      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I do hope so SuzyQ, thats why I'm trying to get my bundle in as soon as I can.

 

I am off home now for the weekend so will check for stuff on Monday - gonna try and have a couple of days reading through what I have done and getting it in order, accompanied by some good food (hopefully prepared by my very good cook of a partner) and some nice chilled wine!!!

I've been reading your thread as I seem to be in almost the same position as yourself, can I just ask, after you refused the condtions for settlement how long did you have to wait before the money was actually put back into your account?

 

Oh and welldone.

 

 

The money isn't in my account yet.

I only crossed off one of the conditions in the end (the one about not going overdrawn again)

I phoned [problem] and they said it could take up to 5 weeks, I said they had until 19th July to pay (as per the judges orders as it will be 21 days after I served my bundle on them) or I will request Judgement from the court which won't look good on their client! (Doubt it will do much good - they are crap at [problem] they are only helpful on the phone if they can be bothered)

 

Im happy because I know the money is on its way.....

Hi

 

I sent off a letter stating that I'm not accepting their conditions and have given them a deadline for the money to be put back into my account. I just hope I haven't blown it, but I really don't see why I should accept any conditions.

When I phoned they told me the money could take 4-5 weeks to be paid into the account - I'm sure they were trying to fob me off yet again but you never know with the crap customer services that is [problem]!

 

Im sure you haven't blown it - I asked Gary the mod who said they have no right to impose conditions on your settlement so Im sure you will be okay.

 

When did you give then until?

I find the timescale of 4-5 weeks to pay money into an account very unbelieveable. Would they be paying the 5 weeks lost interest back into your account also. I have given them a very reasonable amount of time to settle, but we shall see.

Thanks for the congrats but I will wait until the money is in my account before I open the Champagne!!;)

Hi again susyq,

Just a quick note to say i also got my 'settlement' letter from [problem], saying they'll pay it all, incl. court costs (a grand total of £275), WOOHOO.:D

I take it you just crossed out the term re. staying within limits etc.

 

After all this i didn't even get to send off my carefully put together bundle :sad:

 

Don't know what's going on at the moment but i also got an out-of-the-blue pay rise this week.

they say things happen in threes, so i'm off to check my lottery tickets.;)

sounds like congrats for the above. Some of us are a bit behind you me inc, nailard v lloyds...... susy q been advising me. Starting to semi prepare a bundle just in case as looking that way, only just sent in aq and draft order for directions... can you tell me what the terms and conds r you mention? are they up to date ones? if I sent a stamped address envelope any chance you could send to me?? have they been scanned onto this site?

:D LTSB Paid me my first claim yesterday - all £1623.12 of it :D

 

Their timescale of 4-5 weeks is just another thing the people at [problem] say to p*ss us off.

It took 12 days from the day I posted it to the day it appeared in my account so all of you that are still waiting its on its way....

 

I posted my second settlement letter on the 6th July so hopefully by 18th July I will have that too

 

PS: I did book my family holiday yesterday - Alcudia here we come!!!!!:)

Suze, Iv just had the same letter (nailard v lloyds) saying without prejudice and confidential. did you return the letter agreeing to the terms? Im intending to send it back on Monday, had just done my draft order for directions and the cheque for the aq was supposed to be posted this morning, im only concerned that if we agree how long will it take for the dosh to go into the account as if we dont send the aq in by next week then it will be thrown out by judge. have you had the money yet skeggsy

It took them 12 days from the day I posted the letter back for the money to be paid into my account on the first claim -

I haven't had the money on the other account yet and their 12 days is up today (the money also didn't appear in the account until the middle of the day) and so I'm hoping the other amount gets paid today

 

Congrats on your lottery win :D Don't spend it all at once.

I crossed out the terms I didn't agree with and posted the letter back, like GaryH said they have no right imposing terms on your settlement so cross out what you don't agree with.

 

I honestly don't know what to do about the AQ and the allocation money - I never had that on my claim. I would be tempted to send it though to the court just in case so then you have covered your bases. Make sure [problem] have the extra court fees in with the settlement though

Congrats to you too, mine is for the dep on my wedding dress, among other things. letter sent back to **** today special next day delivery so will count down 2 weeks from 2moz. Now sent lba off on buss account with Lloyds and have started new thread for that skeggsy and nailard v lloyds.

 

I did sent the aq back with a cheque to the court and decided to continue until the money was actually back in the account, I didnt sent the letter to **** though with a copy of the draft order for directions as didnt want to risk confusing them. They had incorporated the fee for the aq in the sum paid out.

Hi SusyQ,

That gives me hope we sent the settlement letter back last tuesday and [problem] told me it would take 2 weeks for them to receive the letter as it goes to a " Secure location" then it would be another ten days before the money goes into our account. fingers crossed we get it in 12 days from posting.
