hi there peeps, i have a bit of a problem? i had new brakes fitted on my delica by kwikfit front and back took it for an mot to find that the bolt was missing from o/s rear brake caliper mot station refused to continue with the mot and abandoned it. reasons for refusal the condidition of the vehicle is such that, in the opinion of the examiner, a proper examination would involve a risk of injury to any person or damage to the vehicle or other property. hence had to leave it at mot station. i took a photo of the missing part contacted kwikfit who then came out to the station to fit a new bolt on the caliper.

i question the fact that if we had not taken it for an mot we would never of known it was missing and infact took all 6 kids out before the mot on an outing without knowing it was missing.

i have contacted kwikfit area managers who now offer refund on brakes totalling to £134.00. saying no need to cantact a solicitor.

do i accept this offer or do i have a case to take things further?

any help would be much appreicated

thanks

someone said cause it didnt cause an accident there is no compensation to claim for what might of been they are just trying to protect there reputation!!:(

If they have refunded the cost of the work, put it right, and paid for the retest then I agree that no further compensation is due. Trading standards might be interested in investigating, however.

Post by me are intended as a discussion of the issues involved, as these are of general interest to me and others on the forum. Although it is hoped such discussion will be of use to readers, before exposing yourself to risk of loss you should not rely on any principles discussed without confirming the situation with a qualified person.
