i pay the court fees (is it directly to the courts and have cheque written out when handing this form in?) i sent letter and gave them 7 days the time is up tomorrow. I have just found out today that they have paid in the 720.00 into my abbey account . I did send letter saying i would except but persue the outstanding amount. Just wondering what my next step is if they dont reply. thanks

update To my surprise i have received a letter from abbey today offering me £720.00 ,Should i except this as partial payment and persue the rest ,I am just going to check out templates to see if there is a letter i can use. Any help would be great.....

Hi Just about to send off me data protection request for statements .I have 2 accounts i see i can put 2 account numbers on,But do i only send one £10.00 for the 2 account requests. thanks in advance p.s I assume that i just use the address off one of my statements i have where to send data request to.

Update: I received a letter today from abbey Dear ***** As you know,we are currently investigating your complaint that you raised with abbey four weeks ago .I am sorry for the delay you are experiencing and i would like to take this opportunity to thank you for your continued patience. Our research is taking longer than expected because we want to make sure a full investigation is done. If we are unable to complete our investigation beforehand,we will write to you again in four weeks time to let you know how we are getting on. I am sorry that it is taking longer than originally thought and would like to reassure you that your complaint is very important to us. yours sincerely marc winder I assume this is a standard letter to buy time with shall i jus twait the 14 days (which is the 19th september )and then send them the http://www.consumeractiongroup.co.uk/forum/bank-templates-library/92-letter-before-action-consumer.html is this the right template to send them after the prelim letter as gone in. I to have noticed abbey is not charging me overdraft interest anymore since putting the claim in.They where charging me around £80.00 a month in interest but have stopped this now so i am on a winner already thanks to you lot and this site.....Just got to get the bulk back now ........ cheers

hi Jonni2bad I have already done the non-compliance i used template 2.The letter above is what they sent me on the 7 days notice form the non-compliance warning.The letter is the same as the 1st letter they sent when i done the data protection act but they still have not sent statemnets for the last six years. If they dont come by the end of week should i phone them to see where they are and state dates i require??? regards

They are card cash statements dating back to when i 1st opened the bank in 1995 upto 2000.I did not use the bank as my main bank then. What i thought they would send would be 2001 - 2006 which is the last 6 years when i used the bank as my main banking and it would be when i incurred the charges. I sent them template letter two for non-compliance but have not heard anything as yet but they have until Thursday 7th september to answer. So shall i just wait and see. thanks jill

Please can someone advise ,On what template i should send ,I have received some card staements 4 in total with hardly any transactions on these are dated 1995 -2001 ,It looks like they have sent my first 6 years not last 6 being 2000 - 2006 ,Do i send template 2 or template 3 ,The deadline is tomorrow !!!!
