      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

can someone help me start off my claim for charges from my bank which date back to 6 years ago £30 each charge x3 (£90) every month.

i want my money back.

i didnt know i could claim this back until i seen it on the tv.

 

whats the first thing i should do

The first thing you do is read the FAQ's , then you read around the forum for a few days so you get to understand what you are undertaking .You can then follow the step by step guide

i recieved my statements after sending request for them with £10 cheque, i got a letter (not signed) with my returned cheque saying it is a free service.

my total charges are £875.00.

i have also noticed on my staements that i am paying to use my debit card, it started at £7.50 then rose upto £10.00 then again to £12.00 now it is £13.00, does anyone else have to pay for this service? my bank never sent me letters to tell me that the charges are going up, also i have been charged £56.04 for using other cash machines!! is this right. can i claim this back too?

my account fee charges add up to £321.50 plus machine charges £56.04 making the total charges i have paid to £1252.54

 

will i be able to get this back? please help.

 

once my question has been answered then i will be able to go to the next step asking for it back

Im not sure why Barclays are charging you for the card? Do you have any correspondance?

 

In respect the cash machine charges are lawful if not unfair so theres not anything you can do about that, as if you went to your bank ATM you wouldnt pay anything.

do i send out the 'peliminary approach for repayment letter' next asking for the charges of my overdraft and also add on the charges for my debit card use.

What is the type of account - the charges you are paying for use of debit card seem odd, as do the machine charges.

 

I have just had a look at the Barclays Bank website and they do not charge for use of the Debit Card, they also don't charge for the use of ATM's within the UK.

 

Is it possible that the debit card fees are for misuse?

Are the "machine charges" for use with UK ATM's?

yes each month i get charged, it started at £7.50 then it went up to £10 then £12 now its at £13.

ive not misused my card.

regards to the ATMs i use different bank machines which i now think is right i get charged for the use of them.

they said i have been informed about the charges for the use of my card.

im a barclays addition card holder which they said means that the service is what im paying for i.e. brakedown recoverery, free will service, pet insurance, holiday insurance and a load of other things i dont use.

 

they said that the charges have risen to £13.00 per month and that i was informed when i recieved my statemants, there was supposed to be a booklet with them telling me about the changes, unfortanatly i throw away these booklets as i thought they were junk mail.

 

regards to the charges i had accured using other bank machines they said i shouldnt of been charged them and they are looking into it but i will have to bring in my statements to show them what im talking about, they said i will get charged for using those machines in pubs and clubs which i have never used.

 

i will let you know when i get more info.

 

im just awaiting my letter from them for an offer to repay me back my charges

i too had my account changed without my knowledge or signature to the additions account. the cost is £10.00pm surely this monthly payment from my account should not have been debited without my written consent. the point of the account is of no use to me and the services they say we benefit from are not free they are just offered to us at a slightly lower price than usual. :mad:

thats right, they are not allowed to take your money without your consent, go to your bank and challenge them about it, they will probably tell you that they have sent you letters to confirm this with your statements,

i dont remember seeing any of these letters saying the charge has gone up.

 

thought i was the only one paying for this GREAT nonsense service

14 days up and i recieved my letter from bank saying that they have recieved my letter for repayment and they will be investigating it and that i should hear from them before june 13- thats an extra month!!!! should i send another letter telling them the clock is ticking and that they have a further 14 days to sort it out,

 

is the next letter the threatening letter i send to them warning them if they dont reply the next step will be court?

just got an offer from the bank of just £400 !!!!!!!! i dont think so,

letter was a gesture of goodwill

 

ill send my next letter letting them know its not enough.

 

is this ok? will they reconsider their offer?

ive looked in the templates and cant find the next letter to send out to the bank,

like i said they have offered me £400 back instead of the full refund of £1252.54

can someone please let me know which to send.

so i accept the £400 as an interim payment and ask for the full refund aswell?

where will i find that letter?
