Hi, new on this forum but havent felt the need to post till just now as there is so much good information here, thanks for letting me be a silent participant until now.

 

I am currently at the stage of Litigation, and lloyds have until the 5th of may to acknowledge my claim.

 

my very recent problem i have is

 

1) I went 1.25 over my authorised overdraft limit on the 12th of april but i was 461 pound in credit on the 13th of april after getting paid. I was 1.25 other my authorised limit for less than 24 hours and I have now been charged a penalty of 30 pounds

 

2) On friday the 20th of april Lloyds were unable to make a standing order that i set up online because i wasnt paid on this day (i know i can claim this back from my employer but bare with me) I have now recieved another penalty of 35 pound for this.

 

 

Now am I completly P!ssed off about this.

 

1) how can they jusify a penalty of 30 pounds for a 1.25 slip up on the wrong side of my overdraft?

 

2) I set this standing order online to pay into my dads account, no other company is involved, there is nothing on my statement to say the bank attempted to make the standing order, i only made the standing order because it was easier to do then to write a cheque, I cant possibly see why they would have to charge 35 pounds for not making it, would they charge you 35 pounds to attempt to make a cash withdrawl at the cash machine of money you didnt have? no you'll just get a 'sorry you dont have sufficent funds'

 

I have rang customer services and they refuse to waiver the charges. Even after I explained the frankly shocking nature of circumstances and that I have just started a litigation against them.

 

I simply cannot afford to have 65 pound stolen off me at this time. (It will take a coupe of weeks to process my complaint through my employers to get my 35 pound back)

 

The charges will be TAKEN from my account at the beginning of May.

 

No what I am planning to do is close this account of Friday.

 

What I hope somone can help me with is will this affect my current case against lloyds, and can you see them refusing to close the account whilst these charges are unpaid? This is what the woman at customer services suggested!?

 

They will have to sue me to get that money there is no way on this earth I am paying more charges!!

 

Please help any adice welcome and I will promise to be more vocal from now on and contribute to this great forum:)

Hi Benjfrst, not much help now, but if you had done a bank transfer, you do it on the day you choice when there is money in the account.

They can't justify there charge's which is why we are claiming them!

Have you opened another account? I can not see LTSB letting you close an account which as far as they are concerned you owe money on,:rolleyes: even if someone on the phone did suggest it.

open another account have everything transferred to it leave nothing in the LTSB account and go from there.

I don't beleive it will have any effect on your current claim,( no doubt I will be corrected by someone with more knowledge than myself if I am wrong, but that is what this site is about:D ).

thanks for your reply, i do have another account with barclays which i have never actually used but it is still current.

 

I can switch over everthyhing fairly easy and leave a balance of zero but if i dont close the account down Im sure they will just dip into my overdraft to take the charges out. At a loss of what to do now.

OK benjfrst, I know for a fact they will not close the account till all monies owed have been paid:( transfer all credits etc to your barclays account NOW, and request the od is taken off, no longer needed. this has no effect on your case, once they take the charges you start over again reclaiming them:D then you pay that in and close the account.
