    • I live in a student house, with 5 tenants, unihomes is our utilities provider, who we each have a direct debit set up with and have paid each bill every month. Two letters were sent in my name by BWLegal saying I had two outstanding payments due adding up to over £3500, I have tried to contact british gas (as that is apparently our houses provider) as well as Unihomes. Nothing has helped and BWlegal are pursuing legal action if these debts are not resolved by the 1st May. What do I do? I've called Bwlegal when i bring up that the debt isnt for me and for unihomes they hang up on me. so I am stressed and do not know what to do

    • Hi, everyone. I received a letter from TfL investigator/Prosecutor. The letter reads as follow:   ''Thank you for responding to our enquiry letter. Your comments will be taken into consideration when reviewing whis case and we will contact you as soon as we have reached a decision. TfL now consider prosecution against passengers who are in breach of all TfL byelaw offences and I must inform you that further legal action may be taken. TfL byelaws can be found at ... Please do not hesitate to contact me if I can assist you further.''   The letter was sent 23 days after I replied to them. Should I send another begging letter to IAP? I'm extremely scared now. Thanks all.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi Conalot,

Junkimunki ere attended court @ Derby today in view of YB "administration error" forgot to note date to return documents [as if....],do pigs fly nowdays ...... the Yb had put an application forward to the court on 4th September 2007 for an order to SET ASIDE A Judgement in Default order, that was granted to me on the 16th August 2007, by District Judge Douce , whereby the hearing listed for August 21st was vacated.

 

Judgement was entered because of their NON COMPLIANCE of an order made by District Judge Butler on the 27th June 2007, the YB had made this application and ticked that they did not want a hearing .

 

I was called in , I explained my case and gave in a letter that I had put together with all the happenings and discrepancies so far , also at the very last minute I mentioned that this money had been taken from my benefits , the Judge then replied that HE HAD STRUCK THE ORDER OUT, leaving me to claim the Judgement. gonna fax them tomorrow and request payment by return !!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!:D:p :p

Thanks to everyone who replied ,

The Judge did say that they might appeal to this decision, but hey so what I can fight that as well, I have enough stamina to see that they pay whats rightfully mine at the end of the day.

 

Just keep at em , follow them everywhere like a bad smell,

come on everyone just keep fighting and giving them HELL,

I am preparing arguments ready in view of this and with what I have listed fails to work I will appeal myself against the jerks.

they NON COMPLIED to an order dated 27th June 2007, acknowledged this on 4th Sept by admin error , which they seem to be making loads of at the minute, not Just mine of course seems the admin staff are continually making the same mistake , and what a coincidence it seems other banks have employed the same admin staff who make exactly the same mistakes , they must have all come from " The Royal Academic college of ERRORS", I wouldn't go there for anymore staff LOL LOL LOL

 

 

I wish I had this persons capability of hindsight ESP call it what you like,,,

On 26th April 2007 ******* raised a claim against the bank.

This was received on 27th April 2007, an Acknowledgement of Service WAS FILED ON THE 13TH MAY 2007,,,,, I would use this special gift to more advantageous use than this, possibly enter the lottery ???? LMFAOROF **********

not been on for a while been trying to get my head round removing a stay. well dont need to worry now, went 2 my hearing an hour ago to remove it, whole thing lasted 10 minute.I said that a BBc news report indicated that the OFT test case would be settled and that the issues with my case would be inconclusive, the judge said that this was not fact and only hearsay, i said that if the OFT case goes to a hearing it could take up to 2 years, he said that the OFT case was on the fast track and any appeals would also be fast tracked and the case would probably be over by mid 2008, I said the it would interfer with my right for a expediante hearing, he said that the european courts considered anything up to 2 years a reasonable time. I dont think it helped me getting tongue tide. so round one to YB. but its not all bad news? i found a pound on the way home. would like to thank everybody on this site for thier advice and support and good luck to anybody waiting to go to court

hello gizzard2k, whereabouts was your court? sorry that your removal of the stay did not go to plan. I am going to court on the 15th to try and get mine lifted but I have a feeling that the courts are just going through the motions and that no-one will get their stay lifted. Did YB send anyone? what was the court like? just around a table or witness box etc? sorry for all the questions I just want to know what to expect Hils

hi hilarry

yorkshire did send somebody,it was a T shaped table judge at the top and us either side and u address the judge as sir, i kept forgeting and saying your honour felt like a right lemon when i came out and realised. i forgot to put in my last post about the injunctions ( the one about banks closing accounts and still charging penalties )he looked at me and said that without evidance i couldnt ask for them

just an update chaps havnt been on for ages but am now getting in gear for my hearing on 13th nov its a telephone conference hearing has anyone else had one like this the defendants legal reps are to arrange it an send in docs etc 2 days before must admit am curious to see if they do as they havnt done anything before that the court ordered i will post any developments guys fingers crossed for me think ill need all the help i can get

well guys im busy printing yet again !!!! am getting nervous i must admit at least its a telephone hearing an im not in court i think it will be easy an less intimadating for me but all the same as the success rate isnt great at removing stays at the moment its adding to my nerves. I really hope not just for myself but for everyone that i get a result in my favour i am relying n the fact that YB didnt comply with court directions on handing in their bundle by 11th july an the test case hadnt been ordered by then i hope the judge can see that!!!!! has anyone else had their hearing by telephone conference as i havnt read anything on here

Just give it your best shot Jeanette, thats all you can do. We are all rooting for you, sorry I can't give you any advice on this, I'm totally green on anything to do with the legal system I'm afraid, hopefully someone can offer some advice though. Good luck girl, go get em!!!

well am ill with chest infection an am getting a temp through roof but my stay hearing is on monday have heard nothing since got letter from court am ringing in court in morning see what is going on am bit nervous sure will be more so as weekend goes on wish me luck guys think ill need it
