      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello! I have decided to start my own thread to note all the steps of trying to claim back my bank chages with Lloyds TSB.

 

Everyone on here seems really helpful and its good to read all the other threads.

 

I posted my DPA letter last week, Wednesday 14th June, by Recorderd delivery, with a £10 postal order included.

 

I sent it to the customer care department. I really hope that was to correct place to send it as I have heard nothing back as yet! fingers crossed.

 

I will keep you posted....

Customer Care, Colmore Row? If so, I wouldn't worry too much - I think it's the correct address in any case, but if not they'll forward it to the correct department. And, if they don't do it in time, there's always the chance to report them to the Information Commissioner :D

 

Do you bank online with Lloyds? It's fairly straight forward getting a list of previous charges from the Lloyds Online banking site, although it doesn't go back the full 6 years.

Hello,

 

yes I sent it to Colmore Row, so they should have it.

 

Rergarding Online Internet Banking. I have been having trouble with it for the past 5 months or so. It was not accepting my user id. I sent off for a new one the other day and it has just come through, so I can now see all my statements online! Typically, after I have sent my DPA letter!

 

One question though, when I search for charges, I get the following...

 

Over Draft Excess Fee

Account Charges - normally £5

Unpaid DD

 

Do I claim for all these??

 

I am shocked already and a bit upset! I cant belive how much I was paying out in charges each month.

The £5 account charge is Lloyd's fee for running your account, so you can't claim that one back. Overdraft Excess Fee and Unpaid DD on the other hand, you can claim to your heart's content :)

Ok, I just remembered I paid £5 a month for the account. Thats fine..

 

Do many people bother claiming back the Over Draft Excess Interest? I cant find a spreadsheet to help work it out. I am not sure if you have to pay for it or not.

 

So far it adds up to about £900, thats just for OD Exccess Fees and Unpaid DD's.

You can claim back the overdraft interest on penalty fees that have sent you overdrawn - for EG: Say you have a £500 OD limit, £200 of which is your own and £300 of which is penalties, you could then claim the interest on the £300.

 

There is a spreadsheet available in the templates library, but to be entirely honest - it's more often than not much more hassle than it's worth.

thats what I thought. I wont worry about the interest fees then.

 

I have downloaded all my statements online, but I will also wait for Lloyds to send me copies as on the internet, it wont let you go back 6 years, so I may have more I can actually claim back.

Hi everyone! Not been on here for a while. Just an update and some advise if anyone has it...?

 

I posted my DPA letter on Wednesday 14th June by recorded delivery. I know they received it as I went onto the post office website and tracked it. well its now the 11th July. so its been 26 days so far and I have heard nothing from them . No bankstatements or anything. I know they have another 14 days, but is it normal for tem to take so long??

this was my timescale Lloyds TSB Data Protection Act (SARS) request sent 9th June 2006

Data Protection Act info received July 5th

, mind you i rang them on July the 3rd and they started by saying they had not received it i stated you have because i sent it recorded delivery and i had the proof from royal mails website 2 days later they arrived, i would give them a reminder phonecall, phone the Copy Statement unit Swallow house Birmingham.
