    • I plan to send the new begging letter as following, can I ask for some suggestions?   Dear Investigator/Prosecutor,   Thank you for your reply. I deeply regret my actions and the inconvenience they have caused.   I’m extremely remorseful for my crime. and regret it everyday. I often ask myself ‘’how can I do that thing just because I felt it is interesting. There are a lot of crimes in the world, but feeling it’s interesting is certainly not a reason to crime. I should not crime with any reason.’’ I think about these things every day, and I understand that I can’t blame anyone but myself.   I thanks to the staff who stopped me, as this is a valuable lesson in my life. I told myself that I should never ever repeat such a thing again, and never ever do anything which is possible to be in breach of any law. As a result, I carefully tap my oyster card every time before I enter the station now. I remind myself that I did a wrong thing before, and I should never let it happen again.   Although my monthly travel expenses do not warrant a season ticket, but I just renew my season ticket (please see the attachment). I understand that a crime cannot be truly compensated for, but purchasing a season ticket offers me a small measure of comfort, knowing that my actions caused a loss to the public interest.   I received an email which ask me to negotiate being class teacher in this summer (please see the attachment). I hope that I could teach the lovely students again, which may not be allowed with a criminal record. I would please ask that you would please provide me a single opportunity to settle all outstanding sums owed outside of court without the need for legal proceedings which would have a determinantal impact on my teaching career.   I sincerely apologise again for my crime.     • Utter Rubbish!! lowell dont write and beg for deals once they start court. as for your attitude, we'll thats nothing new for you.😎 you wont be quizzed, it's not like TV, simply refer to your defence/WS when answering anything the judge may ever ask. well it involves chickens. dx

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello All,

 

I sent in my request for copy bank statements on 14/05/07, before finding this site. Anyway I believe this is a SAR giving the 40 day time limit.

 

I got a reply dated 04/06/07 saying received my request and I should receive a response no later than 40 days "from when we received your original request".

 

It is now 47 days and I have heard nothing more.

 

It seems my options are to:

  1. Write to Information Commissioner and complain
  2. Write to HBOS and advise them they are already out of time

It would appear without my copy bank statements I can not request my money back?

 

I will keep reading and see what the best course of action is but any pointers and advice most welcome.

The banks are absolutely swamped with SARs requests.

You need to write to them and point out that they have not comlied with your SARs. Click on the following link.......

There are a number of options here depending on circumstances. Pick the letter that is the most suitable for your claim. Add your details and send it off to the bank.

If that does not elicit a favourable response then send a written complaint to the Information Commissioner's Office.

Reading is a good method. Most points will be found answered in threads on this forum.

 

Statements are a real problem just now, so that affects things. Did you ask for a full banking history as that, so they say, takes 40 days (not that it should). Statements, they say, take 7- 10 days dependent on who tells you.

 

You sent the £10 cheque? Thats important as some people don't send it as they have "heard" they can get it free of charge. However, the fee is reclaimable anyway as part of the process.

 

You will soon pick up on which threads to read through. Ask any questions as you need to!

I requested a comprehensive list of all default charges for DD's SO's and unauthorised overdrafts over the last six years adding if they were unable to provide this data I will accept copy statements going back 6 years.

 

Yes I sent the £10 cheque drawn on the same account and it has cleared.

 

Cheeky bankers took the cheque but did not send the info I have paid for and that the Data Protection Act requires them to issue.:mad:

 

Anyway slowly slowly catch the monkey:)

I have followed up on the previous posts - thanks for your help and guidance.

 

I have drafted a LETTER BEFORE ACTION Section 7 – Data Protection Act 1998 (template 3) to gee them up on getting the bank statements to me.

 

I have a claim against HSBC running as well (I have Bank Statements for that account) so that will help me.

 

The letter go out on Monday 02/07/07 which gives them until Monday 09/07/07. I wonder what happens next?

I'm in Manchester and it's p*ssing down again as per usual. Why am I in Manchester?????

 

Yep I have started so I'll finish.

 

I have also had a word with my Mum who just ahd an offer from HBOS to settle and I have advised her about this sight and that she is also entitled to interest in relation to the charges. I have agreed to look at it for her and give her the figure before she accepts the offer made.

Make sure your mum does not accept a partial offer and get her on here to the relevant bank forum.

There are difference in every case and it is easier for everyone, and you, to keep a track of what is happening to individual cases.

UPDATE! UPDATE! UPDATE! UPDATE!

 

I have the bank statements at long last, I received them last week but have just opened them. They have sent two lots of bank statements for the same six year period. A bit like a bus!!!!

 

My 1st request was back at the beginning of May and they have set them for August backwards so I am in effect missing 3 months of statements. I smell a rat or could I be getting paranoid and it is just incompetence?

 

I will now use the calculator spreadsheet to add the the total charges and apply the interest element.

 

Oh yeah I nearly forgot, they sent me a letter about 5 weeks ago saying the charges were approx £1K. It will be interesting to see how accurate that letter was.

Did you complain to Information Commissioners Office, they are very helpfull and will push for other statements if you ask them to they respond very fast to Emails and telephone calls I have found.

Halifax 2 N1 submitted 20/07/07 stayed 24/08/07 N244 Application filed 31/08/07 hearing set for 12/11/07 rescheduled for 29/01/2008. Application dismissed stay still in place.

Charity Group £200 compo for lost passport.

HM revenue & Customs; demand for WTC overpayment £632.12. Disputed, their error. Did not have to repay.

All opinions expressed are my own and have no legal standing and no connection to CAG

 

All errors/typos etc are not my fault the blame lies with the spelling gremlins

If they have missed any statements, you will need to send them the non compliance letter..

Hello to All,

 

Just revisiting this after a long spell of major problems which meant I could not proceed. I will be looking at the site and posts to get up to date with the current state of affairs.

 

In the meantime HBOS have been charging me regular fees on my account, which is seriously annoying.:evil:

 

They have also just given me 2 weeks notice on my overdraft:mad:

 

Anyone give me a brief overview on what is happening at present?
