    • Today , after a lot of years i received a letter from this lot. Very friendly, "Were writing to remind you that we haven't had any contact from you in a while".  The velvet fist, followed by  a veiled threat to get their preferred debt collectors involved. Yep dead right. In 1992/3 I took out a Student load under duress from DHSS. up to 2000 I had successfully gotten deferment on low income. But rather than sign on as unemployed ,I decided to be self employed. I applied and they asked for all sorts of documents. I obliged and then correspondence ceased from them, circa 2001. To date I have had no correspondence from Student Loans. I was made redundant in 2009 and reached 65 in 2012 , at which age the loan should have been cancelled. Now , today, 12 years on retirement and 11 ( at least years after last contact) I get a letter with veiled threats. Do I , as I smell a scam a) ignore it and hope that Erudio will think that this phishing attempt has failed or b) respond with a statute barred letter or c) remind them of legal terms that loan should be cancelled 12 years ago or d) combination of b) +c)      
    • But I'm not mixing and matching. Sure, when researching I do check multiple avenues, but when speaking, I will open a single post. The Fb post was made in March, it is now June, time has passed, and when the suggestion was made, no further information was given on how I should progress beyond "send a letter", which has meant that I've needed to start another stream - this one, but only after taking the time to research first.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi everyone,

I am a newbie to posting so hopefully i'm posting in the right place, if not apologies to you.

I started the reclaiming process through Martin's Money Expert site which compared to CAG is quite simple and to be honest i seem to spend most of my time going around in circles although i have picked up lots of help and advice just by reading other peoples postings.

I have sent off the letter requesting my statements for 6 years and enclosed the cheque for £10 but so far they haven't cashed it and they only have till Friday to respond

I had this trouble as i too started on Martins money expert site.

 

I did not send registered, but sent it into my local branch, i did receive the statements very quickly but they lost everything else, and i did not hear anything from them.

So i went into my local branch and they had a record of receiving it and posting it on, so i made them fax a copy over to head office.

 

I now send everything registered. I am now at the court stage, so good luck, there is so much advise here you cant go wrong now.

well the 40 days are up tomorrow and still no word, do i start to get the 7 day letter ready to send off tomorrow if they dont arrive, and who should i send it to this time and would sending it registered be a good idea?

 

i'm getting worried now because i thought at this stage things would have been easier, it seems from reading loads of threads that most people got their statements without to much trouble:sad:

Don't you believe it! There are literally hundreds of threads about people having no response to a SAR. Yes get ready to send the DPA non-compliance letter and yes definitely send it recorded and get proof of posting as well.

Don't worry, there are hundreds in same boat as you - the longer they delay, the worse it will be for them.

Hiya - I am in same situation to yourself - sent a recorded delivery to Barclays last Friday giving them 7 days to comply with sending out my summary of charges. No response to my previous request, no cashing of cheque, NOTHING!

I had a similar thing with Barclays, I rang their customer services department, I had my statements in 2 days, give that a try.

Thanks for that i was wondering whether to ring or not but wasn't sure what number to ring, hopefully though i will hear from them before the 7 days are up because i'm dreading having to go through court procedures.

Just an update - i posted my 7 day non compliance letter on monday recorded delivery and still not had anything back, does anyone have advice as to where i go from here if there is still no reply?

Hi everybody,

I had still not heard from Barclays, so i thought i would do what a few others have done and ring the customer service dept, with in minutes i spoke to a very nice lady and she printed my statements out and said that she would rush them through to the post room today so that i get them by Monday - amazing:-)

Hi everybody - update,

 

today i received my statements in full dated from Jan 2000, which is great, have gone through them and highlighted all my paid referrals, they come to £2178. Can anybody advise me as what to do next please?
