    • Tagging @stu007 who's great with this. You should have at least 2 months notice with a Section 21 notice (Which Form 6A is used) For now, scan, redact and upload anything you think will be useful
    • That's fine.  The important thing is to show Kev you're trouble and so best to drop you like a hot potato. Invest in a 2nd class stamp tomorrow - all Kev is worth - and get a free Certificate of Posting from the post office.
    • Do not under any circumstances plead guilty until we know what we are dealing with. It's a sure way to 9 points. The tried and tested way to handle this is to plead not guilty to both charges and offer to plead guilty to speeding provided the "Fail to give information" charge is dropped. But I am concerned about this "ticket refused" sticker. I've never heard of this before. A "ticket" is not a term used in connection with speeding offences. There seems a distinct possibility that your response was received by the police but one thing worries me: I've never heard of a sticker being placed on a response and it being returned "Return to Sender". t's just not what ticket offices do. If you could post a picture of this document and the sticker it might help.  If you can show the response was received you may have a defence to the "Fail to Provide" charge (provided you completed your response properly). If the police are saying you did not respond they cannot succeed with a speeding charge (as they have no evidence you were driving). But if you did not respond, who put the sticker on the document and sent it back yo you?
    • lolerz, many thanks for your reply and correcting my big mistake, oh dear start again. They sent the section 48 along with the Form NO 6A, it was sitting on top of the paperwork, sorry about that. SO they have sent me a Form No 6A and i have received the court paperwork with the claim form and defence paperwork.

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi there,

I live in Scotalnd and am looking to claim £1726 + interest from Abbey. I see I should claim through the English courts for this amount using MCOL or N1 form.

I have a few queries:

Firstly, what local county court I would submit my claim to - the Abbeys registered address is London so would it be there?

Secondly, is likely I would need to appear? I am pregnant and so this could be a problem!

Thirdly, would it be better for me to claim from a Scottish or an English address?

If anyone has any experience or advice I would be grateful.

Cheers!

Firstly, what local county court I would submit my claim to - the Abbeys registered address is London so would it be there? yes it would be a london court local to there headquarters, shouldn't be too difficult to locate.

Secondly, is likely I would need to appear? I am pregnant and so this could be a problem! It is not highly likely you would have to appear, it is still quite rare, but, before embarking on such action, you should be prepared to appear if neccesary.

Thirdly, would it be better for me to claim from a Scottish or an English address? If you are using MCOL you require an english address for correspondence, if you are using N1 you post them to the court and can use your home address

hope this helps

Thanks for the quick response!

So, if I used a English address (I have a family member not far over the border) then the local county court could be there instead of London?

I'm considering dropping 226 quid off my claim to make it easier and claim from Scotland but I grudge it being a tight fisted Scot!

Spot on - you could also use MCOL if you wished. Also even if you dropped the £226 and used the Scottish procedure you would still be using summary cause rather than small claims. Personally I would go with the full claim and use the English system.

I’ve received another letter from Abbey informing me that they are investigating my claim but are not yet done. I have now received 5 of these letters to my current address. I’m also getting duplicates sent to my old address even though the address was changed a year ago and they keep addressing the letters to my husband even though everything has been sent by and signed by me. I’ve written to them to complain about the address change and asked them to respond to my letters directly and not to my husband.

However, I’ve pretty much confused myself. Should I use MCOL or N1? Bearing in mind I do have access to an English address and my claim is 1726 quid before interest.

Also, The interest calculator – should I use the English or Scottish one – I’m assuming English but just want to confirm? I’m chasing my tail now and I just want to get my court claim sent off as soon as possible so please help!

Cheers!

With regards to the interest calculator, if your using the English system use the English calculator.

  • 4 weeks later...

Hey,

I decided to pursue my claim through the FO after receiving a letter from Abbey saying they were unable to complete their investigation within the 8 week limit on Friday. However, today I got an offer of £270 which will be paid into my account within 10 days. I have my rejection letter ready to go but if they go ahead and pay it into my account - can I spend it or should I leave it sitting there until the FO investigation is complete? I have not sent my FO form away yet but will be doing it this afternoon.

You can either reject it or accept it as partial settlement and pursue the matter with the FOS. Rejection letters are here http://www.consumeractiongroup.co.uk/forum/bank-templates-library/25716-rejecting-offers.html
