    • Thanks, jk. I just find that nobody receives OOC now, and the letter said I could contact him if he can assist me further. So I’d like to send them another begging letter to show that I indeed realised my mistake. Isn’t this a good choice?

    • I had a sudden thought and went back to your NTH. There, they said that they had included all the necessary documents required for Hirers so you didn't chase NPE via the ICO for this thread.  So was it the St Thomas's hospital one or another thread that it happened.
    • Same company that tried to get us to pay 6 months worth of Utility bills after we had already moved out of that home. Turns out they just searched the phone book for the name of the previous tenant (us) and decided to threaten us, because why not! British gas were useless and it took a S.A.R  and 4 separate live chats to get them to stop the threats. I advise you do not deal with BWI at all and completely ignore them (unless they send a letter of claim, which they won't). NEVER call them, the number is premium. Go via british gas only. Get them to confirm in writing that you do not not owe them anything, and get them to stop BWI letters. It will probably take multiple attempts. Finally stop worrying here and now. You paid your bills, this debt is not yours, and there is no entity in this world who can make you pay what you do not owe. This is nothing but a mistake by incompetent and greedy BG and their idiotic DCA.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi riskman, I got LTSB's standard response, ie: sorry you are not happy, so went to my local court, as I am fee exempt, being unemployed, and started my claim, LTSB put in a defence, returned the allocation questionnaire (please note all this time I am reading this site, and using the templates library, because yes LTSB will take it as far as they can:rolleyes: and they are trying different tactics).

This morning I received notice of allocation from the court ie:the Judge has booked 20mins for me and LTSB to put forward our cases, (this is were I start putting together 3 copies of all correspondance and I will be going to GaryH(STAR) site got a court date with all the relevant Acts etc, my court bundle).

Its all here Riskman, and if I can do it you can:D read read and read some more. happy claiming:p

things are going along nicely, keep an eye on your account incase they pay your money in (I keep checking, but nothing yet:( )

Keep reading as much as you can, it is very much a waiting game, LTSB are in no hurry, it just feels like forever.

I have a HSBC claim ongoing, and I'm wondering if I'm a bit special as I have had an AQ for them as well!

Riskman, if the offer amount is for your claim, interest and fee as MB has said accept, but on the acceptance letter (never seen one:( ), you need to state that you do not accept any conditions that they are imposing, ie: you may in the future need to put in another claim if they have applied further charges, also no confidentiality, we want everyone to know:p
