    • An update - Still receiving emails and letters - but have been getting text messages too. nothing aggressive just asking me to get in touch.    the text makes it look like it from the bank on first glance - it reads -   'the banks name' would like to dicuss our recent communication...etc... then lists IDR phone number and email FYI - reporting them as spam
    • Hello, After seeing all of the posts about BMW on here I really wish I hadn't even considered them! I bought a used car from them over the weekend, one specifically which had a reversing camera and cruise control in the advert. I was foolish at the time of purchase and didn't check to see these functions work on the test drive (totally my fault). Now that the car is home I've checked and checked and neither of these functions are available. I even checked on Parkers and it seems that no Skoda Kamiq '21 models come with any parking cameras at all. When buying the car, I was told all that was needed was 'Four signatures and £500' to secure it. I was never shown any of the documents, and instead the sales rep opened a box on his iPad and asked me to sign. He had been complaining about the length of time some customers take these days all throughout my time with him. (Again) foolishly I signed. In my email inbox I now have four attachments from BMW, one of which is my signature under a letter which basically says that the cars don't need to match the advertisements online, or have any of the features that a sales rep talks about. I realise that I've made mistakes in not doing my due diligence here, but thought I might as well ask the experts here if I have any rights left to claim that the car was miss-advertised, or if I unknowingly signed them away? Thanks in advance

    • ah this is a B2B PCP then as your are sending the SAR as a private individual and not as repping the co. you need to prove to them. unfortunately, i think that will also reset the 30 days. dx

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Need someone else to confirm this view, but as its highly, highly unlikely theyll show up to court and very likely theyll make an offer at the last minute, prob worth asking for them in any settlement?

good news - all negotiations are with the solicitors. (Your mileage may vary with that opinion!)

bad news - charges since you started the claim are *not* included. If they really believe you when you say OK we'll settle this in full as it stands & you'll be hearing from me next week about the rest? See good news.

Hi

 

It might not be a bad idea to start the ball rolling now on the additional charges? That way you might be able to persuade them to cough those up as well (as part of the settlement of your current claim) instead of going through the court process again?

Can you give me a little bit of background please? Such as what you are claiming for exactly, and a brief summary of your claim so far would be great.

 

Also, have you complied with the courts directions (ie have you submitted a bundle)? And have Lloyds submitted anything?

hi gary im claiming for 1490 plus costs and interest which makes it 1829 ive sent the bundle (but got no conformation of) to the court and scm,lloyds have not submitted anything except thier basic defense a while back

no need they (scm) phoned today to say ive won and my money has been returned.gentlemen and ladies the dragon is slain now ive just got start all over again for the charges since the court case.anyway im off to the pub so if i post on here later and dont make any sense you know why,bottoms up!!!!!!!!!!!!!!!!!!!!!!!!!

Good on you and if they try to charge you for removing your money, go in with a biggish mate, an empty sports bag and demand your cash in full.

If you're of a biggish size yourself, you may omit the mate....

The price they charge for a bankers draft is ludicrous & since you aren't staying why are you paying?!

no im just going to start the process again for those,its under 200 quid but its mine,i shut my account down today as ive now got a better one,im hoping that this time they might pay up a bit sooner because they know that im willing to go all the way and that they dont scare me with their bully boy tactics
