  1. Hello, I was delighted to receive my extract for payment this morning as the bank didn't lodge a defence in my case. I see that there are letter templates for the English system but I'm in Scotland and I'm not sure if there's a specific letter I should be sending the bank requesting payment based on the decree? Also, how long should i give them to pay up? Many Thanks Funky1
  2. I'm still confused - sorry:confused: I understood that as the bank had not given a defence by the return date then that was an end to it? The court told me yesterday that I needn't do more and just wait for payment now but it seemed too easy. Also, this is in Scotland - if that makes a difference?
  3. Hello, The return date for my BOS claim was Friday and when I called the court today they said that BOS had not submitted a defence (which is apparently very unusual). I've to hand in my Form 11 by Wednesday stating Decree + expenses. Does this mean I've won?
  4. Hey, I decided to pursue my claim through the FO after receiving a letter from Abbey saying they were unable to complete their investigation within the 8 week limit on Friday. However, today I got an offer of £270 which will be paid into my account within 10 days. I have my rejection letter ready to go but if they go ahead and pay it into my account - can I spend it or should I leave it sitting there until the FO investigation is complete? I have not sent my FO form away yet but will be doing it this afternoon.

My court date is 3rd August but I received a letter today from BOS advising that after investigating my complaint they are satisfied that the charges are correct, why they were applied and how they (BOS) can help. I'm assuming this is just standard and I should ignore it and wait for the court date?
  7. I’ve received another letter from Abbey informing me that they are investigating my claim but are not yet done. I have now received 5 of these letters to my current address. I’m also getting duplicates sent to my old address even though the address was changed a year ago and they keep addressing the letters to my husband even though everything has been sent by and signed by me. I’ve written to them to complain about the address change and asked them to respond to my letters directly and not to my husband. However, I’ve pretty much confused myself. Should I use MCOL or N1? Bearing in mind I do have access to an English address and my claim is 1726 quid before interest. Also, The interest calculator – should I use the English or Scottish one – I’m assuming English but just want to confirm? I’m chasing my tail now and I just want to get my court claim sent off as soon as possible so please help! Cheers!
  8. Hiya, Was ready to send off the non-compliance letter on Saturday and the statements came in that day. They were all jumbled up and not in any date or year order -I think maybe they are trying to be as awkward as possible?! How are you getting on with your MCOL claim - have you raised it yet?

Hey there, I have a niggling feeling that Shabbey didn't send me a complete list of charges, only a summary spreadsheet and I'm not sure that it covers the entire period I've had an account with them only now that I've issued all the letters before court action have I realised - doh! However, I'm firing ahead anyway and will get my head around it tonight.   11. Well I submitted my claim to Kilmarnock Sheriff Court on Friday and I must say they were very helpful. I was pretty intimidated by the whole court thing but the lady who checked over my wording said it was perfect - a big thanks to CAG ! I hope this encourages others. I did however only have to pass over form 1 and 1b. She said that the banks were defending more and more and BOS was turning up on the day too. Any worries or questions to just give her a call. She reckoned my date would be 3rd August. I'll keep you posted.

  13. Thanks for the quick response! So, if I used a English address (I have a family member not far over the border) then the local county court could be there instead of London? I'm considering dropping 226 quid off my claim to make it easier and claim from Scotland but I grudge it being a tight fisted Scot!
  14. Hi there, I live in Scotalnd and am looking to claim £1726 + interest from Abbey. I see I should claim through the English courts for this amount using MCOL or N1 form. I have a few queries: Firstly, what local county court I would submit my claim to - the Abbeys registered address is London so would it be there? Secondly, is likely I would need to appear? I am pregnant and so this could be a problem! Thirdly, would it be better for me to claim from a Scottish or an English address? If anyone has any experience or advice I would be grateful. Cheers!

  16. Hi there This is my first claim and das it’s for around the Scottish Small Claims limit I’m hoping it won’t be too difficult.I’m in Scotland and my nearest court is Kilmarnock. So here’s where I’m at and would greatly appreciate any advice you can give me: 9th Feb 2007 – Requested Statements Received Response in April – charges amount to £753 (788.68 incl. interest) 18th April I sent 1st request for repayment of charges – Deadline was 4th May 1 week later HBOS advised they were considering my claim and would give me an update in 4 weeks 27th April I sent another letter re-affirming deadline of 4th May 4th May I sent a letter to advise that I would commence court proceeding if no response received by 18th May. I have not yet started the court proceedings but don’t want to hold off much longer before I make my next move. I have seen the FOS mentioned at this stage – is this the route I should be taking or should I just fill in my small claim? (This is my first claim – I have a larger one for Abbey which is for around £2k and I will be at the court stage on 1st June for that one. ) Received a letter from HBOS saying they would get back to me no later than June 20th. My deadline for them was 18th May - should I wait or move forward. Still v confused about whether to do a small claim, go to the FOS and now I've read about a summary cause. Can someone help please?

  18. Hi there, I'm new to this so just finding my feet. I'm from Ayrshire, Scotland and I have come to this site from Moneyexpert. I have issued all my letters and I am now at the stage where I start the court action and I am now very confused! Hope to pick up some help as it has all of a sudden become a bit daunting!:o
