      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi everyone,

 

spent along time reading this site and finally decided it was time to start for myself.

 

I don't have all my statements so yesterday I sent of the DPA letter asking for the last 6 years of statements, but my guestimate from the records I do have is around £2250

 

My main problem is that I spend most of my time abroad working and so I think the initial part of the process will be a little slow.

 

I do however already have another bank account, but hardly use it. Time I think to start moving things over before the Halifax get difficult.

 

Will keep things posted as and when they happen.

As I'm away from home, finally got some statements when my family arrived yesterday with 27 envelopes.

 

Also got a letter from Nicolla Inett, Data Protection Consultant telling me al my requested statements have been ordered.

 

Got all the requested statements for the first account. 127 sheets, but for the 2nd account they have only sent 4 pages covering the first 6 months of the 6 years requested.

 

Anyone have a number for NIcola so I an call and tell her they have 18 days left to provide what I asked for (based on the date of the halifax reply) or should I wait the 18 days and then claim they have failed to abide by the DPA request.

 

After all if they can get it right for one of the accounts they can hardly say they misread the letter when both accounts were mentioned on the same letter.

 

Well now to wade through the sheets for the first account and see what the total comes to.

Hi Everybody

 

I've decided to chase the bank for the thousands they have taken off me over the years. I sent a letter to the Halifax requesting information on the charges that had been applied to my account over the last 6 years. They wrote back to me telling me they had 'no legal obligation to manually invervine in my bank account and that they had ordered copies of my statements to send out to me. They said the copies would be with me for the 15th July but guess what? Yes! I've had nothing yet. I have just come back off holiday and due to unforseen circumstances (being overweight with my baggage on the way back) I have been forced into an overdrawn position on my account. They have paid two direct debits ( which is a first because they don't usually pay them) and charged me £88.00 for the pleasure. I have tonight talked to the Halifax about the excessive charges that have been applied but they were insistant that they are doing nothing unlawful. I will talk to customer complaints tomorrow about the missing statements. What will I do if they don't send them?

10/08/2006 Received Halifax letter offering me £178.00 (goodwill gesture):rolleyes:

11/08/2006 Sent LBA letter out excepting goodwill gesture but not as final settlement. Persuing the rest in court.

01/09/2006 Taken the claim to County Court.

05/06/2006 Claim sent back by the courts... I hadn't put the court address in the top right hand corner :x Took it back to the court 06/09/2006 won't get issued until tomorrow ........... if I'm in luck!

08/09/2006 Received 2nd offer of £524.00. 09/09/2006 claim is served :D .

13/09/2006 I WON, I WON, I WON. Full monies paid back.

Been a while since I added anything here due to a few internet access dificulties but in the mean time progress has been made of sorts.

 

Brief history:-

 

Account 1:-

 

Wrote to the halifax asking for the charges refunded waited and was in the process of drafting the LBA when a letter popped through the door offering £880 in respect of my claim for £3121. I therefore included the no response in my LBA.

 

Just after that I recieved the letter telling me they had applied a default to my account. (I stopped using it when I sent my request for refund, but they continued to add charges). I therefore wrote a 2nd letter also demanding the Default be removed etc.

 

Tomorrow is the deadline for them before I start the court claim.

 

Account 2:-

 

Wrote the lBA demanding the statements they had failed to send me. They eventually arrived while I was away on buisness so was a few weeks before I could go through them. I was pleasantly surprised that they had only charged me £69 in 6 years, so I will concentrate on account 1.

 

I have calculated that since my orgigianl request they have added a further £580 in charges. So with Interest at 8% I expect to be claiming £4265 plus the cost of making the claim and the £10 charge for the statements.

 

I have a busy day at work tomorrow so I expect to start the court ball rolling on Tuesday.
